eport. 1 Because they elicited out of context deposition testimony from her about McIn<strong>to</strong>sh inanother case, they act as if she is an expert on causation.A. <strong>State</strong> Farm’s Reliance on Ms. Rigsby’s Deposition Testimony inMarion is Improper.To support its tale that a second report was needed, <strong>State</strong> Farm relies solely on a few out -of-context quotes from Ms. Kerri Rigsby’s deposition in an entirely separate matter, Marion v.<strong>State</strong> Farm, a deposition that <strong>State</strong> Farm <strong>to</strong>ok long after Ms. Rigsby’s deposition in this case. 2Notably, both counsel <strong>for</strong> Marion and counsel <strong>for</strong> Rigsby (as qui tam rela<strong>to</strong>r) properly objected<strong>to</strong> <strong>State</strong> Farm’s eliciting testimony about the McIn<strong>to</strong>sh claim in that deposition and furthermoved <strong>to</strong> strike it since it was beyond the scope of Marion counsel’s direct examination andcompletely irrelevant <strong>to</strong> the claims in the Marion matter:MR. VAN CLEAVE: John, if you would just allow me acontinuing objection <strong>to</strong> questions regarding the McIn<strong>to</strong>sh claim, Idon't think it's -- I think it's beyond the scope of cross and also notreasonably calculated <strong>to</strong> lead <strong>to</strong> discovery of admissible evidence.Will you allow me a continuing objection?MR.
