RIGHTS AND RESPONSIBILITIESA brief translation of tenancy law<strong>The</strong> landlord cannot discrim<strong>in</strong>ate (as def<strong>in</strong>ed by the Human Rights Act) aga<strong>in</strong>st prospective tenants.This means it doesn’t matter what <strong>you</strong> look like, where <strong>you</strong>’re from, what <strong>you</strong> believe or who <strong>you</strong>shag, <strong>you</strong> should be treated equally and with respect.TENANTS are responsible for:– Pay<strong>in</strong>g <strong>you</strong>r bond and rent on time– Pay<strong>in</strong>g for <strong>you</strong>r utilities like electricity, phone, gas, etc if <strong>you</strong> use them– Tell<strong>in</strong>g the landlord if there’s someth<strong>in</strong>g wrong with the flat –whether it was <strong>you</strong>r do<strong>in</strong>g or not– Fix<strong>in</strong>g (or pay<strong>in</strong>g for) any damage <strong>you</strong> do <strong>to</strong> the flat beyond normalwear and tear– Fix<strong>in</strong>g (or pay<strong>in</strong>g for) any damage <strong>you</strong>r visi<strong>to</strong>rs do– Keep<strong>in</strong>g the place reasonably clean and tidy– Not lett<strong>in</strong>g anyone live <strong>in</strong> the flat who isn’t on the lease– Mak<strong>in</strong>g sure noth<strong>in</strong>g illegal is go<strong>in</strong>g down at the flat<strong>The</strong> LANDLORD is responsible for:– Tak<strong>in</strong>g care of the paperwork– Giv<strong>in</strong>g <strong>you</strong> a receipt for <strong>you</strong>r bond– Send<strong>in</strong>g <strong>you</strong>r bond <strong>to</strong> the Department of Build<strong>in</strong>g and Hous<strong>in</strong>g with<strong>in</strong>23 work<strong>in</strong>g days– Mak<strong>in</strong>g sure the flat and grounds are reasonably clean and tidy when<strong>you</strong> move <strong>in</strong>– Keep<strong>in</strong>g the flat ma<strong>in</strong>ta<strong>in</strong>ed <strong>to</strong> a reasonable state of repair – thismeans no leaks, holes, health hazards, etc– Fix<strong>in</strong>g th<strong>in</strong>gs <strong>in</strong> a timely manner if <strong>need</strong>ed– Pay<strong>in</strong>g <strong>you</strong> back if <strong>you</strong> have <strong>to</strong> fix someth<strong>in</strong>g urgently (but only if<strong>you</strong>’ve tried <strong>to</strong> contact them first and it wasn’t someth<strong>in</strong>g <strong>you</strong> brokeby be<strong>in</strong>g a dick)– Pay<strong>in</strong>g the rates and other property costs– Try<strong>in</strong>g their best <strong>to</strong> s<strong>to</strong>p any of their other tenants fromdisturb<strong>in</strong>g <strong>you</strong>r peaceonce the heatpump arrives <strong>in</strong> April. If an <strong>in</strong>crease isn’t written <strong>in</strong><strong>to</strong><strong>you</strong>r agreement, <strong>you</strong>r rent has <strong>to</strong> stay the same the whole time. If thelandlord doesn’t fulfill the agreement, for <strong>in</strong>stance, if <strong>you</strong>r agreementsays that a heat pump will be <strong>in</strong>stalled by March and it isn’t, pop <strong>in</strong><strong>to</strong>Student Support and we’ll help <strong>you</strong> out.If <strong>you</strong>’re on a periodic lease, <strong>you</strong>r landlord can put the rent up if theygive <strong>you</strong> 60 days notice. BUT, they can’t do this <strong>in</strong> the first 6 months of<strong>you</strong>r tenancy, and they can’t do it aga<strong>in</strong> for 6 months after putt<strong>in</strong>g upthe rent.Gett<strong>in</strong>g th<strong>in</strong>gs FixedIf someth<strong>in</strong>g <strong>need</strong>s fix<strong>in</strong>g at the flat, let the landlord <strong>know</strong>. It’s a goodidea <strong>to</strong> put th<strong>in</strong>gs <strong>in</strong> writ<strong>in</strong>g as well.If the landlord doesn’t do anyth<strong>in</strong>g <strong>you</strong> can give them a ‘10 work<strong>in</strong>gdays letter’ which is official notice that they <strong>need</strong> <strong>to</strong> meet theirresponsibilities otherwise <strong>you</strong>’ll take the matter further. Emailhelp@ousa.org.nz, phone 479 5448 or pop <strong>in</strong><strong>to</strong> 5 Ethel Benjam<strong>in</strong> Pl.Your landlord must give notice before com<strong>in</strong>g <strong>in</strong><strong>to</strong> <strong>you</strong>r flatunless it’s an emergency. <strong>The</strong>y have <strong>to</strong> give <strong>you</strong>:– 24 hours’ notice before com<strong>in</strong>g <strong>to</strong> fix someth<strong>in</strong>g (or send<strong>in</strong>gsomeone else <strong>to</strong> fix someth<strong>in</strong>g, like a plumber or exorcist)– 48 hours’ notice before com<strong>in</strong>g <strong>to</strong> do a flat <strong>in</strong>spection.Rent IncreasesIf <strong>you</strong>’re on a fixed-term lease the landlord can’t put the rentup unless they write it <strong>in</strong><strong>to</strong> <strong>you</strong>r tenancy agreement. <strong>The</strong>ymight write someth<strong>in</strong>g like “heatpump <strong>to</strong> be <strong>in</strong>stalled <strong>in</strong> April,from which po<strong>in</strong>t rent will <strong>in</strong>crease by $5 per week” and if <strong>you</strong>sign the agreement, then <strong>you</strong>’re agree<strong>in</strong>g <strong>to</strong> pay more rent<strong>OUSA</strong> Flatt<strong>in</strong>g Mag – 11
