SUBSIDIARY QUESTIONS(i)Does this policy provide a clear <strong>and</strong> robust framework for meetingthe identified needs for gypsy <strong>and</strong> traveller sites arising fromregional <strong>and</strong> local assessments?Representations received to the Submission Development Policies DPDUnsound170 6485 4B DP14A MundayGovernment Office for Yorkshire <strong>and</strong> the HumberCircular 01/2006 requires Local Development Frameworks to set out criteria for locationof <strong>Gypsy</strong> <strong>and</strong> <strong>Traveller</strong> sites which will be used to guide the allocation of sites in therelevant DPD. These criteria will also be used to meet unexpected dem<strong>and</strong>.The policy wording should provide clearer direction for the allocation of sites to meetany future unmet needs, which may be identified through regional consideration of pitchnumbers. The policy should also provide for the grant of temporary permissions inadvance of a Site Allocations DPD, where there is an unmet need but no availablesites. If it is not possible to complete the assessment required by the Circular within thetime frame of the Local Development Framework, the policy needs to be more specificabout when it is expected to be completed <strong>and</strong> how, when <strong>and</strong> where any need will beaddressed for allocations in the event of a future need.1399 6019 7 DP14Mr. <strong>and</strong> Mrs. HallWard HadawayBroad support expressed for the policy. Object, however, that <strong>Gypsy</strong> <strong>and</strong> <strong>Traveller</strong>sites should be specifically identified within the Local Development Framework. Thisshould be flagged within the Development Policies DPD. The site shown on theattached plan should be one of these sites. A copy of the grant of planning permissionis attached herewith. The reasons for granting consent include that the site is in asustainable location. The permission is, however, subject of a personal consent,condition 2 pertains. In our view there is no need for the consent to be subject of apersonal condition. Object that the policy should set out when personal conditions willbe used.The <strong>Council</strong>’s Response3.1 In answer to the Government Office, the <strong>Council</strong> feels that, in general terms,Policy DP14 as presently formulated is consistent with ODPM Circular 1/2006‘Planning for <strong>Gypsy</strong> <strong>and</strong> Caravan <strong>Sites</strong>’ [NCD 41] until such time as moreinformation is available at both the regional <strong>and</strong> local authority level aboutgypsy <strong>and</strong> traveller accommodation needs <strong>and</strong> provision. As currently worded,Policy DP14 states that planning permission will be granted for new gypsy <strong>and</strong>traveller accommodation, which meets an established need <strong>and</strong> subject to anumber of criteria including access to services <strong>and</strong> facilities, an acceptableliving environment, appropriate size, good road access, <strong>and</strong> impact on existingcommunities. Criteria (i) to (vi) also give appropriate guidance for makingallocations. All these criteria are based on the guidance within Circular 1/2006[NCD 41] itself. <strong>Gypsy</strong> <strong>and</strong> traveller sites may also be supported as anexception under Core Policy CP4.<strong>Hambleton</strong> Local Development Framework Development PoliciesExamination Statement 8: <strong>Gypsy</strong> <strong>and</strong> <strong>Traveller</strong> <strong>Sites</strong><strong>May</strong> <strong>2007</strong>7
