This notice provides additionalwaivers and alternative requirements toseveral Hurricane Sandy grantees—theState of New York and the State of NewJersey.II. Applicable Rules, Statutes, Waivers,and Alternative RequirementsThe Appropriations Act authorizesthe Secretary to waive, or specifyalternative requirements for anyprovision of any statute or regulationthat the Secretary administers inconnection with the obligation by theSecretary or the use by the recipient ofthese funds (except for requirementsrelated to fair housing,nondiscrimination, labor standards, andthe environment). Waivers andalternative requirements are based upona determination by the Secretary thatgood cause exists and that the waiver oralternative requirement is notinconsistent with the overall purposesof Title I of the Housing and CommunityDevelopment Act of 1974 (42 U.S.C.5301 et seq.) (HCD Act). Regulatorywaiver authority is also provided by 24CFR 5.110, 91.600, and 570.5.This section provides additionalwaivers and alternative requirements toseveral Hurricane Sandy grantees.
