the breach prior to the date specified in the notice, the Leaseand Sublease Agreement will not terminate. However, in theevent that such breach or a similar breach occurs after the 14day period provided in this paragraph, Landlord may deliverwritten notice to Tenant and the Subtenant that the Lease andSublease Agreement will terminate upon a date not less thansixty (60) days after receipt of the notice without providingthe opportunity to remedy the breach. The Lease and SubleaseAgreement shall then terminate as provided in such noticeregardless of the periodic rent-paying date.Landlord may terminate the Lease and Sublease Agreement if rentis unpaid when due following expiration of the time period fornotice and opportunity to cure specified under Section 2 aboveand, in addition to what is stated in Section 2 above, Subtenantfails to pay rent its portion of the rent within three (3) daysafter written notice by Landlord of nonpayment and suchLandlord’s intention to terminate the Lease and SubleaseAgreement if the rent is not paid within such 3-day period. The3-day notice in the previous sentence is not to be issued unlessand until the time allowed under Section 2 expires without therent having been paid. The 3-day notice period provided for inthis paragraph shall be computed as three consecutive 24-hourperiods. When such notice is served on Tenant the 3-day periodshall commence at the time of delivery. When such notice isdelivered by mailing, an additional two days from the date ofmailing should be allowed for Tenant to pay rent and therebyavoid having the Lease and Sublease Agreement terminated.Except as otherwise provided in the State’s Statutes governingLandlord Tenant Law, Landlord may recover damages and obtaininjunctive relief for any noncompliance by Tenant or “Tenant”with the Lease and Sublease Agreement.The provisions of this Section 19 shall not limit a Landlord’sor “Tenant”’s right to terminate the Lease and SubleaseAgreement pursuant to State’s Statutes governing Landlord TenantLaw, and amendments thereto..20. Notices and Disclosures. Except as stated in Section19 above, all notices or other communications shall be inwriting signed by the sender, and shall either be (a) personallydelivered, or (b) mailed by certified mail, return receipt8
