LACKMOND STONE TERMS AND CONDITIONS
ORDERING
· Orders can be placed with your sales representative, over the phone,
by fax, e-mail (sales@lackmondstone.com) or on line at
LackmondStone.com.
· There is a $25.00 minimum on all orders or an additional $10.00
handling fee will be applied.
PAYMENT TERMS
· All charges for goods and services are payable in U.S. currency.
· We accept the following credit cards: MasterCard, VISA, American
Express and Discover.
· Special order items require a 50% non-refundable deposit in advance.
· Payment for goods and services with any form of insufficient funds will
be prosecuted unless payment in U.S. cash or cashier’s check is received
with (10) business days together with a $25.00 service charge.
· A security interest is retained on all goods delivered until payment is
received in full.
· COD – Payment of the purchase price in full is due prior to or at the
time of delivery of the goods. All checks or other commercial paper shall
constitute payment when payment is received by Seller. If payment in
full is not received by Seller by the time of delivery, Purchaser agrees
to pay interest on the purchase price at the annual rate of 18% (1.5%
monthly), as well as a reasonable attorney’s fees in relation to the
amount of services performed.
· Credit Terms on Account – All accounts must be paid in accordance with
the terms stated on the invoice. Accounts not fully paid within the
stated terms automatically accrue interest from the due date at the
annual rate of 18 (1.5% monthly).
• If a credit account becomes delinquent, credit shipments will
automatically be terminated, and the delinquent customer(s)
shall be placed on a C.O.D. basis.
• If an account is submitted for collection, the customer agrees
to pay all expenses incurred, including but not limited to
reasonable attorney’s fees.
SHIPPING, DAMAGE SHIPMENTS AND DELIVERY
· Lackmond Stone will ship the ‘Best Way’ possible unless a specific
preference is indicated by the customer.
· If Lackmond Stone is unable to fill an entire order, partial shipments will
be made, unless “Ship Complete" is stated on the order.
· Claims for damaged shipments must be filed with the delivery carrier
immediately.
· Please check all boxes of your shipment carefully, and notify us as soon
as possible if any items are missing.
· If a package arrives damaged, notify the carrier immediately and save all
packaging/cartons for the carrier to inspect.
· Any deliver date agreed to by Lackmond Stone shall be deemed an
estimated delivery date. Lackmond Stone shall not be liable for any loss
or damages allegedly caused by failure to make any delivery of a
purchase order when due.
· Lackmond Stone is not responsible for any delay in shipment or delivery
of its products occurring after such products are transferred to the
carrier.
RETURN POLICY
· Before returning any product to us, please contact our customer service
department or your sales representative. This will help us determine a
solution for you as quickly as possible.
· 30 Day Return Policy for most unused items.
· Special order items and/or customized products cannot be returned.
· A 20% restocking fee will be applied to non-defective returns.
· If the product needs to be returned to us, you must obtain a Return
Goods Authorization (RGA) number. The RGA number must be clearly
written on the outside of the box. Lackmond Stone cannot accept any
returns without and RGA number.
· All returns are subject to inspection before a replacement or credit can
be processed.
· In many cases, items must be sent to the manufacturer before Lackmond
Stone can act upon the claim. Most manufacturers reserve the right to
repair the item and return it to the customer.
· Returned items that have been used and exhibit obvious misuse and
abuse will not qualify for credit.
· Credit that can be applied to future purchases will be given on all
approved returns and adjustments. No cash or credit card refunds will
be given.
FREIGHT POLICY
· We pay freight charges in the Continental United States with the
exception to shipments to Hawaii, Alaska and Puerto Rico, on one
shipment to one destination with any single order of $500 or more,
excluding equipment, storage & handling systems, and/or hazardous
materials. This excludes shipments to destinations in Hawaii or Alaska,
or expedited shipment such as overnight or two-day service.
· Shipments of hazardous materials will entail additional freight charges.

SELLER MAKES NO WARRANTIES WITH REGARD TO ITS PRODUCTS,
EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY
WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE,
AS PROVIDED IN THE UNIFORM COMMERCIAL CODE OR ANY
COMPARABLE STATURE OR LAW THAT MAY GOVERN THE SALE OF
GOODS, EXCEPT EXPRESSLY PROVIDED HEREIN. NO TERMS HEREIN
STATED MAY BE CHANGED WITHOUT THE EXPRESS WRITTEN
CONSENT OF AN OFFICER OF LACKMOND PRODUCTS INC. (D/B/A
LACKMOND STONE).
LACKMOND STONE DOES NOT GUARANTEE THE ACCURACY OF THE
INFORMATION PROVIDED IN THIS CATALOG. PRICES, AVAILABILITY
AND FREIGHT POLICY ARE SUBJECT TO CHANGE WITHOUT
NOTICE. LACKMOND STONE RESERVES THE RIGHT TO CORRECT
