Changing Tradition
By: Adrea Nairne-Barrera / 60s to 60
It’s that time again! I love autumn and
all the fun stuff we get to do when it’s not
blazing outside. We sit in the yard after dinner; we
walk dogs without having to put booties on their paws and can finally
remember why we waited out the summer.
Best of all, the power bill goes down. Things just get better all around.
So now it’s time to prepare for those Norman Rockwell moments
when we celebrate the holidays with traditional family bonding
dinners. There are movies made about all the chaos and conflicts, but
they usually end with the entire group sitting down in a Connecticut
dining room that seats 18 - all toasting each other.
Thanksgiving calls for turkey, ham, sweet potatoes, pies, stuffing,
mashed potatoes (you can never have too many potatoes) and
whatever family recipe has been passed through generations for more
food than any average human can consume. Thanksgiving is on a
Thursday, so we can be sure to have leftovers for the entire weekend
since no one can move for about 3 days anyway.
This is, by far, my favorite holiday, but for a different reason than
most. I was adopted and brought home to my parents just before
Thanksgiving. It became my special time and I can be very territorial
about it. Nobody messes with my Thanksgiving!
Lately I’ve been thinking I should change it up. I’ve seen some
funny reruns of “Everyone Loves
Raymond” where Debra serves
fish but sure enough, Marie shows
up with a turkey anyway.
And then on the soap opera
“General Hospital” they always
have a disaster on Thanksgiving
and wind up eating pizza. (And yes, I have watched that soap since
the 60s.)
For years when I was in the television industry, we used to have
huge dinners because so many actors were away from home working
on shows. They may have been shooting the next day, so we had the
holiday at our house with up to 30 or 40 people I barely knew.
Now I have a small house, and many loved ones are gone, so I have
the perfect opportunity to scale things down. Yet last year, we managed
to have 10 for dinner, sent food for another 6 to a friend’s home and
followed the standard menu choices.
I think the lesson of the day is that no matter how much I would like
to do something quirky or change it up, I cannot mess with tradition. I
imagine we’ll do it again this month.
Rana with NPA awards
And the award goes to…
There is nothing more gratifying than to be honored by your
peers. With that humble sentiment, we’re very proud to announce
that The Vegas Voice has received a total of 8 national
and state awards.
Feature Writing
First: The Vegas Voice, Senior Guardianship
To Rana Goodman and Dan Roberts: “The Vegas Voice is on a mission and judging
by the tone and contents of these articles, it means to succeed.” For our guardianship
articles – “It’s a terrific journalistic effort. Readers are well-served by this
section.”
General Excellence
Second: The Vegas Voice,
“The Vegas Voice switched from a newspaper to a magazine, but it didn’t leave behind
its investigative teeth…its investigative piece on guardianship fraud resulted
in indictments of one of the most scandalous abusers. The Voice should be proud of
this work.”
Front Cover/Illustration
First: The Vegas Voice
To Ray Sarbacker: “The cover illustration captures the mystique of several elements.
Peter Pan is such an imaginary tale. This cover illustration captures the mystique of
several elements. Flight, darkness, sea and exploration come through for an event
telling readers to bring their family and learn to fly.”
Topical Issues
Second: The Vegas Voice
Dan Roberts doesn’t hold back. His state’s attorney general is “Mr. Irrelevant.” The
local district attorney is “Mr. Incompetent.” There’s no missing his meaning.
Overall Design
Second: The Vegas Voice
“The Vegas Voice is primarily a compilation of columns. Each is in a module, which
keeps the pages uncluttered. Each is treated the same with the name and with red
and black type at the top. This magazine is an easy scan.”
Wait there’s more.
The Nevada Press Association (you know the big guys – Las Vegas Review Journal,
LV Sun, etc.) followed with 3 awards; including Best Print Ad by Ray and;
Best Investigative Story by Rana and Dan (“Great reporting and coverage on
a subject. Thanks for your determined efforts to bring to light abuse of those most
vulnerable in our society.”);
And to top it all off, The Vegas Voice was chosen for the “Freedom of the
Press” award for upholding the principles of the First Amendment and protecting
the public’s right in exposing the scandal. (“The fervor to expose a major problem
with guardianship led this senior’s publication to take extraordinary steps – including
overcoming attempts to silence it…to see that reforms were addressed.”)
To say that we’re honored and proud would be an understatement.
And wait to you read what we have planned for 2018!
The Secret to Our Relationship
By: Dan Roberts / Publisher
“
Lift it, lift it! It’s called etiquette,” my
Rana snapped. “Drop it, drop it,” I snarled
back. “It’s called gravity,” was my clever (or so I
thought) retort.
