espondent to a divorce petition or an application <strong>for</strong> an order <strong>for</strong> judicial separationshould <strong>the</strong>re<strong>for</strong>e obtain legal advice in respect <strong>of</strong> <strong>the</strong>ir position under <strong>the</strong> ClergyDiscipline Measure be<strong>for</strong>e any steps are taken in <strong>the</strong> matrimonial proceedin<strong>gs</strong>.11.8 Clergy would <strong>the</strong>re<strong>for</strong>e be well advised to contact <strong>the</strong>ir Bishop or Archdeaconas soon as it appears to be unavoidable that ei<strong>the</strong>r <strong>the</strong>y or <strong>the</strong>ir spouse areconsidering commencing proceedin<strong>gs</strong> which would result in divorce or judicialseparation from <strong>the</strong>ir spouse.11.9 The highest standards are expected <strong>of</strong> <strong>the</strong> <strong>clergy</strong> in respect <strong>of</strong> <strong>the</strong>ir personalrelationships, not least in respect <strong>of</strong> <strong>the</strong>ir relationships with those in <strong>the</strong>ir pastoralcare. In particular, <strong>the</strong> <strong>clergy</strong> must never have sexual or inappropriate relationshipswith those aged 16 or 17, or vulnerable adults. A breach <strong>of</strong> this requirement, inaddition to being treated as a disciplinary matter, will be referred to <strong>the</strong> localauthority designated <strong>of</strong>ficer. In some cases it may constitute a criminal <strong>of</strong>fence.Anyone found guilty <strong>of</strong> a criminal or disciplinary <strong>of</strong>fence <strong>of</strong> this kind is likely to beremoved from <strong>of</strong>fice and referred to <strong>the</strong> Disclosure and Barring Service which haspower to bar <strong>the</strong>m from work with children and/or vulnerable adults.11.10 Discretion should be used in all <strong>for</strong>ms <strong>of</strong> communication including whensending messages by email or text, or when visiting social networking sites or blo<strong>gs</strong>,or holding conversations using cameras or microphones via <strong>the</strong> internet, much <strong>of</strong>which relies upon insecure <strong>for</strong>ms <strong>of</strong> data transmission.It is advisable <strong>for</strong> <strong>clergy</strong> to maintain a personal email address <strong>for</strong> <strong>the</strong>ir ministrywhich is not shared with o<strong>the</strong>rs in <strong>the</strong> household, and email correspondencereceived should be accessible only to <strong>the</strong> person to whom it is sent.Confidentiality in all <strong>for</strong>ms <strong>of</strong> correspondence must be respected and maintainedwhe<strong>the</strong>r written or electronic.11.11 The <strong>clergy</strong> must remember that <strong>the</strong>y are public figures whose opinions whenpr<strong>of</strong>fered have weight and significance. In using social media ministers shouldalways assume that anything <strong>the</strong>y post or contribute is in <strong>the</strong> public domain and willbe shared. The power <strong>of</strong> <strong>the</strong> internet <strong>for</strong> doing harm as well as good must always beborne carefully in mind and weighed be<strong>for</strong>e saying anything which may prove bedamaging to oneself as well as to o<strong>the</strong>rs.11.12 Close attention must be given to secure all <strong>for</strong>ms <strong>of</strong> data, including traditionalpaper records.
