Article 3(1) Tangible movable State property of the SFRYwhich was located within the territory of the SFRY shall passto the successor State on whose territory that property wassituated on the date on which it proclaimed independence.(2) Paragraph (1) of this Article does not applyto tangible movable State property of great importance to thecultural heritage of one of the successor States and whichoriginated from the territory of that State, such as: worksof art; manuscripts, books and other objects of artistic,historical or archaeological interest to that State; andscientific collections and important collections of books orarchives which shall pass to that State. Such property shallbe identified by the successor State concerned as soon aspossible, but not later than 2 years after the entry intoforce of this Agreement.(3) If SFRY State tangible movable property (otherthan military property) which has passed to one of thesuccessor States in accordance with paragraph (1) of thisArticle, has been removed without authorisation, from itsterritory by another successor State, the latter state shallensure its return as soon as possible or pay fullcompensation for such removal.Article 4(1) Notwithstanding paragraph (1) of Article 3 ofthis Annex, tangible movable State property of the SFRY whichformed part of the military property of that State shall bethe subject of special arrangements to be agreed among thesuccessor States concerned.
(2) In relation to tangible movable and immovableproperty of the former Yugoslav National Army used forcivilian purposes the arrangements referred to in paragraph(1) of this Article will acknowledge the relevance ofArticles 2 (1) and 3 (1) of this Annex.Article 5(1) A Joint Committee on Succession to Movable andImmovable Property shall be established by the successorStates, which shall ensure the proper implementation of theprovisions of this Annex applicable to tangible movable andimmovable property (other than military property) and theresolution of any problems which might arise in the course oftheir application.(2) The Joint Committee shall commence its workwithin 3 months of the signature of this Agreement.Article 6It shall be for the successor State on whoseterritory immovable and tangible movable property is situatedto determine, for the purposes of this Annex, whether thatproperty was State property of the SFRY in accordance withinternational law.Article 7Where pursuant to this Annex property passes to oneof the successor States, its title to and rights in respectof that property shall be treated as having arisen on thedate on which it proclaimed independence, and any othersuccessor State’s title to and rights in respect of theproperty shall be treated as extinguished from that date.
