CONSTRUCTION AND DESIGN DISPUTES• Conducting an ICC arbitration in Singapore relating to an allegedly defective 110MWe CFB boiler installed by a European supplier for use in an integrated pulp andpaper mill in Indonesia. The main issues related to cyclone separator inefficiency(leading to poor thermal transfer and erosion); high bed temperatures; excessiveflue gas velocities; furnace and back pass sizing; thermodynamics and inadequateID fan capacity• Successfully conducting an ICC arbitration in Singapore relating to a BFB boilerinstalled for use on an industrial park in Thailand. We successfully demonstratedthat the supplier was in breach of contract and liable to pay substantial damagesto the buyer• Advising the owners/operators of a RDF CFB boiler supplied to provide power tothe national grid and dispose of waste materials in relation to its defective designand installation. The matter was ultimately progressed to a favourable settlementafter we effectively demonstrated to the supplier the technical and legal basis ofthe claim• Advising NEXI of Japan on the financing and political risks associated withconstructing a US$170 million FPSO vessel to be used in an offshore block inSouthern VietnamINVESTMENT TREATIES & FOREIGN INVESTMENT PROJECTS• Advising the Government of India in connection with the US$6 billion claimbrought by General Electric, Bechtel and Enron as well as the offshore lendersunder a variety of BITs with India. We ultimately reached, negotiated andexecuted a very favourable settlement for the GOI ending a 15 year dispute withthe foreign investors• Advising a South-East Asian government on defending its first BIT claim inconnection with an alleged breach of a concession agreement relating to thefinancing, construction, maintenance and operation of a tollway13
• Advising the Government of Bangladesh in connection with a US$30m disputewith the operation and maintenance contractors of 2x150 MW open cycle powerplants in 2 international arbitrations in Singapore• Advising a public sector concern of India in connection with a proposed multilateralinvestment protection agreement between India, Pakistan and Iran to covera proposed US$7 billion gas pipeline supplying natural gas from Iran to India14
