snirriG NOTES.
The U.S. S. Alert will sail for San Fran-
cisco in about a fortnight.
It is reported that the TJ. S. S. Nipsic is
to receive her euns and ammunition from
the U. S. S. Alert and that the latter vessel
will proceed to
The business on the wharves is very dull
at present; and, with the exception of
Brewer's wharf, there is comparatively
little activity at any of the wharves.
The four-maste- d Schooner Robt. Lewers
is to sail from Port Townsend on Novem-
ber 1st with about 1,000,000 feet lumber for
Messrs. Lewers fc Cooke. She may be
looked for by the 20th of this month.
The Gernian bark G. N. Wilcox is at the
P. M. S. S. wharf taking in ballast, and
the work of putting it on board was con-
tinued energetically last night. She will
probably get away to-da- y for Puget Sound.
The Swedish bark Ida has been moved
to the Kinau wharf, and underwent a sur-
vey last week. It is understood that the
vessel will have to undergo very extensive
repairs; but the owners being'so far dis-
tant, communications from them require
time.
The Hawaiian bark Lady Lampson, Cap-
tain Sodergrin, arrived October 2Sth, 24
days from San Francisco with a full cargo
of general merchandise comprising 100
barrels flour, 1,874 ctls. barley, and gen-
eral merchandise, value $21,700 consigned
to Messrs. Wilder & Co. She is docked near
.the old Custom House wharf.
The bark Ida finished unloading Thurs-
day, and a survey of the vessel will shortly
be made with a view to ascertain the dam-
age she has sustained. It is probable that
the vessel will be repaired upon the Marine
Railwav and afterwards reload her cargo
of lumber when she will proceed to her
destination. All this, of course, depends
upon the report of those who make the
survev.
"These appearances have been so
HAWAIIAN GAZETTE, TUESDAY, NOVEMBER 5, 1881.- -
SUPREME COURT.
october term,
at chambers.
Friday, Nov. 1.
before ius donor justice dole.
rUOBATE DIVISION.
In re estate of Thomas H. Hobron.
Probate of Will. The Court admits the
Will to probate, and appoints Mrs. Ho-
bron executrix to serve without bail.
W. 0. Smith attorney for petitioner.
CRIMINAL.
The Court was opened at 10 o'clock by
proclamation of Deputy Marshal Hop-
kins, the Chief Justice on the Bench.
The Attorney-Gener- al moved that the
names of Hiram Kaaha, B. H. Kahana-nu-i
and A. S. Mabaulu, charged with
conspiracy, be placed on the native cal-
endar. He stated that he was prepared
to present an indictment against them.
Motion was allowed and the Attorney-Gener- al
then read the indictment .charg-
ing the three defendants with the offense
of conspiracy in the first degree. The
defendants pleaded not guilty and their
cases were set for trial at the next term
of Court.
Order was now made that all those
persons indicted for conspiracy and riot,
except the three just previously ar-
raigned, should appear before the Court
at 1 o'clock. At 10 :25 the- - Court took a
recess until 1 o'clock.
AFTERNOON SESSION.
The Court assembled again atl o'clock
and seven of those indicted for riot, and
had pleaded not guilty, were brought be-
fore the bar of the Court. His Honor
ordered that they and all other cases of
those indicted for riot or conspiracy in
connection with the Wilcox affair of July
30th, should stand over to the next term
of Court, bail being set for each indict-
ment at $100.
Ho Fon, the Chinese, who had been
tried and found guilty by a jury, of con-
spiracy, was now presented before His
Honor for sentence.
Mr. Neumann, counsel for the defend-
ant, desiied to make a motion in arrest
of judgment on the ground that the in-
dictment under which the defendant had
been found guilty, charged that he was
engaged in the offence with one It. W.
Wilcox and divers other persons to the
Attorney-Gener- al unknown. He held
that all "the persons seemed to be known
to the Attorney-Genera- l, and a jury had
acquitted Wilcox.
