Please quantify what is meant by “long-term”?3.31 “Monitoring will provide supplementary baseline information in 2012 on the species, numbersand colonies <strong>of</strong> bats using the tunnel to enable comparisons to be made with surveys undertakenpost-construction.”16. Will the surveys conducted in 2009, 2010 and 2011 also be used to produce the base-line?17. If less species <strong>of</strong> bat use the tunnel in 2012 than 2011, will the reduced number <strong>of</strong> species be usedas the base-line?18. If there are fewer bats using the tunnel, as has been the case each year since the “enhanced”BicesterLink service was introduced in May 2009, will the lower number in 2012 be used?3.33 “Any significant decrease in bat use <strong>of</strong> the tunnel, or significant increase in bat casualtieswill be further investigated and, remedial action implemented by <strong>Chiltern</strong> Railways, in agreementwith Natural England.” (emphasis added)19. Please quantify “significant”.20. Has <strong>Chiltern</strong> Railways and/or Natural England already considered what would be appropriateremedial action? If so, please provide details.3.40 “In the event two unscheduled trains were to cross within the tunnel the pressure changewould be somewhat greater.”21. What is an “unscheduled” train?22. Please quantify “somewhat”.3.41 “Based on the results <strong>of</strong> these surveys, and evidence <strong>of</strong> the effects <strong>of</strong> changes in air pressureon bats elsewhere, Natural England is now satisfied that the changes in air pressure resulting fromincreases in train speed will remain below the level that might cause harm to bats roosting in orusing the tunnel.”23. Does the “evidence <strong>of</strong> the effects <strong>of</strong> changes in air pressure on bats elsewhere” only relate to batdeaths at wind turbines? If not, please provide further details.3.44 “Under Regulation 58 <strong>of</strong> the Habitats Regulations (and other provisions), Natural England haswell established powers to enforce the provisions <strong>of</strong> the EPS Licence, if necessary, through thecourts.”3
