Who better to tellyou how to write a successful opposition than twomembers of the Board of Appeal?The third edition of the C-Book once again providescandidates with a wealth of information relevant toopposition practice. The key changes compared to thesecond edition include updated Guidelines referencesfollowing the revised Guidelines published in April <strong>2010</strong>and updated case law. For candidates of the EQE PaperC, a particularly useful addition is the charts given onpages 97 and 100 detailing the many required steps in awell constructed inventive step argument, both for„normal“ and „partial problem“ inventive step argumentationrespectively. The charts list each step, illustratehow each step was argued in the Examiners’ ReportC 2009 and provide an estimate of the number of marksawarded for each step with regard to use of informationand argumentation. Another addition is the hints andtips in relation to exam technique and strategy providedin the chapter entitled „Assessing your own Paper“.Bill and Hugo are both tutors for the respected CEIPIcourses. The authors teach at the Regional Pre-prepcourses, which take place in the Autumn, the mainPreparatory seminar, which is now scheduled in Novemberin Strasbourg, the „re-sitters“ course, also scheduledin November, and the „cramming“ course in early February.The various CEIPI Paper C courses aim to providecandidates of the EQE with all they need to know to passthe dreaded opposition paper. The C-Book summarisesmuch of what is taught at these seminars.Many EQE candidates have extremely limited oppositionexperience, if any, prior to sitting Paper C. As aconsequence, Paper C continues to cause candidates themost problems and has the lowest pass rate of the EQEFinal papers. It is simply impossible to pass Paper Cwithout a sound technique coupled with sufficient practice.Paper C of the EQE has undergone a remarkableevolution over the last 10 to 12 years. The ever increasingemphasis on argumentation and, in particular, bothinterpretation and the problem solution approach, mustbe appreciated and understood by candidates if they areto provide an opposition statement with sufficient detailto impress the examiners. Both these key aspects arediscussed at length in the C-Book.The specific technique or methodology explained inthe C-Book ensures that candidates focus on what isnecessary to pass the examination, namely robust analysisand detailed argumentation, with constant referenceto where the information relied upon is to be found inthe papers. On top of this, the C-Book provides usefulguidance on how to set out an opposition statement,how to tackle the legal aspects of the exam paper andprovides important tips for exam technique and strategy.The C-Book also provides information regarding essentialaspects such as added subject matter, entitlement topriority, state of the art, claim dependencies, how to dealwith ranges within a claim, etc.Candidates who read, understand and put into practicethe methodology and information provided in theC-Book will be well equipped to sail over the biggesthurdle of the EQE.1 W.E.
