(2) An insurance company shall not, in a criminal action, be competent to bring a civil claimagainst an accused person for the recovery of compensation paid by it by virtue of a contract ofinsurance.Section 75:(1) A civil claim made in a criminal action, shall be entertained only where it is based on adirect, certain and actual damage.(2) Except where otherwise provided by law, a civil claim emanating from an offence shall bebarred after thirty (30)years even where it is embodied in a criminal action.Section 76: A party who brings a civil suit on the basis of specific facts, may afterwards, inrespect of the same facts, either link his action to that of the Legal Department, or undertake aprivate prosecution, provided that he withdraws his initial civil suit.Section 77: With the exception of international conventions, the provisions of section 76 shall beapplicable where the civil suit was brought in a foreign court.PART IITHE AUTHORITIES RESPONSIBLE FOR POLICE INVESTIGATIONCHAPTER IJUDICIAI POLICESection 78:(1) The duties of the judicial police shall be performed under the supervision of the StateCounsel by judicial police officers, judicial police agents and all other civil servants or persons towhom judicial police duties are assigned by law.(2) In this capacity, the persons referred to in the preceding sub-section shall be auxiliaries of theState Counsel.
