Terms and Conditions of Sale - <strong>Shorthorn</strong>Terms - Terms of the sale are cash. Mail Order bids are payable in full 14 days from sale date. 2% per month thereafter. Monies are payable in <strong>Canadian</strong> funds to theclerk, immediately following the sale. Animals and registration papers will not be released until payment is received in full.Guarantee - All serviceable age females have been pregnancy examined safe in calf by an accredited veterinarian giving an estimated length of gestation. This estimatedgestation period shall be used only as a guideline to calving, and not a guarantee of actual service. Open females will be guaranteed open as of sale day. Bullcalves, if failing to be satisfactory breeders will be replaced or credit given on purchase of a replacement. They must be returned to us for evaluation. In any event,the sellers are responsible only to the extent of the purchase price of the said animal. Each animal becomes the responsibility of the purchaser as soon as sold. TheStandard Guarantee as endorsed by the <strong>Canadian</strong> <strong>Shorthorn</strong> <strong>Association</strong> will apply.Insurance - Agents will be in attendance to insure your purchases. We strongly recommend that insurance is purchased for full value. Any sale animals not removedon sale day will be left at owner’s risk.Liability - All persons who attend the sale do so at their own risk. The owners, sale manager, ringmen and clerks assume no responsibility, legal or otherwise for anyaccidents or incidents which may occur.Health - All sale animals will be current on all vaccinations, etc., and Ivomeced prior to the sale.Registrations and Transfers - All cattle sell with completed certificates of registration and will be transferred to the new owners following payment in full.Announcements - Announcements from the auction block on sale day have precedence over any material printed in this catalogue.Mail Bids - We hope you will be able to attend this sale. In the event that you cannot be present, feel free to contact any of the sale representatives listed on Page 1 ofthe catalogue. They are knowledgeable and will handle your bids in a most confidential manner.Delivery - Assistance in making delivery arrangements will be provided wherever possible.Tibial Hemimelia - All consignments to the Hill Country Classic have been tested Tibial Hemimelia Free (THF), or are THF by parentage - both sire and dam havebeen tested Tibial Hemimelia Free.Terms and Conditions of Sale - Speckle ParkTerms: The terms are cash or cheque at par unless other arrangements have been made with the seller. Funds from outside countries will be accepted at current rate ofexchange. All payments must be made to the clerk of the sale and no release will be given until satisfactory settlement has been made.Disputes: In case of dispute, the animal will be again put up for advanced bids and if there are no advanced bids, the animal shall be sold to the person from whom theauctioneer accepted the last bid.Risk: All are at the purchasers risk as soon as sold, but will be cared for during a reasonable length of time after the sale.Certificate of Identification: <strong>Canadian</strong> Certificate of Identification, properly transferred to the purchaser, will be supplied for each animal. In the case of animalspurchased for export, the necessary custom papers, health charts and export certificates also will be furnished free of cost. Animals for breeding can enter the U.S. freeof duty.Errors: If errors are noted, corrections will be made from the auction stand, and will take precedence over any printed matter.Identification: Each animal sold shall have a readable tattoo corresponding to its Certificate of Identification.Warranties:(1) Each seller warrants clear title to the animal and the right of purchaser to sell same.(2) Unless otherwise noted in the catalogue or announced from the auction stand each animals is sold as sound.(3) Bulls - A bull is guaranteed by a breeder, if, during a six month period of trial, he settles cows by natural service or passes a fertility test by a competent veterinarian.Any guarantee with respect to freezing of semen must be by separate agreement between buyer and seller.(4) Females - Females determined as being safe with calf by examination, or with calves at side are considered breeders without further guarantee. Any female notpregnant when sold, or that on having reached the age of 20 months should fail to conceive after being bred regularly for 4 months to a bull known to be a breeder, shallbe reported in writing to the seller. The seller will be granted the privilege of a further period of 4 months to prove the female a breeder on his own premise. Satisfactoryadjustment shall be deemed to be replacement with another in-calf female of equal value, or refund of full purchase price, with the seller having choice.(5) Calves - There shall be no warranty on calves under 12 months of age, male or female, as in the manner in which they were cared for will largely determine theirbreeding ability. Full adjustment will be made however, in the event that a heifer calf under 12 months of age when sold should later prove to have been a freemartin.(6) The seller is not responsible for any damage caused by foreign bodies after the animals is sold, inclusive of mummified calves, nor for sickness not shown at Saletime.Options and Privileges of Return or Adjustment: All claims for adjustment or refund must be made in writing within six months of sale date. Warranties cease whenthe animal is disposed of by the original purchaser.Accidents: Every precaution will be exercised to protect the safety and comfort of those attending the sale.
