Details of your local offices<strong>and</strong> contact numbers are available via their websitewww.citizensadvice.org.ukPaying the court feeA court fee is payable depending on the type ofapplication you are making. For example:• To apply <strong>for</strong> judgment to be set aside• To apply to vary a judgment or suspend en<strong>for</strong>cement• To apply <strong>for</strong> a summons or order <strong>for</strong> a witnessto attend• To apply by consent, or without service of theapplication <strong>notice</strong>, <strong>for</strong> a judgment or order.No fee is payable <strong>for</strong> an application by consent <strong>for</strong> anadjournment of a hearing if it is received by the courtat least 14 days be<strong>for</strong>e the date of the hearing.What if I cannot af<strong>for</strong>d the fee?If you show that a payment of a court fee wouldinvolve undue hardship to you, you may be eligible <strong>for</strong>a fee concession.For further in<strong>for</strong>mation, or to apply <strong>for</strong> a fee concession,ask court staff <strong>for</strong> a copy of the combined booklet <strong>and</strong><strong>for</strong>m EX160A - Court fees - Do I have to pay them?This is also available from any county court office, or acopy of the leaflet can be downloaded from our websitewww.hmcourts-service.gov.ukCompleting the <strong>for</strong>mQuestion 3Set out what order you are applying <strong>for</strong> <strong>and</strong> why;e.g. to adjourn the hearing because..., to set aside ajudgment against me because... etc.Question 5Most applications will require a hearing <strong>and</strong> youwill be expected to attend. The court will allocate ahearing date <strong>and</strong> time <strong>for</strong> the application. Pleaseindicate in a covering letter any dates that you areunavailable within the next six weeks.The court will only deal with the application ‘without ahearing’ in the following circumstances.• Where all the parties agree to the terms of theorder being asked <strong>for</strong>;• Where all the parties agree that the court shoulddeal with the application without a hearing, or• Where the court does not consider that a hearingwould be appropriate.Telephone hearings are only available in applicationswhere at least one of the parties involved in the caseis legally represented. Not all applications will besuitable <strong>for</strong> a telephone hearing <strong>and</strong> the court mayrefuse your request.Question 6If you do not know how long the hearing will take donot guess but leave these boxes blank.Question 7If your case has already been allocated a hearingdate or trial period please insert details of those datesin the box.Question 8If your case is being heard in the High Court or aDistrict Registry please indicate whether it is to bedealt with by a Master, District Judge or Judge.Question 9Please indicate in the box provided who you want thecourt to send a copy of the application to.Question 10In this section please set out the in<strong>for</strong>mation youwant the court to take account of in support of theapplication you are making.If you wish to rely on:• a witness statement, tick the first box <strong>and</strong> attachthe statement to the application <strong>notice</strong>. A witnessstatement <strong>for</strong>m is available on request from thecourt office.• a statement of case, tick the second box if youintend to rely on your particulars of claim or defencein support of your application.• written evidence on this <strong>for</strong>m, tick the third box<strong>and</strong> enter details in the space provided. You mustalso complete the statement of truth. Proceedings<strong>for</strong> contempt of court may be brought against aperson who signs a statement of truth without anhonest belief in its truth.Question 11The application must be signed <strong>and</strong> include yourcurrent address <strong>and</strong> contact details. If you agree thatthe court <strong>and</strong> the other parties may communicate withyou by Document Exchange, telephone, facsimile oremail, complete the detailsBe<strong>for</strong>e returning your <strong>for</strong>m to the courtHave you:• signed the <strong>for</strong>m on page 2,• enclosed the correct fee or an application <strong>for</strong> feeconcession,• made sufficient copies of your application <strong>and</strong>supporting documentation.
