SB 483Continued from page 14extraordinary medical expenses so as to delete andexclude “a child of <strong>the</strong> parent’s current family.” In o<strong>the</strong>rwords, in <strong>the</strong> original guidelines, if a parent had a sickchild in a “new” family, <strong>the</strong> child support award <strong>for</strong> <strong>the</strong>child <strong>for</strong> whom <strong>the</strong> worksheet was being calculated andsubject to this litigation, could be reduced. This is nolonger <strong>the</strong> case.EightA new provision specifically allows <strong>for</strong> a “temporarymodification of child support” while a modificationaction is pending.NineSB 483 clarifies that deviations may increase ordecrease <strong>the</strong> presumptive amount of child support.This seems logical but <strong>the</strong> original guidelines onlyexpressly provided that <strong>the</strong> deviations could increasesupport.TenThe court, ra<strong>the</strong>r than <strong>the</strong> jury, will determine adjustedincome, health insurance costs, and work relatedchild care costs.ElevenJust in case you thought <strong>the</strong> definition of “grossincome” in <strong>the</strong> original guidelines was too narrow(and you may recall that it listed 21 possible sourcesof income), <strong>the</strong>re is a new catch-all <strong>for</strong> “o<strong>the</strong>rincome.”In sum, SB 483 makes both technical and substantivechanges but none that will come close to rocking ourlegal world as did <strong>the</strong> “new” guidelines of Jan. 1, 2007.SB 483 does not contain an effective date (at least noneis provided in <strong>the</strong> most recent online resources) so perhapswe can assume <strong>the</strong>se changes are effective immediately.As a final note, you may find <strong>the</strong> most current versionof <strong>the</strong> child support worksheet by going towww.georgiacourts.org/csc and going to <strong>the</strong> green icon<strong>for</strong> “Downloadable Electronic Worksheet.” Should youhave questions or suggestions you may go to this samelink and follow prompts to reach <strong>the</strong> Georgia ChildSupport Commission through Jill Radwin.
