Testimony of Agent MaralesSalvador MoraEes, anenforcement agent with TABC for 18 years, was at the Tap Bar on July12, 20<strong>03</strong>, working undercover in a sales-to-iutoxicatedpersons' opesat ion. He testsed that heenteredtheTap Bar at 7p.m., observed thesurroundings, and leR. He said that hereturned to theTapBar at I 0 p.m He said that he noticed that the same man-later identified as Julio Lopez-that b d beensitting at the bar at 7 p.m. was still there. Because of the length oftime that had elapsed since his fistvisit to the bar, he began to observe the individual. Agent Morales testified that he sat two seats overEon the individual, and observed the man ta be drinking beer; to have slow eye movement; to raiseand lower hs voice as he spoke in a repetitive manner; and to close his eyes and drop his head as ifhe were falling asleep. He observed this conduct for about 15 minutes, Wkile the man was seated atthe bar, and displaying the descnied symptoms, an employee working behind the bar, Maria Palacios,served him another 12 oz, bottle of beer. Mr. Lopez was thereafter arrested for public intoxication.Agent Morals made cantact with Mr. Lopez later at the ja$. He testified that Mr. Lopez was yeUingand screaming, and making animal noises.b. Testimony of Agent HeidtmanTimothy W. Heidtman, Jr., an enforcement agent with TABC, was part of the identificationteam, and he was contacted by agent Morales on July 12,20<strong>03</strong>, about a possible intoxicated person,so went inside the Tap Bar. He testitied that Mr. Lopez showed classic signs of intoxication: wateryeyes, slow movement, and slumping. He escorted Mr. Lopez outside, He said Mr. Lopez wasuncooperative and had a strong odor of alcohoIic beverage on his breath. He testified that heconcluded Mr. Lopez was very intoxicated.
