246THE CONSTITUTION OF INDIA(2) In this paragraph, a “reserved forest” means any area which is areserved forest under the Assam Forest Regulation, 1891, or under any otherlaw for the time being in force in the area in question.(3) All laws made under this paragraph shall be submitted forthwith tothe Governor <strong>and</strong>, until assented to by him, shall have no effect.1 4. Administration <strong>of</strong> justice in autonomous districts <strong>and</strong>autonomous regions.—(1) The Regional Council for an autonomous region inrespect <strong>of</strong> areas within such region <strong>and</strong> the District Council for an autonomousdistrict in respect <strong>of</strong> areas within the district other than those which are underthe authority <strong>of</strong> the Regional Councils, if any, within the district may constitutevillage councils or courts for the trial <strong>of</strong> suits <strong>and</strong> cases between the parties all<strong>of</strong> whom belong to Scheduled Tribes within such areas, other than suits <strong>and</strong>cases to which the provisions <strong>of</strong> sub-paragraph (1) <strong>of</strong> paragraph 5 <strong>of</strong> thisSchedule apply, to the exclusion <strong>of</strong> any court in the State, <strong>and</strong> may appointsuitable persons to be members <strong>of</strong> such village councils or presiding <strong>of</strong>ficers <strong>of</strong>such courts, <strong>and</strong> may also appoint such <strong>of</strong>ficers as may be necessary for theadministration <strong>of</strong> the laws made under paragraph 3 <strong>of</strong> this Schedule.(2) Notwithst<strong>and</strong>ing anything in this Constitution, the Regional Councilfor an autonomous region or any court constituted in that behalf by theRegional Council or, if in respect <strong>of</strong> any area within an autonomous districtthere is no Regional Council, the District Council for such district, or any courtconstituted in that behalf by the District Council, shall exercise the powers <strong>of</strong> acourt <strong>of</strong> appeal in respect <strong>of</strong> all suits <strong>and</strong> cases triable by a village council orcourt constituted under sub-paragraph (1) <strong>of</strong> this paragraph within such regionor area, as the case may be, other than those to which the provisions <strong>of</strong> subparagraph(1) <strong>of</strong> paragraph 5 <strong>of</strong> this Schedule apply, <strong>and</strong> no other court exceptthe High Court <strong>and</strong> the Supreme Court shall have jurisdiction over such suits orcases.(3) The High Court shall have <strong>and</strong> exercise such jurisdiction over thesuits <strong>and</strong> cases to which the provisions <strong>of</strong> sub-paragraph (2) <strong>of</strong> this paragraphapply as the Governor may from time to time by order specify.______________________________________________1. Paragraph 4 has been amended in its application to the State <strong>of</strong> Assam by the Sixth Schedule to theConstitution (Amendment) Act, 2003 (44 <strong>of</strong> 2003), s. 2, so as to insert the following subparagraphafter sub-paragraph (5), namely :—“(6) Nothing in this paragraph shall apply to the Bodol<strong>and</strong> Territorial Council constitutedunder the proviso to sub-paragraph (3) <strong>of</strong> paragraph 2 <strong>of</strong> this Schedule.” .