So goes another quick verbal dispute between my Ladylove and yours
truly. You must admit, that if that’s the worst of our squabbles, we’re in
pretty good shape. And I’m thrilled to say (at least from my perspective)
we are.
This month marks the five-year anniversary that our political editor
and yours truly became a forever couple. I’m amazed how fast time
has gone by.
For readers unaware of my previous life, I met Amy when I was 15
and she was only 12. We grew up together, created four perfect sons and
shared 35 years as husband and wife. Then suddenly, six plus years ago,
she was gone forever.
No question I was lost when I lost Amy. I believed that I would never
smile again with my life consisting of being alone and depressed in
front of the TV. Then my uncle (who knew and experienced exactly
what it’s like to lose a wife after all those years) sat down with me,
called me a schmuck and told me to get a life.
Soon thereafter, one of our wonderful Vegas Voice columnists (as
I’ve always told people, you never know what good things can happen
when you read our publication) introduced me to Rana. How Rana
was able to look past my bumbling, fumbling and stumbling is all you
need to know about her heart and compassion. Now, five years later,
we’re still together.
What’s the secret of our relationship?
Now, I’m not going to tell you such BS like love, respect and/or
(heavens forbid) sharing thoughts & feelings. Nor that age-old myth
of “never going to sleep angry” (Rana and I can’t make it past 10
o’clock anyway).
Without doubt, the unconditional reason: separate bathrooms.
Snicker all you want, but it’s amazing how we happily co-exist when
our respective toiletries and stuff (and boy does Rana have stuff) are
in separate johns. Honest-to-god, we have had more discussions (see
opening paragraph) and “talks” when we’re away on vacation sharing
a hotel room.
Fortunately for us, when Rana moved into her home years ago, she
built a full, complete bathroom for her mom. It’s now my commode
and I can state without any hesitation that such kingdom (and throne)
is all mine.
There is never an issue as to occupying all the counter space, or a
concern whether the toothbrushes are located on the right or left side
of the sink. No finding as to the “guilty party” for that squeeze mark in
the middle of the toothpaste tube, or the selection and location of the
preferred “reading materials.”
And most importantly, the placement of that all-important seat.
Five years down and the rest of our lives to go. And I’m smiling and
looking forward to every day.
8. Tell your children over dinner: “Due to the economy, we are going
to have to let one of you go.”
9. Pick up a box of condoms at the pharmacy, go to the counter and
ask where the fitting room is.
And my very favorite:
10. Go to a large Department store’s fitting room, drop your drawers
to your ankles and yell out, “There’s no paper in here!”
Why does a round pizza come in a square box?
Why are you IN a movie, but you’re ON TV?
And how is it that we put a man on the moon before we figured out
By: Vicki Wentz / Vicki’s Voice
Yesterday, my Dad turned 91 years old. I
guess it’s a big deal, but really, we expected
nothing less.
Speaking for myself, a world without Dad in it is truly unthinkable.
I mean I start to think about it, and then I reach this sort of wall, and
can’t go any further.
I need to work on this because there will eventually be a world without
my Dad in it. Dad has had vascular dementia for 3 years, and we lose
him a little more every day. I know I have to work on it, but, not today.
Since Ohio State was playing Penn State (we are fierce, born-andraised
Buckeyes) my brother-in-law, Gregg, brought a gigantic TV
screen and set it up on the deck so we could watch together.
The deck was covered with leaves, so my nephew, Ian, volunteered
to blow it off. My Dad has a big-Mama blower, and when Ian started
it, several things happened: the TV screen immediately fell over; two
little field mice who’d been hiding in a leaf pile came racing out which
alerted Rosie (the dog), who charged across the deck at the exact
moment Gregg was sprinting to the fallen screen. Rosie cut in front of
Gregg, who tried to avoid her and stepped down on one of the hickory
nuts that are covering the deck, and he went airborne.
I looked out the window in time to see the screen on the ground,
Gregg flailing through the air, the dog beneath him hot on the trail
of the mice, who, wisely, had split up, causing Rosie to hesitate (Rosie
is quite overweight due to Dad’s feeding her half of everything on his
10
Ninety-One Bottles of Beer on the Wall, Ninety-One Bottles of Beer
November 2017
plate at every meal).
As Gregg landed, Ian let the blower go and ran
to help him get the screen up, but the blower was
still blowing, which thrilled Ian’s son, James (age
3), who immediately grabbed the blower hose
and began blowing the leaves around the picnic
table, but failed to take into account the paper
cups, napkins and plates on it - as well as the two My Dad
Chrysanthemum arrangements - all of which went
flying over the railing and into the yard. (Meanwhile, I’m thinking if
I’d known there was such entertainment outside this window, I’d have
made popcorn.)
