Housing Panel. One ofthe major problems the Advisory Board's Housing<br />

Committee has had is that the decisions were made at the Board level but could<br />

not be implemented because merchantable title could not be delivered.<br />

The first order ofthe Trust should be to record the subdivisions and then the titles<br />

may actually be distributed. This process, as it is contemplated would require<br />

each Trust Participant to declare his intention but would not be able to close until<br />

a future date.<br />

The Board ofAdvisors has spent a considerable amount oftime reviewing the<br />

housing lists, vacant properties, and Petitions for Benefits. The Housing<br />

Committee, a sub group ofthe Advisory Board, made up ofthe local residents and<br />

the Board members who have knowledge ofthe community have met with dozens<br />

ofpetitioners. This Housing Committee can be expanded to include additional<br />

viewpoints ifnecessary but the implication that a new Housing Panel could do a<br />

better job or be more fair is not in keeping with the work that has already been<br />

done.<br />

Ifa new housing panel is created, it should also be stipulated that the<br />

representatives ofthe FLDS should not be any person who is cohabiting with a<br />

"re-assigned" spouse. Those individuals have a damaged moral compass and<br />

would not be able to be objective since they are in a compromised position and<br />

could only make decisions which would justify their own living situation.<br />

The petitioners for equity in housing and restoration ofdeeds or property could<br />

never be treated fairly by the same men who are now in possession oftheir homes<br />

and in custody oftheir families.<br />

A person would have to close their eyes to not see that the wholesale transfer of<br />

Trust assets to the management ofthe Church will create problems, not solve<br />

them. The UEP Trust was never intended to serve only the currently favored<br />

members. The revised trust has been fully developed and to date no one has<br />

identified any necessary amendments. The addition ofmore members including<br />

members to represent the FLDS has been discussed many times and would still be<br />

a good idea.<br />

The housing panel should be comprised ofthose Advisors who already have been<br />

engaged in the housing issues, plus any new Advisory Board members who want<br />

to be involved. Ifthat board ever makes a decision that can be called into question<br />

for fairness, then we could talk about limiting their number. The two by two plus<br />
