the <strong>City</strong>, rights specified in this MOU and rights granted by the laws <strong>of</strong> the State <strong>of</strong> California orthe Constitutions <strong>of</strong> the State <strong>of</strong> California or the United States.ARTICLE 8WORK WEEK/WORK DAY1. At the discretion <strong>of</strong> the Chief <strong>of</strong> Police, any <strong>of</strong> the represented classifications may beallowed to work the alternate work schedules listed below:(a)(b)(c)Traditional: Five (5) eight (8) hour shifts during a seven day period, includingtwo (2) fifteen-minute paid rest periods and one half-hour paid meal break;Nine/Eighty: Eight (8) nine (9) hour days and one (1) eight (8) hour day during afourteen (14) day period with the work week ending at noon on the eight hourday, including two (2) fifteen-minute paid rest periods and one half-hour paidmeal break;Four/Ten: Four (4) ten (10) hour shifts during a seven day period, including two(2) fifteen-minute paid rest periods and one half-hour paid meal break;(d) Three/Twelve: Eighty (80) hours during each two week pay period with six (6)twelve and one-quarter (12.25) hour days and one (1) six and one-half (6.5) hourday during the pay period and including two (2) fifteen-minute paid rest periodsand one half-hour paid meal break; or(e)Twenty Eight Day (Sworn only): For sworn employees only, one hundred andsixty (160) hours in a 28 day work schedule with twelve (12), twelve and one-halfhour (12.5) hour days and one (1) ten (10) hour day during the pay period(commonly referred to as a “3/12” work schedule), including two (2) fifteenminutepaid rest periods and one half-hour paid meal break.2. All sworn employees shall receive a paid “roll call” period.3. The work schedules described above are in no way intended to set forth the "workperiod" as defined under the Fair Labor Standards Act.4. Once assigned to a work schedule, employees may be reassigned to the original oralternate work schedule with 60 days notice, except in the case <strong>of</strong> an emergency. In thecase <strong>of</strong> an emergency, the Chief shall provide as much notice as is reasonably possible <strong>of</strong>the work schedule change.5. For purposes <strong>of</strong> this MOU, employees receiving paid rest and meal breaks shall have theright to uninterrupted rest and meal breaks except in the following circumstances.(a)Employees engaged in meal or rest breaks shall take appropriate action whenmade aware <strong>of</strong> any actual crime in progress or incident which, unless appropriateaction is taken, would jeopardize the health or safety <strong>of</strong> any member <strong>of</strong> the public.c:\webs\egov\vperl\egov\temp\documents\$asq13170542283683.doc 6
