determine the precedential value of case law, statutes, and<br />
constitutional provisions.<br />
Our law has many sources of authorities, including written<br />
judicial opinions (or cases), statutes, regulations, and others.<br />
Judicial opinions form the basis of our common law (meaning<br />
“case law”) legal system. <strong>The</strong> concept of “stare decisis”<br />
supports our common law system. It means “to abide by or to<br />
adhere to decided cases.” According to stare decisis, judges<br />
should adhere to precedent, or principles of law from earlier<br />
cases, and so, those cases and their decisions become rules<br />
of guidance in future, similar cases.<br />
But a court doesn’t need to abide by decided cases. It can<br />
criticize or even overrule a decided case, thus damaging or<br />
even destroying its “precedential value.” A court may also rule<br />
a statute or regulation as void or invalid, meaning that it<br />
violates another existing legal authority. Negative decisions<br />
Parallel citations<br />
• Shepard’s will show parallel citations in parentheses the<br />
first time that it cites the case, and it will not cite it in<br />
subsequent volumes.<br />
• If a Shepard’s edition goes to press without a parallel<br />

• If a parallel cite does not appear in any of the volumes, then<br />
no parallel source exists.<br />
