CHAPTER 4NIGERIAN COMMUNICATIONS COMMISSIONRULES FOR THE ARBITRATION OF INTERCONNECTION ISSUES ANDDISPUTES1. INTRODUCTION1.1. These Rules shall be known as the <strong>Nigerian</strong> <strong>Communications</strong> Commission (hereinafterreferred to as “NCC”) rules <strong>for</strong> the arbitration of interconnection issues and disputes andshall govern the arbitration of open or unresolved interconnection issues which ariseunder Chapter VI Part 2 of the <strong>Nigerian</strong> <strong>Communications</strong> Act 2003.[2. COMMENCEMENT2.1. The arbitration process is commenced by the filing of a petition <strong>for</strong> arbitration in sixcopies with the Commission pursuant to Section 4(p) and 75(2) of the Act by any partyto the negotiation process (hereinafter referred to as the “Petitioning Party”) where thenegotiating process fails to reach an agreement within a period of ninety days.2.2. The arbitration process is deemed to have commenced on the date when thepetition is filed with the Commission.2.3. The petitioning party shall at the same time as it files the petition at theCommission serve copies on all parties to the negotiating process and obtain proofof service which should be filed at the Commission.2.4. The petition shall contain all relevant in<strong>for</strong>mation and documentation includingthe following:-(i)(ii)(iii)(iv)(v)(vi)The names, address, telephone numbers and fax number of the petitioner.The name, address, telephone numbers and fax number of the other party to thenegotiation.The names, address, telephone number and fax of the representative of the partieswho participated during the negotiation.Details of the negotiation history including any mediation process.A detailed statement identifying all unresolved issues and including all relevantdocumentation concerning those unresolved issues.A statement indicating the position of each of the parties concerning theunresolved issues including proposed remedies and copies of all relevantdocumentation relied upon or pertaining to those issues.23
