Surveyors Registraon Board of VictoriaMonthly NewsleerIssue No. 7 July 2013Awards for ExcellenceEvery year, the Surveyors Registraon Board of Victoria awards a prize to thelicensed surveyor who obtained the highest overall score in surveys and projectexaminaons on the path towards becoming registered as a Licensed Surveyor inVictoria.The duraon of the candidate’s Professional Training Agreement is also a criterionthat is considered. The prize consists of two ckets to the annual Instuon ofSurveyors Victoria (ISV) Gala Dinner, a Cerficate of Achievement and an awardrecognising the candidate’s accomplishment.The award for 2012/2013 was made to Mr Kyle Bracher LS.The Board also sponsors two university awards to acknowledge exceponalachievement in cadastral surveying studies and encourage students to considerregistraon as a licensed surveyor. Projects, Examinaons and AssessmentsThe Board congratulates the following candidateson passing their projects and thankstheir respecve supervising surveyors fortheir support and encouragement .Urban <strong>Cadastral</strong> ProjectCandidateSupervising Surveyor (Employer)Christopher Powell Geoffrey Turner LS (Bosco Johnson)Rural <strong>Cadastral</strong> ProjectCandidateMahew KingDamian SmaleSupervising Surveyor (Employer)Glen Villella LS (Breese Pi Dixon)Geoff Humphrey LS (Breese Pi Dixon)Formal Disciplinary HearingOn 4 October 2012, the Board received a complaint about the professional conduct ofMr Peter Farren LS.A formal hearing was held on 14 May 2013 into Mr Farren’s professional conduct to determinewhether he had engaged in unprofessional conduct within the meaning of paragraphs(a), (b), (c) and/or (d) as defined in secon 3 of the Surveying Act 2004 in connec-on with:• a cadastral survey made on 10 March 2005 and cerfied on 4 May 2005, and in par-cular in respect of compliance with Regulaons 10(1)(d) and 13(1) of the Surveyors(<strong>Cadastral</strong> Surveys) Regulaons 1995; and• a cadastral survey made on 24 May 2010 and cerfied on 16 August 2010, and inparcular in respect of compliance with Regulaons 11(1)(e) and 14(1) of the Surveying(<strong>Cadastral</strong> Surveys) Regulaons 2005.The Panel found that the Licensed Surveyor, whether by act or omission, engaged in unprofessionalconduct, which was not of a serious nature, pursuant to secon 27(1)(b) ofthe Surveying Act 2004.While the Panel found that there was no deliberate wrongdoing by Mr Farren or his staffin respect of either the first or the second survey, what has occurred here is an inadvertentfailure by Mr Farren to adequately supervise his staff and to fail to ensure that thenecessary checks were undertaken to correctly idenfy the boundary features of thesurvey site when cerfying the first survey under the 1995 Regulaons and the secondsurvey under the 2005 Regulaons.2(… connued on page 3)


Formal Disciplinary Hearing (...connued from page 2)In respect of each of the two surveys, the Panel found that Mr Farren’s conduct was“conduct by a licensed surveyor in the course of engaging in business as a licensedsurveyor that would be regarded by a licensed surveyor in good standing as beingunacceptable.”In respect of the second survey, the Panel further found that Mr Farren’s conductwas “conduct by a licensed surveyor in the course of engaging in business as a licensedsurveyor that falls short of the standard of competence and diligence that amember of the public is reasonably entled to expect of a licensed surveyor.”The determinaon of the Panel was that the Licensed Surveyor be cauoned pursuantto secon 27(2)(a) of the Surveying Act 2004.
