Litigation: Kasowitz’s litigators represent clients in high-stakes and often precedent-setting<br />

Recent representations: MBIA Inc. in actions brought by the world’s largest financial institutions<br />
in which they seek to set aside MBIA’s transformation of its structured finance insurance<br />
business; Fairfax Financial, a Canadian insurance giant, in a lawsuit which seeks $6<br />
billion in damages against hedge funds which allegedly manipulated Fairfax’s stock through<br />
the use of manufactured analyst reports and other deceptive practices; Hilton Worldwide<br />
in a civil action brought by Starwood Hotels and in a related federal grand jury investigation,<br />
arising from alleged misappropriation of trade secret materials; Comcast in the defense of<br />
three class actions alleging antitrust violations as a result of “clustering” in cable markets;<br />
Metropolitan Life Insurance Company and Lloyds TSB Bank plc in their actions against<br />
Credit Suisse relating to their losses on financial instruments issued by National Century<br />
Financial Enterprises, Inc.; and Bayerische Hypo-Und Vereinsbank AG (“HVB”), the<br />
second-largest private German financial institution, in defense of individual and class<br />
actions alleging fraud and RICO claims stemming from certain tax shelter transactions.<br />
Creditors’ Rights & Bankruptcy: Kasowitz’s Creditors’ Rights and Bankruptcy Group<br />
represents major parties in the largest bankruptcies and restructurings throughout the country.<br />
The firm is a leader in representing investors in securities of distressed companies and<br />
in representing debtor companies as well. The firm represents businesses in developing legal<br />
strategies for their financial rehabilitation, working closely with the client to achieve an<br />

Insurance Recovery: Kasowitz’s Insurance Recovery Group is one of the largest in the<br />
nation focused exclusively on policyholder coverage. The firm’s attorneys pride themselves<br />
on understanding the business needs of their clients and working closely with them to<br />
address all of their legal insurance coverage needs, including high-stakes litigation, alternative<br />
