within fifteen (15) days from <strong>the</strong>ir constitution, initiate <strong>the</strong> process of selectionwhich shall include <strong>the</strong> setting of criteria <strong>for</strong> selection <strong>and</strong> <strong>the</strong> process <strong>for</strong>accepting nominations from accredited labor groups, in <strong>the</strong> case of <strong>the</strong> laborsec<strong>to</strong>r representative, <strong>and</strong> by recognized trade associations, chambers,cooperatives, <strong>and</strong>/or business organizations, in <strong>the</strong> case of <strong>the</strong> MSMErepresentatives. The nominations committee may also utilize existingguidelines on selection of Council members which shall include genderrepresentation. They may also include as part of <strong>the</strong>ir selection process <strong>the</strong>identification of MSME nominees by category, i.e., micro, small <strong>and</strong> mediumbut shall ensure that each of <strong>the</strong> major isl<strong>and</strong> groupings, i.e., Luzon, Visayas<strong>and</strong> Mindanao, shall have one representative each.The nominations committee, within <strong>for</strong>ty five (45) days from its constitutionshall submit a shortlist of nominees <strong>to</strong> <strong>the</strong> Chair of <strong>the</strong> MSMEDC who shall<strong>the</strong>n endorse <strong>the</strong> shortlist <strong>to</strong> <strong>the</strong> President <strong>for</strong> appointment. The BMSMEDshall assist <strong>the</strong> nominations committee in <strong>the</strong> selection process <strong>and</strong> shallensure that <strong>the</strong> nominees involvement in local or regional activities concerningMSMEs shall be presented, with regard <strong>to</strong> <strong>the</strong> MSME representatives. TheBMSMED shall also ensure that it shall receive from <strong>the</strong> appropriategovernment agency <strong>the</strong> current list of accredited labor groups.Sec. 5. Term of Office. All members of <strong>the</strong> Council so appointed, except <strong>for</strong><strong>the</strong> ex- officio members, shall serve <strong>for</strong> a term of three (3) years. The personso appointed <strong>to</strong> replace a member who has resigned, died, or been removed<strong>for</strong> cause shall serve only <strong>for</strong> <strong>the</strong> unexpired portion of <strong>the</strong> term.In <strong>the</strong> case of <strong>the</strong> private banking sec<strong>to</strong>r, <strong>the</strong> three (3) year term shall beserved alternately by <strong>the</strong> identified associations at one (1) year each. Thesequence of service shall be based on <strong>the</strong> agreement reached by <strong>the</strong> bankassociations. The bank associations shall in<strong>for</strong>m <strong>the</strong> MSMEDC in writing of<strong>the</strong>ir representatives <strong>and</strong> <strong>the</strong> particular part of <strong>the</strong> term that he/she shallserve.Sec. 6. Authorized Per Diems <strong>and</strong> o<strong>the</strong>r expenses. The private sec<strong>to</strong>r membersof <strong>the</strong> Council shall receive per diem of Two thous<strong>and</strong> pesos (P2,000) permeeting, <strong>for</strong> a maximum of twenty-four (24) meetings per year. Said per diemmay be adjusted by <strong>the</strong> MSMED Council as appropriate. Accommodation,travel <strong>and</strong> transportation expenses <strong>and</strong> meals during meetings shall not beincluded in <strong>the</strong> a<strong>for</strong>e-mentioned per diem <strong>and</strong> shall be shouldered by <strong>the</strong>MSMEDC. The per diems <strong>and</strong> o<strong>the</strong>r expenses shall be taken from <strong>the</strong>MSMEDC’s appropriations under <strong>the</strong> General Appropriations Act.Sec. 7. Resource Persons during deliberations. The Council may call upon<strong>the</strong> participation of any national or local government agency, association oflocal government officials or private sec<strong>to</strong>r organization in its deliberations29
