POLITICAL PRESSURES TO RESTRICT THE IDENTIFICATION, CARE AND PROTECTION OF VULNERABLE PEOPLE<br />

Restricting the identificati<strong>on</strong>, care and access to protecti<strong>on</strong> of <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g><br />

For m<strong>on</strong>ths, there has been pressure from the EU Commissi<strong>on</strong>, warning that too many <str<strong>on</strong>g>people</str<strong>on</strong>g> were being identified as<br />

<str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> and were falling outside of the scope of the EU-Turkey deal 4 .<br />

In December 2016, the Joint Acti<strong>on</strong> Plan <strong>on</strong> the implementati<strong>on</strong> of the EU-Turkey Statement 5 recommended that<br />

<str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g> no l<strong>on</strong>ger be exempt from the admissibility procedure 6 , potentially allowing them to be returned to<br />

Turkey.<br />

A first change in this directi<strong>on</strong> took place in early May <str<strong>on</strong>g>2017</str<strong>on</strong>g>, when new procedures established that <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g><br />

individuals would no l<strong>on</strong>ger immediately be sent to the mainland up<strong>on</strong> identificati<strong>on</strong>, but that they would have their<br />

first interview for asylum <strong>on</strong> the island, before being able to move to the mainland for treatment. This was not to apply<br />

to <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> Syrians. Given that certain medical c<strong>on</strong>diti<strong>on</strong>s require tests and treatment that are not available <strong>on</strong> the<br />

Greek island, this shift in policy is of great c<strong>on</strong>cern to us as it clearly limits <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g>’s timely access to much<br />

needed healthcare.<br />

A sec<strong>on</strong>d more recent development have been the pressure of the EU Commissi<strong>on</strong> to put in place a template that<br />

would be used during the vulnerability screening interview to more strictly define who would be identified as<br />

<str<strong>on</strong>g>vulnerable</str<strong>on</strong>g>. It would then be used to determine <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g> that could undergo the admissibility procedure <strong>on</strong> the<br />

island – opening the door to the return of <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g> to Turkey. 7<br />

As a medical organizati<strong>on</strong> providing treatment to <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g> <strong>on</strong> the Greek islands and mainland, we believe that<br />

it is crucial that medical vulnerability categories remain broad, so as to enable a case by case examinati<strong>on</strong> of the<br />

pers<strong>on</strong>’s vulnerability. Indeed, some<strong>on</strong>e’s vulnerability isn’t exclusively defined by the disease that they have, but is also<br />

influenced by the severity of their c<strong>on</strong>diti<strong>on</strong>, by possible co-morbidities as well as by the c<strong>on</strong>diti<strong>on</strong>s in which they are or<br />

will be living in.<br />

<br />

Vulnerable <str<strong>on</strong>g>people</str<strong>on</strong>g> in limbo<br />

As a result of these shortcomings in the identificati<strong>on</strong> and referral of <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g> from the islands, some<br />

extremely <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> and desperate <str<strong>on</strong>g>people</str<strong>on</strong>g> have made their own way to the mainland. In our clinic for the<br />

Rehabilitati<strong>on</strong> of victims of torture in Athens, we provide care to 8 patients who broke their geographical restricti<strong>on</strong> <strong>on</strong><br />

the islands in order to receive the urgent medical treatment they needed in Athens. Yet, they are being told that there is<br />

no way for their asylum situati<strong>on</strong> to be regularized without going back to the islands. For very <str<strong>on</strong>g>vulnerable</str<strong>on</strong>g> <str<strong>on</strong>g>people</str<strong>on</strong>g> such as<br />

victims of torture, it is inc<strong>on</strong>ceivable that in their extremely fragile state they be required to do this.<br />
