In<str<strong>on</strong>g>the</str<strong>on</strong>g> case Danbar Enterprises PR-2004-036, 14 <str<strong>on</strong>g>the</str<strong>on</strong>g> Tribunal <str<strong>on</strong>g>in</str<strong>on</strong>g>dicated that,although not <str<strong>on</strong>g>the</str<strong>on</strong>g> preferred means of creat<str<strong>on</strong>g>in</str<strong>on</strong>g>g specificati<strong>on</strong>s, if designspecificati<strong>on</strong>s are used <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>y are not biased <str<strong>on</strong>g>in</str<strong>on</strong>g> favour of a particularbr<str<strong>on</strong>g>and</str<strong>on</strong>g> of product <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>re is sufficient competiti<strong>on</strong>, a violati<strong>on</strong> of <str<strong>on</strong>g>the</str<strong>on</strong>g>trade agreements has not occurred.What happens when specificati<strong>on</strong>s are changed after bid clos<str<strong>on</strong>g>in</str<strong>on</strong>g>g,perhaps even after <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tract is awarded? Is this a matter of c<strong>on</strong>tractadm<str<strong>on</strong>g>in</str<strong>on</strong>g>istrati<strong>on</strong> or someth<str<strong>on</strong>g>in</str<strong>on</strong>g>g more? A Tribunal case called Cany<strong>on</strong>C<strong>on</strong>tract<str<strong>on</strong>g>in</str<strong>on</strong>g>g (PR-2006-016) 15 is a significant example of this situati<strong>on</strong>.That procurement was for <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>stallati<strong>on</strong> of signs <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>on</strong>e of <str<strong>on</strong>g>Canada</str<strong>on</strong>g>’snati<strong>on</strong>al parks. After <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tract was awarded, discussi<strong>on</strong>s with <str<strong>on</strong>g>the</str<strong>on</strong>g>c<strong>on</strong>tractor led to substantive changes to <str<strong>on</strong>g>the</str<strong>on</strong>g> orig<str<strong>on</strong>g>in</str<strong>on</strong>g>al specificati<strong>on</strong>. Abidder <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> orig<str<strong>on</strong>g>in</str<strong>on</strong>g>al competiti<strong>on</strong> filed a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tribunaldecided that <str<strong>on</strong>g>the</str<strong>on</strong>g> changes effectively created a new procurement that wasnot competed <str<strong>on</strong>g>in</str<strong>on</strong>g> c<strong>on</strong>formity with <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable trade agreements.
