These notes refer to the Childcare Act 2006(c.21)which received Royal Assent on 11 July 2006provision for the National Curriculum for England including the foundation stage (whichcurrently covers children from the age of 3 to the end of the school year in which they turn 5).As the Early Years Foundation Stage will cover all such children, provisions relating to thefoundation stage are being removed from Part 6 of the Education Act 2002.Section 49: Inspections112. Section 49 relates to inspection of early years provision and requires the ChiefInspector to inspect early years provision at intervals (to be prescribed in regulations) and onrequest from the Secretary of State. It also allows the Chief Inspector to inspect early yearsprovision at any other time when he considers it appropriate.113. Subsection (3) allows regulations to be made setting out circumstances in which theChief Inspector will not be required to carry out an inspection when it falls due. Regulationscould, for example, provide that an inspection is not required where the provider does nothave any children on the roll.114. Subsection (4) allows regulations to be made providing that the Chief Inspector is notrequired to carry out an inspection at an independent school where the early years provisionwould be inspected by a body approved by the Secretary of State.115. Subsection (6) provides for regulations to require the registered person to notifyparticular people of an inspection.Section 50: Report of inspections116. This section sets out requirements for the Chief Inspector to report in writing on anyearly years provision which he inspects and makes provision for the distribution of copies ofthe report. Subsection (4) applies subsections (2) to (4) of section 11 of the Education Act2005. This provision allows the Chief Inspector to publish the report by electronic means andprovides for reports to be privileged for the purposes of defamation unless they have beenmade with malice.Section 51: Interpretation of Chapter 2117. This section defines the meanings of terms used in Chapter 2 of Part 3.Chapter 3: Regulation of Later Years Provision for children under 8Section 52: Requirement to register: later years childminders for children under eight118. This section prohibits persons from providing later years childminding for children upto the age of 8 unless they are registered in Part A of the general childcare register aschildminders. There is provision for the Secretary of State to exempt providers by order fromthe requirement to be registered.119. Subsection (4) sets out what happens where a person who should be registered as alater years childminder under subsection (1) fails to do so. In such cases the Chief Inspectormay serve an enforcement notice on that person and that person may then be prosecuted ifthey continue to care for children without being registered (see subsection (7)). The noticewill stay in effect until revoked by the Chief Inspector.16

This section sets out the requirement for registration for later years providers (otherthan childminders) providing childcare for children up to the age of 8. Such later yearsproviders must be registered in respect of particular premises.121. Subsection (2) specifically exempts from this requirement later years provision madeat a maintained school, non-maintained special school or independent school where thatprovision is made by the school and one or more pupils attends it. Subsection (3) makesprovision for the Secretary of State to exempt providers by order from the requirement to beregistered. It is an offence to provide non-exempted later years provision withoutregistration.Section 54: Applications for registration: later years childminders122. This section deals with applications for registration as a later years childminder forchildren under 8. It requires applicants to give certain information to the Chief Inspector andpay any prescribed fee. The Chief Inspector must register the person if they are notdisqualified from registration and any requirements for registration are satisfied and are likelyto continue to be satisfied. A person may be disqualified from registration by regulationsmade under section 75. These may be used to disqualify, for example, persons on the listkept under section 1 of the Protection of Children Act 1999 (c.14). Registration requirementsmay include requirements relating to the premises on which the provision is to be provided.Section 55: Applications for registration: other later years providers123. This section deals with applications for registration by other later years providers(who are not childminders) for children under 8. Applicants are required to give certaininformation to the Chief Inspector and pay any prescribed fee. As with applications forchildminding, the Chief Inspector must register the person if they are not disqualified fromregistration and any requirements for registration are satisfied and are likely to continue to besatisfied.Section 56: Entry on the register and certificates124. This section requires the Chief Inspector to enter successful applicants in Part A of thegeneral childcare register and give them a registration certificate. Should changes incircumstance mean that the certificate needs to be changed then the Chief Inspector must givethe registered person an amended certificate. The Chief Inspector must also provide a copy oflost or destroyed certificates on payment of a prescribed fee.Section 57: Special procedure for registered early years providers125. Section 57 requires the Chief Inspector, on request, to register a person in Part A ofthe general childcare register if he is already registered as an early years provider in the earlyyears register.126. For providers other than childminders this applies only where the care for over 5s isbeing provided on the same set of premises as the care in respect of which the provider isregistered in the early years register.127. The usual rules about amendment and loss of certificates apply to certificates grantedunder this special procedure (see subsection (3)).17
