<strong>Makana</strong> <strong>Municipality</strong>Fraud Prevention <strong>and</strong> Anti-Corruption Policy1. DEFINITIONS“CFO” means the Chief Financial Officer of the <strong>Makana</strong> <strong>Municipality</strong>;“Constitution” means the Constitution of the Republic of South Africa, 1996 (Act. No 108 of 96).“Corruption” means any conduct or behaviour where a person accepts or agrees or offers anygratification for him/her or for another person where the purpose is to act dishonestly <strong>and</strong> illegally.Such behaviour also includes the misuse of material or information, abusing a position of authority ora breach of trust or violation of duty;“Corrupt Activities Act” means the Prevention <strong>and</strong> Combating of Corrupt Activities Act 2004 (ActNo. 12 of 2004).“Council” means the Council of the <strong>Makana</strong> <strong>Municipality</strong>.“Councillor” means a member of Council of the <strong>Makana</strong> <strong>Municipality</strong>;“Disclosure” in terms of the Protected Disclosure Act, 2000 (Act No. 26 of 2000) means – anydisclosure of information regarding any conduct of an employer or an employee of that employer,made by any employee who has reason to believe that the information concerned shows or tends toshow one or more of the following:(a) That a criminal offence has been committed, is being committed or is likely to be committed;(b) That a person has failed, is failing or is likely to fail to comply with any legal obligation to whichthat person is subject;(c) That a miscarriage of justice has occurred, is occurring or is likely to occur;(d) That the health or safety of an individual has been, is being or likely to be endangered;(e) That the environment has been, is being or is likely to be damaged;(f) Unfair discrimination as contemplated in the Promotion of Equality <strong>and</strong> Prevention of UnfairDiscrimination Act, (No. 4 of 2000) or(g) That any matter referred to in paragraphs (a) to (f) has been, is being or is likely to bedeliberately concealed;“Disciplinary Procedure” means the Disciplinary Procedure of the <strong>Municipality</strong> in terms of thecollective agreement of the South African Local Government Bargaining Council <strong>and</strong>/or theDisciplinary Code <strong>and</strong> Procedures for Senior Managers;“Employee” means any employee of the <strong>Municipality</strong>, contractual or permanent;“Fraud” means the unlawful <strong>and</strong> intentional making of a misrepresentation which causes actual orpotential prejudice to another. The use of the term is in its widest possible meaning <strong>and</strong> is intendedto include all aspects of economic crime <strong>and</strong> acts of dishonesty;“MFMA” means the Local Government: Municipal Finance Management Act, 2003 (Act No. 56 of2003);“<strong>Municipality</strong>” means the <strong>Makana</strong> <strong>Municipality</strong>;“Municipal Manager” means the Municipal Manager of the <strong>Makana</strong> <strong>Municipality</strong>;“NPA” means the National Prosecuting Authority of the Republic of South Africa;“Occupational detriment” in relation to the wonrking environment of an employee in terms of theProtected Disclosure Act (Act No. 26 of 2000) means –(a) being subjected to any disciplinary action;Page 2
