Please Substitute for Ordinance No 37 10Placed oni Reading and referred to theRules Ordinances Committee 5310 Placedon2d Reading517 10ORD<strong>IN</strong>ANCE N0 37 10 BYAN ORD<strong>IN</strong>ANCE to take effect August 1 2010 provided it receives the affirmativevote of at least five 5 members elected to Council otherwise it shall take effect andbe in force after the earliest period allow by law to amend Title Seven Parking of theTraffic Code within the Codified Ordinances ofthe City of Lakewood for the purpose ofupdating and expanding the Code and to be consistent with the Ohio Revised Code andto remove criminal penalties for parking violations to be consistent with newChapter309 of the Lakewood Codified OrdinancesandWHEREAS this ordinance is necessary for the public health welfare and safetyWHEREAS this Council by a vote ofat least five 5 members elected theretodetermines that this ordinance is an emergency measure and that this ordinance shalltake effect at the earliest date possible as set forth in ARTICLE III SEC<strong>TO</strong>NS 10 and13 of the SECOND AMENDED CHARTER <strong>OF</strong><strong>THE</strong> CITY <strong>OF</strong> LAKEWOOD and that it isnecessary for the immediate preservation ofthe public property health and safety andto provide for the usual daily operation of municipal departments in that this legislationmust go into effect simultaneously with the enactment of new Chapter 309 whichmakes all parking offenses in the City of Lakewood civil effective August 1 2010 Nowtherefore<strong>BE</strong> IT ORDA<strong>IN</strong>ED BY <strong>THE</strong> CITY <strong>OF</strong>LAKEWOOD STATE <strong>OF</strong> OHIOSection 1 That Chapter 351 Parking Generally within Title Seven Parking of theTraffic Code of the Codified Ordinances of the City of Lakewood currently reading asfollows351 01 LIMITATIONS ON PARK<strong>IN</strong>GNo person shall stand or park a vehicle except when necessary to avoid conflict withother traffic or with the provisions of this Traffic Code or in compliance with thedirections ofa police officer or a traffic control device in any ofthe following placesa On a sidewalk except a bicycle74J
