The <strong>City</strong> Procurement Office or Risk Management Office shall be the sole judge in making the determination thatdefective safety shoes were purchased.Catalogs, Price Lists and PricingVendors may <strong>of</strong>fer discounts from list price. The percentage discount(s) <strong>of</strong>fered to the <strong>City</strong> shall remain firm for the life<strong>of</strong> the contract including extensions.Vendors are to place on the Price List (item 1) all shoes that they <strong>of</strong>fer that meet the specifications listed above for thisRFQ. Replacement shoes will be provided at the same discount as the shoe(s) it replaces.The <strong>City</strong> also requests safety shoes (Price Sheet item 2) with other protective features beyond impact, compression, andpuncture resistance protection. Vendor(s) may also <strong>of</strong>fer a discount from contractor’s price list and/or from themanufacturer's published price list for any other safety shoes available from the contractor. Vendor’s price list(s) and/ormanufacturer’s published price catalog(s) must be submitted with bid response. Vendor’s price list(s) and/ormanufacturer’s published price catalog(s) may be in the form <strong>of</strong> print or CD/USB (thumb drive), or Internet web-site.Updates to the referenced price list and/or catalogs must be provided at no cost to the <strong>City</strong> <strong>of</strong> <strong>Douglas</strong> when available.Procurement Officer must be informed 30 business days in advance <strong>of</strong> new price lists and/or catalogs and the respectivedate(s). Updates may be in the form <strong>of</strong> print or CD/USB (thumb drive), or Internet web-site.If an employee purchases safety shoes not listed on the city safety shoes certificate, this must be noted on the vendor'sinvoice.DeliveryContractor(s) employees shall be sufficiently trained and possess the experience and knowledge to assist <strong>City</strong> employeeswith proper fitting and correct shoe application for all areas <strong>of</strong> use by employees. Mismatch service shall be provided forthose employees whose feet are different in size so that the employee requires two different sized safety shoes in order tohave appropriate and safe fitting shoes. Problems related to improper fit shall be satisfactorily and promptly addressed.The men's and women's sizes that are required include sizes 4-M through 17-W including half sizes. When female sizesare not available, contractor is asked to submit a conversion chart showing the appropriate male size (and stock number, ifthere is a change) that would be required to accommodate the women's sizes.The intent <strong>of</strong> resulting contracts is for the contractor(s) to provide the majority <strong>of</strong> <strong>City</strong> employees with safety shoesimmediately upon receipt <strong>of</strong> order. It is especially critical for new employees to receive safety shoes upon receipt <strong>of</strong> orderas they may not be able to perform their job duties without safety shoes.If an order is placed during normal hours <strong>of</strong> operation and it is not immediately available, delivery must be made directlyto that employee within seven (7) to ten (10) days for both standard and non-standard sizes unless written statement fromemployee direct supervisor or Risk Management Office is obtained by the contractor waiving the seven (7) to ten (10 )daydelivery period as being non-critical for said employee.Failure to comply with this requirement will result in a poor performance rating and may be cause for contracttermination.In the event the contractor fails to deliver safety shoes on time, the <strong>City</strong> may, at its option, give the contractor a five (5)day period in which to correct such deficiencies. Failure <strong>of</strong> the contractor to deliver safety shoes within this additionaltime period my result in the termination <strong>of</strong> the contract.4
