GENERAL TERMS AND CONDITIONSI. PREFACE§ 1 General Scope1.1 These General Terms – referred to as „GT“in the following – apply to wharfage, berths andKiel’s port area operated by SEEHAFEN KIELGmbH & Co. KG – referred to as PORT OF KIELin the follwing. For using the railway constructionof PORT OF KIEL, separate General Terms doapply. For handling and storing goods by PORTOF KIEL as agent, the Tariffs for Port Services areto be regarded with priority.1.2 The port area is stipulated according to theannouncement of the port authority of the statecapital city of Kiel dated 30 November 2001 andcomprisesa) the inner Kiel Fjord, seawards limited by theline between the beacon on the northern moleof the “Scheerhafen” in the west and the cityborder between Kiel and Mönkeberg in theeastb) the lower Schwentine River from its mouth tothe bridge at the former Holsatia mill,c) the North Port at the Kiel Canal.1.3 For using the wharfage and berths, also theterms of the state order for ports in Schleswig-Holstein, the state order for safety in handlingdangerous goods in the ports of Schleswig-Holstein, the state order for the disposal of shipwaste and load residues in the ports of Schleswig-Holstein and the port usage order by the statecapital city of Kiel are to be applied in theirparticular and current versions for theirdesignated scope directly, otherwisecorrespondingly.1.4 The wharfage particularly includes openareas, cargo quays, ramps, entrances and exits,warehouses, passenger terminals, handlingfacilities and the special ferry quays.§ 2 Functions2.1 The wharfage serves the handling andrelated storage of goods as well as passengertraffic.2.2 The berths are designated to mooring oftheir assigned vessels.2.3 Trespassing on the wharfage is notpermitted. PORT OF KIEL reserves the right tocontrol entrance authorisations and banunauthorised persons or deny them access.§ 3 User Duties3.1 Every wharfage user and every client ofservices and deliveries of PORT OF KIEL at thequays acknowledges the terms of these GT andcommits to their compliance. Deviations are onlyvalid if confirmed by PORT OF KIEL in writing.3.2 Intructions of PORT OF KIEL personell areto be obeyed. Violations can result in deniedaccess to the wharfage.3.3 Regarding business correspondence withPORT OF KIEL, its established forms are to beused. This also refers to electronic forms whereavailable.§ 4 Tariffs4.1 Fees and tariffs are payable according to thevalid quay and port tariff when using wharfageand port area.4.2 Fees for services of PORT OF KIEL on andat the wharfage are stipulated in the effectiveversion of the Quay Tariff.4.3 For services by PORT OF KIEL that are notlisted in the tariff, special fees are agreed.