Susan (married to the aforementioned Gregg and organizing the
aforementioned table) tried to grab the paper products flying through
the air, while holding down the tablecloth, and my brother, John,
bellowed at little James to put the blower down RIGHT NOW, but this
just caused James to turn toward him, blowing John so hard in the face
that he had to retreat...over to the wine table.
Having assured himself that Gregg would live, Ian tackled James
and wrestled the blower from him, triggering copious tears from James,
which brought his mother, Caroline, running from the screened porch.
Evidently, one of the mice had decided to hide under the porch step
rather than risk trying to outrun Rosie (it needn’t have worried; Rosie
is a sprinter, not a distance runner) but the slam of the screen door
spooked it and it ran out just as Caroline did, and being a sensible
mice-avoider, Caroline screeched and leaped over the terrified mouse
toward James, assuming the mouse might attack him.
I was eating chili by this time, and I swear I snorted it right up my
nose. Then, I turned and realized Dad was sitting beside me, watching
the show and laughing his 91-year-old fanny off.
I hugged him - hard; he put his arm around my shoulders and
squeezed. “There’s nothing as wonderful as having all you kids here,”
he said. I loved that moment.
I just closed my eyes and hugged my Dad and he hugged me back.
How many more times will that happen? I’ll think about that...
tomorrow.
WOW - World of
Wonder
By: Dianne Davis /
That’s Entertainment
WOW – World of Wonder, a visually stunning
fast-paced variety show is delighting audiences
at the Rio All Suites Hotel and Casino Showroom. It is
feisty and fun with colorful costumes, exceptional 3-D
animation complete with holograms and beautiful sets.
More than 30 artists dance, flip, fly, balance, amuse and
entertain in this whimsical variety show.
The thin thread of a plot is carried by a nerdy guy
chasing a dream. The show includes a visually stunning
scene which begins in the grand ball room of the Titanic
with elegantly dressed dancers and unique special effects
as the ship sinks and our main character escapes to the
next fantasy scene.
The performers are certainly up to Vegas standards,
but the star of the show is the 3-D animation on stage
and on both sides in this 180-degree presentation.
Ships. Elephants, Venice - all beautifully and artistically
projected.
Some of the songs are familiar like “What Would You
Do with a Drunken Sailor” or “I Like It Here in America.”
The scene in Venice included “That's Amore” as well as
an amusing chef with a large derriere doing the plate
spinning routine that we must have seen dozens of times
on the old Ed Sullivan Show.
The living statues were visually stunning. America's
Got Talent alum Silvia Silvia (a tiny lady in her 60s!)
with the special talent of shooting apples off heads with
a cross bow will have you gasping in anticipation and
fear.
And then there was the roller skating act. We've seen
two skaters on a tiny platform, circling at fast speed, but
here it is three in that tiny area. We were sitting close to
the stage in fear that one of them would fly into our laps.
Wow has energy, spirit, a variety of acts, colorful
costuming, and what you want in a Vegas show – the
WOW faction.
Our Great Shows!
Hebert Pedals to Sing
By: Sam Wagmeister / People & Places
Each month Brenda Hebert (pronounced
A-bear) struggles to make ends meet on
two-digit paychecks. But that don’t deter her from
a mission close to her heart.
The struggling singer, whose gigs are primarily entertaining
wheelchair-bound residents in assisted and independent living centers
and nursing homes packs up her fifty plus pounds of sound equipment,
hops one bus and then another and lugs her gear up a steep, 2 block
hill to entertain the troops - the troops of World War II, Korea and Viet
Nam. The troops who call Boulder City’s Nevada Veterans Home their
home.
For four years, this singer with the “never-quit attitude” has donated
her time and bus trips volunteering to entertain her heroes at “mocktail
hour”
The entertainment “bug” first bit Hebert as a pre-teen. She produced
the annual Thanksgiving variety show for her 50-person extended
family.
In mid-2014 the plucky redhead ditched her unfulfilling job to
pursue her music; targeting senior community audiences, riding
busses or her rickshaw-like bicycle to get to 2-5 gigs a week. “Business
is growing,” she says, with last July’s bookings increasing from 7 shows
to 20 this year.
November 2017
EVER! We will have appearances
by some of the top performers
in Las Vegas: Anne Martinez,
Sonny Charles, Chase Brown,
Rosanna Telford, Jonathan
Karrant, Genevieve Dew, Rita
Lim, Irena Nero (Russian
singing sensation) and many
more.
One special guest will be Major
Dustin Sanders who is a fighter
pilot now stationed at Nellis Air
Frankie Scinta will headline/cohost
our new annual tradition
Force Base. He will help us thank all the veterans and inspire us to stay
“VEGAS STRONG.”
