DELHI TRANSCO LIMITEDANNEXURE-‘A’GENERAL TERMS AND CONDITIONS:The contractor shall strictly follow the terms and conditions given hereunder for the work:-1. Scope of work:- Contractor will satisfy himself with the details of the work to be executed and ifconsidered necessary they should visit the site and get any other information required in this connection.2. T&P:- The contractor shall use his labour and tools and plants required for the execution of work unlessspecified.3. Safety:- The contractor shall make all the arrangements for the safety of his staff. DTL shall not beresponsible in any way for injury/disablement, accident to any worker/man on this account and will not beresponsible to pay any damage to the workmen or the contractor or any outside agencies.a) The contractor shall make all payments and other contributions, any/all, which made have to be made inregard to the workmen under any statute of rules or regulations. DTL shall not be responsible for these payaments.b) DTL shall not be responsible for any injury/loss suffered by the contractor/his workmen. The contractorshall arrange to cover all such workmen under the ‘Employees State Insurance Scheme’ if applicable to thearea and premises where the worker are working. Alternatively, the contractor shall have insurance policyto pay compensation under the workmen’s compensation act, legal requirements in this respect. Thecontractor shall produce for inspection such coverage/policies to the DTL before such workman deputedfor the work as specified in this work order, if necessary/asked for.c) The contractor will undertake to indemnity DTL against liabilities or damages by way of compensationarising from any accidents to the person or property of any other person employed or otherwise during theprogress of the contract and DTL shall not entertain any claim in this respect.d) The contractor shall be solely responsible and shall ensure due compliance with all the legalrequirement concerning the workman employed by him under the provisions of applicable labour and otherlegislations. In the event of the contractor committing any fault resulting in DTL being required to anynotice/summons in this respect the same shall be entitled to recover from the contractor the liabilityattached to it due to any proceedings.4. The contractor shall accept all risks of stoppage or hindrances to his work by outside interference.5. Contractor shall take necessary steps to ensure that all the electrical installations of DTL and otherservices like Water connections, pipelines, sewer pipe lines, open drains, telephone cables, etc. are notdamaged by his workers in any way. The contractor will be responsible for all such damages and shallhave to repair failing which he has to pay entire cost of damages. In case of damages to DTL’sproperty/material contractor has to pay replacement cost.6. Before carrying out the work, it shall be entire responsibility of the contractor to take all the safetyprecautions and shutdowns etc., if required during the execution of the work. All shutdowns will be takenby DTL supervisory staff, but contractor’s representative will give request in writing.7. The work has to be carried out according to the specifications given, where not, according to thesatisfaction of DTL representatives.8. The quantity of work can very up to ± 25% depending upon the requirement at the discretion of DTL.9. In the event of any obstruction at site, change in scheme, or due to any reasons the contract can becancelled for the balance quantity of the executed work. The work can also be suspended temporarily dueto any reasons and for such period extension of time will be given by DTL, if required, on the writtenrequest of the contractor.10.Payment:- I. The payment shall be made within one month of receipt of bills from the contractor afterthe completion of work as mentioned in the notice inviting tender/as per practice in vogue in DTL. Thepayment shall be sanctioned after verification is made as per rules of DTL. However, any specific clause ofpayment quoted by the contractor for doing work, the penalty of DTL or less to the contractor will not beentertained .
