which, prior to the occurrence which gives rise to the claim, has beendeclared under any law, by-law or municipal ordinance to be adangerous animalIf You Have A ClaimWhat you must do:a) You must promptly give us notice in writing when an occurrencetakes place.The notice must include:(i) the date, time, place and circumstances of the occurrence;(ii) names and addresses of witnesses and potential claimants.b) You must not admit that you are legally liable. You may not know allof the facts. This means that you must not pay or offer to pay forbodily injury or property damage. It could be taken as an admissionthat you were legally liable.c) You must follow all conditions of the <strong>policy</strong> that deal with your claim.d) You must give us any letters or papers you receive from the people orthe representatives of the people making the claim. You must do thisas soon as you get them.e) You must co-operate fully with us while we handle your claim.f) You must co-operate fully in the legal matters we are handling foryou. You must not interfere in any legal action or discussion.What we will do:If a claim is made against you for which you are insured, we will defendyou even if the claim is groundless, false or fraudulent. We reserve theright to select legal counsel, investigate, negotiate and settle any claim ifwe decide this is appropriate. We will only pay for the legal counsel weselect. We will try to settle the claim out of court if we feel that is the bestthing to do.Defense Settlement — Supplementary Payments:We will:a) pay up to $100 a day for your actual loss of wages or salary when weask you to do something for us. For example, if we ask you to appearin court;b) pay for other reasonable expenses and court costs charged againstyou, including expenses which you have incurred for emergencymedical or surgical treatment to others following an occurrenceinsured by this <strong>policy</strong>;c) buy any appeal bonds;d) buy any bonds needed to release property held by the court becauseof the law suit. However, the total face value of these bonds cannotbe more than your applicable Amount of Protection;e) pay the interest that a court charges on the part of the final judgementthat we are paying.How We Settle A ClaimWe will not pay until you have fully complied with all the terms of thiscoverage, nor until the amount of your obligation to pay has been finallydetermined, either by a judgement against you or by an agreement thathas our consent.If we feel that you have done nothing wrong, we may refuse to pay aclaim. This does not mean that you will not be covered. It means we feelthat you are not legally liable. If, after we deny a claim on your behalf acourt finds that you are legally liable, you are covered.22