With a variety of performers and styles, (and music from all genres)
you are guaranteed to enjoy the show of the year. I’m hoping we will
have enough VIP tables to accommodate all who need a place to put
“Five miles,” she says, “is the breakeven point,” explaining when she
chooses the bus over the bicycle. Those 5-mile jaunts are 90 minutes,
each way.
Hebert has clawed her way to the modest heights. A hospitality
industry veteran, her last Seattle paycheck financed her move to Las
Vegas in 2000, toting her belongings in one box and a suitcase. “I went
from one friend’s couch to another.”
One memory is Hebert singing the National Anthem at a 51’s game
and hopping on her bicycle the next day to head to a seasonal desk
clerk job at the Grand Canyon. She giggles when she thinks of her
survival jobs. “The worst was cleaning toilets for the Clark County Park
District.”
Many would compare Hebert’s journey as muddy. But she says, “At
the end of the show, it brightens my day, even if I’ve had a bad day.”
Back at the Boulder Veterans Home, 83-year old Air Force vet Phil
Keefer yells at the end of Hbert’s performance, “You’re the best.”
Our Queen
By: Charlie Christy / Executive Director
- Ms. Senior Nevada
As we continue to profile
the outstanding members
of the Ms Senior Nevada Pageant Family, our Queen,
Terri MacTaggart, stands out as a shining example of
the quality of the women that comprise this group.
Terri said she entered the Pageant to have a platform
to promote senior causes. And wow, has she!
Terri is currently serving in a volunteer capacity
as a Mediator and Arbitrator on the State Bar of Nevada Fee Dispute
Committee. She is also a Certified Public Accountant.
Additionally, she has recently volunteered to help on Guardianship
reform. Terri will be assisting Rana in her efforts to right the terrible
wrongs that have occurred to our seniors.
We are indeed blessed and honored to have Terri as our current
Ms Senior Nevada. She says things like, “I don’t sing or dance…”
However, Terri is doing something so vital to seniors, we commend her
on her efforts and dedication.
Terri has agreed to be our Queen for a second year while we regroup
and stage a real Pageant. Our contestants will come from all
over Nevada and to continue to proudly represent our state, just as our
organization has done for the past 32 years.
Oh Mr. Grant...
By: Beverly Washburn / Hollywood Memories
thought I'd write this month about Ed Asner
I who, although has done countless films and
TV, is probably best known for his role as Lou Grant
on the 70s sitcom "The Mary Tyler Moore Show."
He was born in 1929 and is still a working actor today. He's been
nominated 20 times for the coveted Emmy award, seven of which was
for the Mary Tyler Moore Show and three of which he won for that same
show.
After the MTM show was cancelled, Ed went on to star in his own
show titled "Lou Grant" which was a dramatic show. In fact, he is the
only actor to win an Emmy for a sitcom and a drama for the same role.
He was also president of the Screen Actors Guild for five years. And in
2001, was the recipient of the SAG Lifetime Achievement Award.
I had the privilege of working with him in 2007 in a little, low budget
independent film called “Hard Four” which was about shooting Craps.
I played the part of Brenda - a tourist who loses all her money playing
the slot machines.
Now there's a concept for ya! I was delighted to meet him as I had
always been a fan.
As you can see by the photo, I had short blonde hair at the time. He
was very nice to work with and I was so happy to have met him.
Fast forward to October 2014. I was at a wedding in Los Angeles and
Mr. Asner was also there. I wasn't sure he would remember me as seven
Backwards & in High Heels
By: Yvonne Cloutier / Musical Moments
When we think of Ginger Rogers, we think
of Fred Astaire's dance partner. However,
she was a singer, actress, AND a dancer.
On her own, she made 72 movies as an actress. Rogers also received
an Academy Award for her 1940 performance as Kitty Foyle.
Ginger was one of the biggest box office draws and highest paid
actresses during the 1940s. In her later life, she performed in Hello
Dolly, Mame and other Broadway plays and TV shows.
She also made USO appearances, visited service camps, hospitals and
did bond drives totaling over $500,000. She graced the cover of Life
Magazine four times.
In the 1930s, she did 9 musicals with Fred Astaire; the biggest
successes were Irving Berlin's 1935 Top Hat, and Kern's & Fields 1936
Swing Time. Ten years later, in 1949, Rogers & Astaire did their 10th
musical, which was their first technicolored film, The Barkleys of
Broadway, with music by Harry Warren and Ira Gershwin.
Ginger replaced Judy Garland (who Fred Astaire preferred) for this
film, but Judy's lifestyle was undependable. Ginger claimed that there
were no bad feelings between Astaire and her, but simply different life
styles. They often developed dance routines together.
Rogers, born in Missouri, was named Virginia Katherine McMath.
Her mother, a Marine vet, was an influential, dedicated, enthusiastic
stage mother. After her mother divorced her father, he was eliminated
18
November 2017
years had gone by, not to mention I now have red hair.
