<strong>Local</strong> <strong>Property</strong> <strong>Tax</strong> – Frequently Asked Questionsperiod and without challenge to their right of occupation will be treated as ifthe occupant owns the property. In these circumstances, the occupant will beliable for <strong>LPT</strong>.• Where the residential property is rented on a normal short-term (less than 20year) lease, the landlord will be liable for <strong>LPT</strong>.• If you are acting as a personal representative for a deceased owner (e.g.executor/administrator of an estate) you will be liable for <strong>LPT</strong>.2.2 What if I jointly own the property?• Where there is more than one owner of the residential property, they need toagree who will make the relevant <strong>LPT</strong> Return and pay the tax.• If no one pays, Revenue can proceed to collect the tax due from any of theowners.3. Exemptions3.1 Will any propert<strong>ie</strong>s be exempt from <strong>LPT</strong>?Certain propert<strong>ie</strong>s will be exempt from assessment. These are• Newly constructed, unoccup<strong>ie</strong>d and unsold residential propert<strong>ie</strong>s.• Where ownership is vested in a public body or an approved charitablebody and used to provide accommodation to people with special housingneeds such as the elderly or people with disabilit<strong>ie</strong>s.• Where a principal private residence is unoccup<strong>ie</strong>d due to long term mental orphysical infirmity of the owner.• Mobile home, vehicle or a vessel.• <strong>Property</strong> fully subject to commercial rates.• Houses in certain unfinished developments (unfinished housing estates) asprescribed by law.• Residential propert<strong>ie</strong>s enjoying protection in other legislation – e.g. diplomaticproperty.Exemptions will also apply in the case of:• New and previously unused propert<strong>ie</strong>s that are purchased from a builder ordeveloper between 1 January 2013 and 31 October 2016 will be exempt untilthe end of 2016.• Second-hand propert<strong>ie</strong>s purchased by a first time buyer between 1 January2013 and 31 December 2013 will be exempt until the end of 2016.<strong>Local</strong> authority housing and social housing will not be exempt unless it is provided topeople with special housing needs such as the elderly or people with disabilit<strong>ie</strong>s.Liability will rest with the local authority or social housing organisation as owner.4
