Place of the Arbitration <strong>–</strong> the Juridical<br />
Seat/place of hearings and meetings.<br />
• <strong>LMAA</strong> and <strong>SCMA</strong>: Freedom to choose/agree.<br />
• Default Position<br />
<strong>–</strong> <strong>LMAA</strong>: Seat is in England (does not say London),<br />
English Law (Cl.6).<br />
<strong>–</strong> <strong>SCMA</strong>: Juridical seat is Singapore. Singapore law<br />
and the IAA. Award under <strong>SCMA</strong> Rules deemed<br />
made in juridical seat (R22.1 and 22.2). All physical<br />
hearings and meetings in Singapore (R.22.3).<br />
Tribunal and parties have to agree if the arbitration<br />
is to be held in a language other than English<br />
(<strong>SCMA</strong> Rules 2015).<br />
• Importance of juridical seat: Under Singapore IAA,<br />
no appeal on error of law. The English 1996 Act permits<br />
an appeal on such grounds (see below).