I walked up to him and before I could introduce myself, he gave me
a big hug and said "Beverly, love the red hair!" I was so thrilled that he
would remember me.
How blessed I am to know him. He is truly one very nice, special man.
Until next time, remember wherever there is a human being or an
animal, there is an opportunity for kindness.
from Ginger's life after he
unsuccessfully kidnapped her.
Ginger died in 1995. She lived
modestly and had no children.
Some Anecdotes: After Ginger
had a stage mishap with Astaire, a
Los Angeles Times humorist, wrote:
"Ginger Rogers did everything he
did, backwards, and in high heels."
*In the movie, The Black Widow, she was asked why she played such
an awful role. Ginger replied: "It was very easy, they paid me."
*Ginger claimed that Astaire had a quirk - his unwillingness to kiss
his leading ladies. She blamed his wife for this.
*One time, Ginger designed a beautiful blue feathered gown. The
director disapproved and Astaire disliked it too because the feathers
came off and stuck to his suit. Rogers’ mother however intervened. The
result: Dress approved!
*Ginger & Fred never received one penny from the worldwide
exhibitions of their films. The Screen Actors Guild later formed a union
to protect actors' rights.
Quantum Holograms & Psychic Phenomenon
By: Ali Guggenheim / Psychic Phenomenon
As a scientist, astronaut Edgar Mitchell was
most comfortable in his world of physical
precision and rationality. Yet, the sixth man ever
to walk on the moon experienced a life-altering realization when
traveling back to earth.
He instantaneously knew that this new perception was just as solid
and trustworthy as any scientific or mathematical findings. Mitchell
realized that the beautiful world we all participate in, is part of a whole,
harmonious, living, conscious universe.
Realizing that mankind has "barely begun to probe the deepest
mystery of the universe - the fact of consciousness itself" and foreseeing
the endless untapped possibilities, Mitchell was convinced that the
uncharted territory of the human mind was the next frontier to explore.
It began with some successful (debatable) personal ESP tests from the
moon.
Sparking his lifetime quest "to reconcile the worlds of science and
metaphysics, interstellar exploration and personal growth", he founded
the "Institute of Noetic Sciences” dedicated to finding scientific
answers to humanities great mysteries - such as psychic phenomenon,
psychokinesis, telepathy, etc.
Years of experimentation lead to the recent scientific discovery that
Quantum Holography (QH) is an "attribute of all physical matter
validated by experimental work with functional magnetic resonating
20
Novembert 2017
imaging.”
Mitchell's report states that
tests have shown evidence
that brains process and store
information holographically.
The brain creates a "detailed
three-dimensional movie
generating the stream of
consciousness that the
mind experiences" and
that "holographic processing is not restricted to processing sensory
information in the light portion of the electromagnetic spectrum but,
applies to enhance all the five normal senses.
"The case for mind/mind and mind/matter interactions is
impressively well documented over many decades, with staggering
probabilities against chance having produced the results."
Mounting evidence indicates that every physical object (living or
not) has its own unique resonant holographic memory, stored nonlocally
at Zero Point Field that can be picked up via the mechanism of
resonance. Like the “iCloud”, all information is "hanging out there"
in the collective consciousness and is retrievable by setting intent,
focusing and clearing the channel for access.
Who Are We?
By: Chuck Dean / Vet 2 Vet
Do you remember this?
“I, _____, do solemnly swear (or
affirm) that I will support and defend the
Constitution of the United States against all enemies, foreign and
domestic; that I will bear true faith and allegiance to the same; and
that I will obey the orders of the President of the United States and the
orders of the officers appointed over me, according to regulations and
the Uniform Code of Military Justice. So help me God.”
In case it has faded, or blended obscurely with other memories, this is
“The Oath of Enlistment” into the United States Armed Forces. This oath
has not changed, nor does it cease to exist simply because warriors get
discharged and placed in a reserve status.
We said it; it still applies…and I don’t remember ever having an option
of undoing that commitment when my active duty was over. Do you?
Every Veteran’s Day it has been a practice of many organizations and
individuals to educate or remind the generations of why it is such an
honorable time for those who have served our country. It is necessary
to keep this distinctive day of recognition and acknowledgement from
slipping into oblivion.
However, knowing what a veteran IS can be equally as enlightening.
Who are these people that so willingly give up a carefree life at home to
accept a strict, regulated, and sometimes painfully austere existence that
is demanded of being a defender of freedom?
Answering that question can fill up magazines the size of this
publication many times over, but since we are short of editorial space,
allow me to hone it to a nutshell.
