The Year in Review 2010 5Our Nacogdoches officeprevented CitiMortgage fromtaking a client’s home in aforeclosure suit and, in theprocess, the firm obtained$500 in attorney’s fees.The client, Ms. Simpson, is a58-year-old disabled widowwho needs a constant supplyof bottled oxygen just tosurvive. In 1999, herhusband told her that he hadbeen offered a great deal on aloan from a company calledAllegiance Mortgage Group.He wanted to use the loan tofix their dilapidated house.That same day, Ms. Simpson andher husband went to a titleinsurance company and signed anumber of documents with verylittle understanding of what theywere signing.It turned out that the Simpsons hadagreed to a 30-year home equityloan with a high interest rate andsecured by their homestead. Ms.Simpson and her husbandfaithfully made payments on theloan for years. Even after Ms.Simpson’s husband died in 2000,she continued to make regularpayments until she suffered amassive heart attack in 2006.After her heart attack, Ms.Simpson found it difficult to keeptrack of her bills, and her medicalexpenses exhausted the resourcesshe had to make payments on herhome equity loan.Each time CitiMortgagecontacted Ms. Simpson, shetold corporaterepresentatives about hersituation. Nevertheless, themortgage giant refused towork out a paymentarrangement and continuallythreatened to foreclose onthe home. After severalyears of intermittentpayments by Ms. Simpson,CitiMortgage filed suit todeclare that it could sell Ms.Simpson’s home. In 2002, the City ofNacogdoches completely rebuiltMs. Simpson’s home usingCommunity Development BlockGrant funds. As a result of thisimprovement, Ms. Simpson’shome was appraised at over$50,000 for property tax purposeswhen CitiMortgage filed its suit.When Ms. Simpson contactedLSLA, we were able to quicklydetermine that the original loan didnot fully comply with therequirements of the TexasConstitution for home equity loansfor a homestead. After extensiveinvestigation, we were also unable tofind any evidence that the originallender, Allegiance Mortgage Group,
