Operational Limits of the Service<br />

Provisioning of the Service is subject to the availability and the operational limitations of the requisite equipment<br />

and associated facilities. There is no guarantee of bandwidth. Your connection speed may not be suitable for some<br />

applications, and particularly those involving real-time or near real time, high-bandwidth uses such as video<br />

streaming or video conferencing. You understand and agree that temporary interruptions of the Service may occur<br />

as normal events in the provision of the Service and that DIGICEL HAITI will not be liable for such interruptions. You<br />

further understand and agree that DIGICEL HAITI has no control over third party networks you may access in the<br />

course of your use of the Service, and therefore, delays and disruptions of other network transmissions are beyond<br />

the control of DIGICEL HAITI. DIGICEL HAITI will not be liable for any failure of performance, if such failure is due to any<br />

cause beyond DIGICEL HAITI’s reasonable control, including acts of God, fire, explosion, vandalism, nuclear disaster,<br />

terrorism, cable cut, storm or other similar occurrence, any law, order or regulation by any government, civil unrest,<br />

or military authority, national emergencies, insurrections, riots, wars, labor difficulties, supplier failures, shortages,<br />

breaches, or delays, or delays caused by you or your equipment.<br />

Security Warning<br />

The unsecured nature and ease of connection to public Wi-Fi hotspots increases the risk that unauthorized persons<br />

can access your phone, laptop or other device or your communications over the Wi-Fi network. Wi-Fi customers should<br />

take precautions to lower the security risks. If you have VPN, DIGICEL HAITI recommends that you connect through<br />

it for optimum security. DIGICEL HAITI also encourages its users to observe standard security practices. You should<br />

ensure that computer hard drives are not shared; that laptops have firewall protection; and that security software is<br />

installed, functional and updated on your device. DIGICEL HAITI recommends that you avoid transmitting or accessing<br />

sensitive personal information over the Wi-Fi network, and that you only connect to known Wi-Fi hotspots.Digicel<br />

Haiti will not accept liability, if your information was exposed or your equipment is hacked by unauthorized persons.<br />

Limitation of Liability<br />

DIGICEL HAITI, ITS EMPLOYEES, AGENTS, VENDORS, <strong>AND</strong> LICENSORS ARE NOT LIABLE FOR ANY COSTS OR DAMAGES<br />

ARISING, EITHER DIRECTLY OR INDIRECTLY, FROM YOUR <strong>USE</strong> <strong>OF</strong> THE <strong>WI</strong>-<strong>FI</strong> SYSTEM OR THE INTERNET, SPECI<strong>FI</strong>CALLY<br />

INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE OR CONSEQUENTIAL<br />

DAMAGES.<br />

Governing Law<br />

These Terms and Conditions are governed by the laws of the Republic of Haiti.