When veterans raised their right hand, and vowed to defend the
American way of life, they demonstrated exactly what the heart of a
veteran is. We are people who swear to uphold what America stands for
- even it means making the ultimate sacrifice. We are mothers, fathers,
husbands, wives, sisters, and brothers who willingly give up the comforts
of normal life to serve anywhere and anytime to ensure those comforts
stay intact for the country we love.
That’s just who we are.
Chuck Dean served as an Army paratrooper in Vietnam and
through that experience was led to address the many transitional
issues veterans struggle with. He is the author of several important
books for veterans. All can be found on Amazon at: http://www.
Introducing the Nevada Elder Hub
By: Rana Goodman / On My Soapbox
When the announcement came naming the
permanent Guardianship Commission
members, I admit I was disappointed that my
application was denied. After working three years to make sure reforms
were made and assisting in getting the word out about the guardianship
system problems, I trust you can understand my feelings.
However, as the weeks elapsed, Dan and I came up with an idea
for bigger and better plans. And like “they” say, (whoever “they” are)
things happen for a reason.
Over the past few years, we have received many calls from readers who
had questions about where to get help for people who are taking care
of their parent, (or spouse, disabled sibling or adult child) on a regular
basis. Since The Vegas Voice through our publication, seminars
and senior fairs, is always in contact with group homes, assisted living
facilities, etc., it seemed like this new idea was a “natural” for us.
Where does one go when care-giving help is needed? Sadly, this can
be the trap for possible guardianship problems. Other times, the family
members just need a “little bit of advice and assistance.” We are hoping
to provide the answer.
The Nevada Elder Hub will be a place to help, chat and cover all
types of senior issues. Plans are still in the very early stage, but what do
you think? Any suggestions or advice would be most welcomed.
One of the ideas is to visit and check out medical facilities and care
From our Vegas Voice family to yours: Have a very happy and
safe Thanksgiving!
giving agencies all over town on a regular basis. We want to develop
a check list of “clean vs. not so clean” or even a Top (or Bottom) 10
List.
Frankly, I’m tired of calling the government offices and getting the
reply, “we will check on that” knowing nothing is going to be done. Just
like we did on guardianship, Nevada Elder Hub will give you the
truth and you do with it what you will!
Guardianship Update: Dan and I have been working closely with
the Nevada Secretary of State concerning the implementation of the
new guardianship law. This new law, effective January 1 st contains the
“official” Guardianship Preference Form as well as Lockbox protections.
Next month, we will have a complete listing of our guardianship
seminars as well as updates explaining the “how to” for the law. Until
then, Dan and I, and our entire Vegas Voice family wish you and yours
a very Happy Thanksgiving.
Seniors & Thanksgiving
By: Dan Hyde / Call to Action
Did you know that every Thanksgiving,
several thousands of seniors go without
any food whatsoever, let alone celebrating the
holiday you and I take for granted? Did you also know that just $5 can
feed TWO (2) hungry seniors with a turkey balanced meal?
YOU can make a difference this Thanksgiving by donating
(at whatever financial level you are comfortable with) to
goodnessgraciousministries.com or catholiccharities.com. You can
also earmark your contributions to a specific cause and help a senior
in need!
You will feel good about yourself in doing so knowing that, at least
for this one day, you made a positive difference in a person’s life!!
PS: You may want to think seriously about contributing to either of
these worthy charities on a monthly basis, knowing that you are doing
your part in feeding those who, unfortunately, know hunger on a daily
basis!
When my Dad, the artist known
A Debt Beyond Gratitude
By: Victoria Seaman / Victoria’s Corner
Our country owes our veterans a debt that
goes beyond gratitude. The men and
women who volunteered to put their lives on the
line deserve the best our country has to offer, but sadly we’re falling
woefully short of this goal.
Our Veterans Administration facilities in Nevada have made
significant strides toward improvement, but there is still distance to
travel before we can have as much pride in the system that exists for the
benefit of veterans as we do in the veterans themselves.
This issue is personal for me - my father was a veteran and my
husband served honorably in the United States Marine Corps. My family
answered the call for service, and I am dedicated to ensuring that the
folks back home remember that and make good on the promises made
to veterans by our government.
The Administration needs to be appropriately resourced and policed.
More importantly, market-based solutions might provide meaningful
innovation to the way our veterans are treated.
Decentralizing the care of veterans and providing them with the
ability to find their own providers would go a long way to eliminating
the waitlist at the VA and ensure that vets have the ability to find the
care that works for them and their unique circumstances.
I support this method because it solves two problems with one
solution by empowering vets and reducing the waitlists currently
plaguing so many of our hospitals. It’s the least we can do for those
who so generously gave of themselves to our country.
Golf Signage & Marketing
By: Mike Landry / Golf Fore Ever
When it comes to golf course signage and
markings – some golf courses are, some
aren’t.
