When it is not medically advisableto give such information to the patient, the information should be available to a legally authorized individual.D. Safety:<strong>Patient</strong>s have the right to expect reasonable safety in the performance of procedures <strong>and</strong> safety in theenvironment.E. Advance Directives:<strong>Patient</strong>s have the right to formulate advance directives <strong>and</strong> have their care providers comply with thesedirectives in accordance with applicable law.F. Refusal of treatment:<strong>Patient</strong>s have the right to refuse treatment to the extent provided by law <strong>and</strong> to be informed of the medicalconsequences of that refusal. <strong>Patient</strong>s who refuse care or treatment are responsible for the results of thatdecision.When refusal of treatment prevents the provision of appropriate care in accordance with ethical <strong>and</strong>professional st<strong>and</strong>ards, the relationship with the patient may be terminated upon reasonable notice.G. Research, educational or experimental procedures:<strong>Patient</strong>s have the right to information concerning research or experimental procedures proposed as a part oftheir care <strong>and</strong> have the right to refuse to participate in any such activity <strong>and</strong> refusal to participate will notjeopardize or affect care in any way.H. Request for Service:<strong>Patient</strong>s have the right to expect that within its capacity, the hospital will respond to a patient’s request forservice. Evaluation, service <strong>and</strong>/or referrals will be completed as indicated by the urgency of the case.<strong>Patient</strong>s have the right to consult with a specialist or change attending doctor at their own expense.I. Freedom from restraints:<strong>Patient</strong>s have the right to be free from restraints except when necessary to protect the patient from injury toself or others. The least restrictive restraint will be used whenever possible. Restraints must be administeredin accordance with SJMHS <strong>Patient</strong> Care Policy No. 240.J. Access to the medical record:<strong>Patient</strong>s have the right to read their medical record while on a patient care unit in accordance with SJMHSLeadership Policy No. 310. <strong>Patient</strong>s also have the right to read <strong>and</strong>/or obtain copies of their completedmedical record upon request in accordance with Medical Staff Policy. A fee is charged for copies of themedical record.K. Confidentiality of records:<strong>Patient</strong>s have the right to expect that communication <strong>and</strong> records regarding their care will be treatedconfidentially. Records will not be released except as authorized by patients or their legal representative, asrequired for transfer to another health care facility, or as required by law, or as required by third partypayment contracts.L. Privacy - personal <strong>and</strong> informational:<strong>Patient</strong>s have the right to privacy in treatment <strong>and</strong> in caring for their personal needs. This includes the rightto be interviewed <strong>and</strong> examined in surroundings designed to assure reasonable privacy.M. Presenting a Complaint:<strong>Patient</strong>s <strong>and</strong> their family members or guardians have the right to present complaints to SJMHS about anyaspect of the patient's care at SJMHS. <strong>Patient</strong>s <strong>and</strong> their families must be informed of their right to presentcomplaints <strong>and</strong> how to do so. This information is included in the brochure "<strong>Patient</strong> Guide" which is availablein all patient care areas. <strong>Patient</strong> Comment Cards are available throughout the hospital for patients' <strong>and</strong> familymembers' use in recording a complaint.