The Attorney-Gener- al argued in favor
of having sentence passed and with which
the Court agreed. The Attorney-Gener- al
then stated he did not think that there
was a great deal in the case of Hie de-
fendant which would appeal to the
niercy of the Court. True, the defendant
was a young man, bad a young wife and
two young children. The speaker was
in hopes that the Court would not nnd
it necessary to imprison the culprit, but
if it should, or whatever-sentenc- e might
be passed, he hoped it would go to the
heart of this young man and teach him a
lesson that would be valuable to him
through after life.
His Honor addressing the prisoner
said, in substauce, that : the uttermost
limit that the Court would we authorized
to inflict in your case would be imprison-
ment for ten years at haid labor or a fine
of $1000. Jt is impossible to fully esti-
mate how much this, racket I might say,
affair of Wilcox's has cost the country.
1 do not refer to the actual expenses for
the services of persons to put down this
affair, nor that incurred in the trials,
nor the cost of repairs of damages to the
music hall, etc., I do not refer to those
although the amount therein must have
been several thousand dollars. I refer
more particularly to the damage that
cannot be definitely estimated, the in-
jury to our good name, the shaking of
values and the injury to us abroad is
worth manv hundreds of thousands of
dollars. If this country is reduced to
that condition that a revolution may
occur every few months or so then no
new enterprises will be undertaken and
people ot wealth will put their monies
away from here. It is evident that this
movement was started by people who
were dissatisfied, who were without em-
ployment largely and without money.
I could understand why Chinese who
had lived here a long time and had for-
merly voted were dissatisfied, because
they had no vole now. Yet you are a
young man of only 24 years of age ; you
were more of an agent in this than any-
thing else, and being a newspaper man
and understanding Hawaiian and Eng-
lish, you would naturally be a go be-
tween. Some Chinese have contributed
to the movement which has been the
means of bringing you here. I propose
that opportunity be given to make a
further contribution, and I fine you $250.
Mr. Neumann withdrew his notice of
motion in arresfof judgment and thanked
the Court for the leniency shown his
dient.
The Attorney-Gener- al now moved
that sentence be passed on J. M. Poepoe
and'as the prisoner had pleaded guilty
he considered ihat that fact should be
taken into consideration. He had hoped
that the Government would have been
in a position to commend the action of
defendant in giving assistance on the
side of the prosecution but the shifting,
hedging and fencing which Poepoe dis-
played while giving his evidence had
compelled the speaker to make up his
mind that the witness had forfeited any
special plea from the Crown.
His Honor before passing sentence
said : Mr. Poepoe there is but one tri-
bunal that can give exact and discrimin-
ating justice and that is the Divine one ;
I don't pretend to be able to do it.
When the chief in a criminal action gets
off there is a sympathy with others con-
nected that they do not suffer much.
My feeling now toward the Hawaiian
people is one of sadness and pity, not of
anger or hate in anyway but of pure pity
and sorrow that they did not rise to tho
degree of their manhood and do right. I
thought when you gave your evidence
tho other day you seemed desirous of
being on the popular side certainly in
giving your evidence you made speeches
to the jury and it may have influenced
them. I qannot help but think that
Poepoe knew that Wilcox had that con-
stitution with him and that he intended
getting it signed by force, but not as a
truthful witness would he say so. . .
. I cannot let the defendant off
with a nominal punishment, that would
be a mockery of the law. I hope that
after the penalty has been satisfied he'
will learn that his best interests do not
always lay on the popular side but on
tho side of right whether popular or un-
popular. The sentence of the Court is
that you pay a fine of $400.
James Ivauhano was next called for
sentence and after a brief account by the
Attorney-Gener- al of the shortconnection
of th prisoner with th oiguiiz.iti'iii,
und also the present titiou ot other ex
-- s-
tenuating circumstances he hoped that
the Court would pass a light sentence.
His Honor briefly addressed the pris-
oner saying that as he had pleaded
guilty without any promises being held
out to him and had afterwards been of
assistance to the Government in repair-
ing the damage done, would sentence
him to pay a fine of $100.
The Attorney-Gener- al now moved for
sentence on said Kepaa' and stated in
brief that although the prisoner had
been a member of the organization yet
he was sworn in under duress but as