If you happen to play the same golf course all
the time, what I will say next will mean nothing
to you. However, if you play different courses, then golf course signage
and marking is important to you.
One of the reasons for slow play is that players in front of you may not
know the course. They spend much of their time looking for distance
markers, and yes on some golf courses, searching for a tee box.
In my opinion, it should be easy and inexpensive for golf courses to
paint a strip on the curb with the appropriate color of the tee box, put
up a sign indicating where to find the tee box as well
as signage at intersecting paths letting players know
which way to go.
Federal Legislation for Elder Abuse Prevention
By: Richard Black / Guardianship Concerns and the judges who support them, when alleged incapacitated
Much of the recent drama in Washington, persons are presented to the court.
D.C. leaves me shaking my head in This new law requires the following:
disbelief. Politicians from the President on Title I: Supporting federal cases involving elder justice.
down seem to be primarily concerned with self-promotion and appointment of federal law enforcement to train and investigate
partisan backbiting. Is anyone truly committed to protect and aid elder abuse complaints. appoint an elder justice coordinator (ejc)
the average citizen - especially our vulnerable and elderly?
and assistant us attorney in each federal judicial district.
Recently we got some relief.
Title II: Improved Data Collection And Federal Coordination.
On October 19, 2017 President Trump signed the Elder Abuse Title III: Enhanced Victim Assistance To Elder Abuse Survivors.
Prevention and Prosecution Act into law. Portions of this Title IV: Robert Matava Elder Abuse Prosecution Act Of 2017 -
bill has been proffered in federal legislation since 1986 when the Enhanced Penalties For Telemarketing And Email Marketing Fraud
Associated Press did its ground-breaking 2,200 case expose on the Directed At Elders.
rampant abuses found nationwide in adult guardianships.
Title V: Miscellaneous – Reaffirms Court-Appointed Guardianship
More than 20 bills have been proposed since then to insure federal Oversight and establish programs to assess the fairness,
protections for adults under guardianship. All were killed due to the effectiveness, integrity, and accessibility of adult guardianship
successful lobbying efforts by the various state bar and the American and conservatorship proceedings. Implement changes deemed
Bar Association lobbyists, and state and national guardianship necessary to enable the annual accountings and other required
associations.
conservatorship and guardianship filings to be completed, filed and
According to the National Center for State Courts, adult reviewed electronically.
guardianships are a $50 billion business that affects nearly 180,000 This law is primarily focused on white collar crimes and is targeted
new conscripts nationwide each year. While guardianship should to reduce criminal activity endorsed in adult guardianship and
be the last option considered to protect a person, due to the money probate proceedings in Nevada’s courts. What Nevada elected, and
involved, and the near non-existent oversight by the courts, it is judicial leadership and local law enforcement has failed to address,
Two Big Meetings
By: Stu Cooper / Happy Destinations
It has been too long since our last
VEGAS VOYAGERS meeting. I'm
happy to announce that we have two
meetings scheduled for Sunday, November 12th. We
have two meetings, because the first one, (for those
who live in Henderson)
will be at 9:00 am at
BUCKMAN'S RESTAURANT
at the REVERE COUNTRY
CLUB in Anthem.
And the second one, (for those who
live in Summerlin) will be at 1:00 pm in
the FAIRWAY CONFERENCE CENTER at the
SUNCOAST HOTEL AND CASINO. Yes, we have
made it convenient for everyone to attend a meeting.
And what a meeting it will be. We have so much to talk about. For
all of you (we have over 160 people) going on the PHAT PACK Mexican
Riviera cruise from January 27 - February 3rd, we will answer all your
questions about the upcoming cruise. For those who want to book this
cruise, we will also be taking reservations.
There will be an extensive discussion on our "Bus to the Boat" cruises
coming up in 2018 and 2019. Our Princess Cruise vacation options will
also be discussed. Over the past few years, there have been new cruise
itineraries offered round trip from Los Angeles.
Itineraries offered now include the Pacific Coast, Hawaii, Alaska,
Mexico and the Panama Canal. Best of all, we will offer round trip bus
transportation from Las Vegas to the pier in Los Angeles.
At the meeting, there will also be a special Royal Caribbean Cruise
Line presentation. It seems that our Voyagers
really like longer exotic cruises that Royal
Caribbean offers.
For example, as I write this, over twenty
"Voyagers" are on a 23-night cruise
from Seattle to Sydney, Australia. And
another dozen are cruising along the east
coast on various Fall foliage and
repositioning cruises. We will discuss
all the various longer cruise options.
Finally, for those of you who might
have ever considered spending St. Patty's day in Ireland, the
Vegas Voyagers will be offering a St. Patty's day tour in the Emerald Isle
of Ireland. We will also be discussing a longer, more detailed Ireland tour
option for the fall of 2018. Celtic Tours, will be providing this unique tour
option.
