o) Any notice to the bidder shall be deemed to be sufficiently served if given or left <strong>in</strong>writ<strong>in</strong>g at the address mentioned <strong>in</strong> the tender, Collector and Chairman, District <strong>Rural</strong>Development Agency, shall not be responsible <strong>for</strong> any postal delay.9. OPENING OF TENDERS AND EVALUATION:9.1. The tenders received upto 3.00 P.M by the Collector and Chairman, District <strong>Rural</strong>Development Agency, District or his authorised person on will be opened by theCollector and Chairman, District <strong>Rural</strong> Development Agency, District, or his authorisedperson at 4.00 P.M. onat DRDA, District <strong>in</strong> the presence <strong>of</strong> such <strong>of</strong> thosetenderers or their representatives with letter <strong>of</strong> authority who may be present at the time <strong>of</strong>open<strong>in</strong>g. The representatives <strong>of</strong> the tender<strong>in</strong>g firms who are attend<strong>in</strong>g the open<strong>in</strong>g <strong>of</strong> thetenders should br<strong>in</strong>g a letter <strong>of</strong> authority from the tender<strong>in</strong>g firms, which they represent, toidentify their bona-fide.9.2. The Collector and Chairman, District <strong>Rural</strong> Development Agency will evaluate andcompare the tenders, which have been determ<strong>in</strong>ed to be substantially responsive <strong>for</strong> eachschedule separately.9.3. The evaluation <strong>of</strong> a tender will take <strong>in</strong>to account, <strong>in</strong> addition to the tender price (Exfactory/ ex –warehouse / <strong>of</strong>f-the-shelf price <strong>of</strong> the goods <strong>of</strong>fered from with<strong>in</strong> India, such priceto <strong>in</strong>clude all costs as well as duties and taxes paid or payable on components and rawmaterial <strong>in</strong>corporated or to be <strong>in</strong>corporated <strong>in</strong> the goods, Excise duty and Octroi etc on thef<strong>in</strong>ished goods, (if payable) and price <strong>of</strong> <strong>in</strong>cidental factors.9.4 The District Collector and Chairman, DRDA, District reserves the right to negotiate withthe Bidder whose <strong>of</strong>fer is the lowest evaluated price strictly accord<strong>in</strong>g to TamilnaduTransparency <strong>in</strong> Tender Rules, 2000.9.5. The f<strong>in</strong>al acceptance <strong>of</strong> the Tender is entirely vested with the District Collector andChairman, DRDA who reserves the right to accept or reject any or all <strong>of</strong> the tender <strong>in</strong> full orpart.10.AWARD OF CONTRACT:10.1. The successful tenderer will be notified by a letter sent by registered post to theaddress shown on tender that his tender has been accepted. A further security equivalent to4% <strong>of</strong> the contract price shall be remitted with<strong>in</strong> 7 days from the date <strong>of</strong> acceptance <strong>of</strong> thetender. The tenderer shall attend the <strong>of</strong>fice <strong>of</strong> the Collector and Chairman, District <strong>Rural</strong>Development Agency on the date fixed and sign an agreement <strong>in</strong> the prescribed <strong>for</strong>m <strong>in</strong> a8Bidders Signature with seal
