mention the ultimate identification of Matt Muller as the possessor of the phone. Without<br />
the illegal search the authorities never would have called Joyce Zarback. All of this<br />
evidence must be <strong>suppress</strong>ed <strong>to</strong> protect the integrity of the Fourth Amendment of the<br />
United States Constitution.<br />
V - CONCLUSION<br />
Based upon the facts of this case and precedent case law, the prosecution will not<br />
be able <strong>to</strong> prove a reasonable justification for the warrantless search of Mr. Muller’s<br />
cellular phone and the Court should grant the <strong>motion</strong> <strong>to</strong> <strong>suppress</strong>. Therefore, for all of<br />
the aforementioned reasons, Defendant, Matthew Muller, respectfully requests the Court<br />
<strong>to</strong> grant a <strong>motion</strong> <strong>to</strong> <strong>suppress</strong> evidence under Penal Code § 1538.5.<br />
