The <strong>Code</strong> <strong>for</strong> <strong>Crown</strong> <strong>Prosecutors</strong>General Principles2.1 The decision to prosecute or to offer an individual an out-ofcourtdisposal is a serious step. Fair and effective prosecution isessential to the maintenance of law and order. It is the duty ofprosecutors to make sure that the right person is prosecuted <strong>for</strong>the right offence and to bring offenders to justice whereverpossible. Casework decisions taken fairly, impartially and withintegrity help to deliver justice <strong>for</strong> victims, witnesses, defendantsand the public.2.2 It is the duty of prosecutors to review, to advise on and toprosecute cases or to offer an appropriate out-of-court disposalto the offender. <strong>Prosecutors</strong> must ensure that the law is properlyapplied; that all relevant evidence is put be<strong>for</strong>e the court; andthat obligations of disclosure are complied with, in accordancewith the principles set out in this <strong>Code</strong>.2.3 Although each case must be considered on its own facts and onits own merits, there are general principles that apply to the wayin which prosecutors must approach every case.2.4 <strong>Prosecutors</strong> must be fair, independent and objective. They mustnot let any personal views about the ethnic or national origin,gender, disability, age, religion or belief, political views, sexualorientation, or gender identity of the suspect, victim or anywitness influence their decisions. Neither must prosecutors beaffected by improper or undue pressure from any source.<strong>Prosecutors</strong> must always act in the interests of justice and notsolely <strong>for</strong> the purpose of obtaining a conviction.2.5 The prosecution service is a public authority <strong>for</strong> the purposes ofcurrent, relevant equality legislation. <strong>Prosecutors</strong> are bound bythe duties set out in this legislation.3
