By <str<strong>on</strong>g>the</str<strong>on</strong>g> time <str<strong>on</strong>g>of</str<strong>on</strong>g>making <str<strong>on</strong>g>the</str<strong>on</strong>g> final decisi<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g>route we will have taken into accountboth engineering and operati<strong>on</strong>al needsand costs, as well as any commentsor suggesti<strong>on</strong>s you or your agent havemade. If at this stage we are unable toagree with any suggesti<strong>on</strong>s or objecti<strong>on</strong>sthat you have we will explain <str<strong>on</strong>g>the</str<strong>on</strong>g> finaldecisi<strong>on</strong> to you in writing.15. The period <str<strong>on</strong>g>of</str<strong>on</strong>g> notice allows time <str<strong>on</strong>g>for</str<strong>on</strong>g>any objecti<strong>on</strong>s to be addressed be<str<strong>on</strong>g>for</str<strong>on</strong>g>ewe start work. At <str<strong>on</strong>g>the</str<strong>on</strong>g> end <str<strong>on</strong>g>of</str<strong>on</strong>g> that timewe hope that matters between us willhave been agreed. However, if you d<strong>on</strong>ot permit us access to your land inaccordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> notice we gave youwe are able to apply to a Magistrate <str<strong>on</strong>g>for</str<strong>on</strong>g>a warrant to do so.16. Once we start work we will adhere to<str<strong>on</strong>g>the</str<strong>on</strong>g> notified route as far as possible. Wewill c<strong>on</strong>sult with you if we are not able todo so. If we find that we need to makesignificant changes that you are unableto agree <str<strong>on</strong>g>the</str<strong>on</strong>g>n we will serve anew notice.17. If, <str<strong>on</strong>g>for</str<strong>on</strong>g> any reas<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> works do notstart <strong>on</strong>, or shortly after <str<strong>on</strong>g>the</str<strong>on</strong>g> proposeddate, we will advise you <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> amendedtiming. Once <str<strong>on</strong>g>the</str<strong>on</strong>g> proposed starting dateis determined we should be able to giveyou a reas<strong>on</strong>able idea <str<strong>on</strong>g>of</str<strong>on</strong>g> how l<strong>on</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g>works will take and also how l<strong>on</strong>g weanticipate any reinstatement will take.Once a statutory notice has been servedyou should not do anything <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> landin questi<strong>on</strong> that might hinder or preventus exercising our statutory rights, but youshould c<strong>on</strong>tinue your normal agriculturaloperati<strong>on</strong>s up to <str<strong>on</strong>g>the</str<strong>on</strong>g> actual time <str<strong>on</strong>g>of</str<strong>on</strong>g> entry.If you are in doubt, please c<strong>on</strong>tact us <str<strong>on</strong>g>for</str<strong>on</strong>g>advice and clarificati<strong>on</strong>.Timing <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> works18. Within engineering, operati<strong>on</strong>al ando<str<strong>on</strong>g>the</str<strong>on</strong>g>r c<strong>on</strong>straints we will undertake <str<strong>on</strong>g>the</str<strong>on</strong>g>works at <str<strong>on</strong>g>the</str<strong>on</strong>g> time which will cause leastdamage to <str<strong>on</strong>g>the</str<strong>on</strong>g> land.Compensati<strong>on</strong>19. If we cause any permanent loss in <str<strong>on</strong>g>the</str<strong>on</strong>g>value <str<strong>on</strong>g>of</str<strong>on</strong>g> your land as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>presence <str<strong>on</strong>g>of</str<strong>on</strong>g> our pipes or, if you will haveany temporary losses or disturbancecaused by <str<strong>on</strong>g>the</str<strong>on</strong>g> works, you may be entitledto claim compensati<strong>on</strong> from us (seeparagraph 55 <strong>on</strong>wards).Agents20. In some circumstances you may feel it isappropriate to appoint an agent, e.g. asurveyor experienced in this type <str<strong>on</strong>g>of</str<strong>on</strong>g> work,to act <strong>on</strong> your behalf in advising you <strong>on</strong><str<strong>on</strong>g>the</str<strong>on</strong>g> works, protecting your interests andassessing and agreeing your claim <str<strong>on</strong>g>for</str<strong>on</strong>g>compensati<strong>on</strong>. Where our work involvespipelaying we would accept your grounds<str<strong>on</strong>g>for</str<strong>on</strong>g> appointing an agent. If you do so,we will pay <str<strong>on</strong>g>the</str<strong>on</strong>g> reas<strong>on</strong>able cost <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>agent’s fee after <str<strong>on</strong>g>the</str<strong>on</strong>g> claim has beensettled. The maximum amount payablewill be based <strong>on</strong> a standard scale <str<strong>on</strong>g>of</str<strong>on</strong>g>pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al fees, known as Ryde’s Scale.If you require fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r in<str<strong>on</strong>g>for</str<strong>on</strong>g>mati<strong>on</strong> aboutthis you should c<strong>on</strong>sult with your agent.We would not usually pay legal feesunless we ask you <str<strong>on</strong>g>for</str<strong>on</strong>g> a <str<strong>on</strong>g>for</str<strong>on</strong>g>mal easementdocument that requires additi<strong>on</strong>al work.Record <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> land21. We will make a full schedule <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> working area, includingany buildings in close proximity, anyaccesses and any compound in respect <str<strong>on</strong>g>of</str<strong>on</strong>g><str<strong>on</strong>g>the</str<strong>on</strong>g> proposed scheme. This may c<strong>on</strong>sist<str<strong>on</strong>g>of</str<strong>on</strong>g> written notes, photographs or a videorecording with verbal commentary. Acopy will be sent to your agent prior to<str<strong>on</strong>g>the</str<strong>on</strong>g> scheme commencing or to you ifdo not appoint an agent. Please in<str<strong>on</strong>g>for</str<strong>on</strong>g>mus if you believe that we have omittedany relevant details. The purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>record is to help all parties check thatwe have restored <str<strong>on</strong>g>the</str<strong>on</strong>g> land to its originalc<strong>on</strong>diti<strong>on</strong> as near as possible unless youhave asked us to c<strong>on</strong>sider alternativeproposals and, that any buildings alsoremain in <str<strong>on</strong>g>the</str<strong>on</strong>g> original c<strong>on</strong>diti<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ywere at <str<strong>on</strong>g>the</str<strong>on</strong>g> start <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> works.C<strong>on</strong>tacts22. Be<str<strong>on</strong>g>for</str<strong>on</strong>g>e <str<strong>on</strong>g>the</str<strong>on</strong>g> works commence we willgive you <str<strong>on</strong>g>the</str<strong>on</strong>g> name, business addressand teleph<strong>on</strong>e number <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>resp<strong>on</strong>sible <str<strong>on</strong>g>for</str<strong>on</strong>g> supervising <str<strong>on</strong>g>the</str<strong>on</strong>g> works.We will also give you an emergencyteleph<strong>on</strong>e number <str<strong>on</strong>g>for</str<strong>on</strong>g> use outside normalworking hours.Locati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> pipes and equipment23. Normally all our pipes are laid belowground.
