Castrowith Commissioner Roberta Achtenberg concurring“Property is intended to serve life, and no matter how much we surround it with rights and respect,it has no personal being. It is not man.”--Martin Luther King, Jr.I was pleased to vote in favor of the Commission conducting this briefing on the potential civil rightsimplications of the use of the eminent domain power, for several reasons: (1) there was bipartisaninterest in the topic both inside and outside of the Commission, and we can always use morebipartisanship—especially at the Commission; (2) if indeed there was a widespread, current pattern ofabuse of the eminent domain power based on race and ethnicity, then this Commission should belooking into the issue; and (3) it allowed us to examine an issue at the national level that was initiallyraised by one of our State Advisory Committees as I am a firm believer in the concept that our work atthe Commission, at least in part, should be informed by the work taking place within our State AdvisoryCommittees.However, after reviewing the materials prepared for our briefing, reading the written submissions of ourwitnesses, and hearing their testimony at our briefing, I am not convinced that there is currently awidespread or systemic abuse of the eminent domain power that is having a disparate impact oncommunities of color, or is being directed at racial and ethnic minority communities in a discriminatoryfashion. What I am certain of is that there are isolated abuses, which the witnesses and the materialshighlighted for us, and those should be of concern and the circumstances that lead to them should becorrected. However, the greatest abuses presented to the Commission as part of our briefing were, forthe most part, abuses, which took place decades ago.In recent years there has been a massive loss of property among people of color, especially amongLatinos and African-Americans. That loss is of minorities’ homes as a result of the mortgage foreclosurecrisis. This issue, more than the current use of eminent domain, has deprived the most vulnerable in oursociety of their property, and for many, their sole asset—their homes. It is this issue, and not eminentdomain use (or alleged abuse), that has plunged African-Americans and Latinos into greater depths ofpoverty and decimated what little wealth they had managed to build, especially compared to their Whiteneighbors. 1 This Commission should seriously examine the disparate impact of this issue on minoritycommunities.1 The Lost Decade of the Middle Class: Fewer, Poorer, Gloomier, Pew Research Social & Demographic Trends,http://www.pewsocialtrends.org/2012/08/22/the-lost-decade-of-the-middle-class/, in part, “For the middle-income group, the “lost decade”of the 2000s has been even worse for wealth loss than for income loss. The median income of the middle-income tier fell 5%, but medianwealth (assets minus debt) declined by 28%, to $93,150 from $129,582. During this period, the median wealth of the upper-income tier wasessentially unchanged—it rose by 1%, to $574,788 from $569,905.