There you have it. We will be discussing all of this at our two meetings
on Sunday, November 12th. Please call 1-800-698-1101 or email to
info@vegasvoyagers.com your RSVP and which meeting you will be
attending. We look forward to seeing you there.
Every Day is Veterans Day
By: Kathy Manney / Around Our World
The VA Southern Nevada Healthcare’s
motto - “Here Every Day is Veterans
Day.” This could also be the motto for the
Albuquerque Veterans Museum of Military History and New
Mexico Veterans Memorial Park honoring, not only New
Mexico veterans, but all who have worn the uniform of the
United States Armed Forces.
The museum campus is postcard-worthy and honors not only those
who have served honorably in the military, but for those that will serve in
the future. Stained glass artwork is found throughout the museum.
Each piece of stained glass art denotes one of the six branches of the
United States military service. Medal of Honor recipients are remembered
in specific displays found near the visitor center’s foyer.
The Memorial’s gardens and sculptures make this one of Albuquerque’s
leading tourist destinations. Beginning at the visitor center, you get an
overview of significant wars throughout history told from a New Mexico
perspective. Learn about colonial New Mexico, World Wars I and II, the
Korean and Cold Wars, the Vietnam War and the Iraq War through objects
and stories told by those who lived them.
The museum and park’s unique rose gardens scattered around the
grounds are filled with a selection of roses significant to veterans. From
the Veterans’ Honor Roses to the Peace Roses, each type of rose symbolizes
something of importance to America’s veterans.
Seven settings depict the soldier’s experience - from the “Call” which
symbolizes joining the military to the Homecoming - each setting symbolic
of what a soldier experiences while serving our country.
Whether you are an American military veteran, or simply want to learn
more about those who have for generations served in our armed forces,
the Albuquerque Veterans Museum of Military History and New Mexico
Veterans Memorial Park is a beautiful and moving place to visit.
Do You Know?
By: Jim Valkenburg / Insurance Insight
Will my personal auto policy
provide coverage if I use my
vehicle for business? The answer is
yes and no – depending on the business. All companies
allow for business use of a personal vehicle when your
occupation is, for example, realtor, doctor, sales rep, etc.
That just means that you use your personal vehicle to be
“out and about” during the workday.
Some companies allow some artisan use on a pickup or van. They
often restrict how many jobsites per day and what equipment is being
hauled.
If any of you have become Uber or Lyft drivers, there are a couple of
companies that let you have a personal auto policy (not commercial) and
add on an endorsement for that usage. For the rest of the business use,
you may need to purchase a commercial auto policy. And if you use your
vehicle for delivery of any kind, it will always have to be a commercial
policy.
What deductible should I choose on my home? I believe you
should be encouraged to have the highest deductible you can afford in
the event of a loss. The first reason for this is for premium savings for you.
The higher the deductible, the lower the premium.
The second reason is a bit more critical. If you have a number of
home claims, you can lose your insurance and there are no standard or
preferred companies that will write your home until the losses are over
3-5 years old. If you maintain a higher deductible, you would be less
tempted to put in a small, insignificant claim.
I still remember a lady calling us who had just been canceled by a
large reputable company for claims. She had 3 claims, none of which
exceeded $600. Her premium had been in the neighborhood of $700 and
our quote was over $2,000.
Insurance companies know that frequency of claims is as bad or worse
than severity of claims. Three theft claims will get you canceled, but a
lightning strike that destroys your home will not.
New Device Stops a Cold Before it Starts
By: Doug Cornell / To Your Health
New research shows you can stop a
cold in its tracks if you take one
simple step with a new device when you
first feel a cold coming on.
Colds start when cold viruses get in your nose. Viruses
multiply fast. If you don’t stop them early, they spread in
your airways and cause misery.
But scientists have found a quick way to kill a virus —
touch it with copper. Researchers at labs and universities
worldwide all agree — copper is “antimicrobial.” It kills microbes,
such as viruses and bacteria, just by touch.
That’s why ancient Greeks and Egyptians used copper
to purify water and heal wounds. That’s why Hippocrates,
the “father of modern medicine”, used copper to heal skin
ulcers, and why Civil War doctors used it to prevent infection
of battlefield wounds. They
didn’t know about viruses and
bacteria, but now we do.
Researchers say microbe
cells have a tiny internal electric
charge across the membrane surrounding
the cell. The high conductance
of copper short-circuits
this charge and pops holes in the
membrane. This immediately
stops the microbe from reproducing
and destroys it in seconds.
Tests by the Environmental
Protection Agency (EPA) show
that copper surfaces kill germs that get on them. That way the
next person to touch that surface does not spread the germ.
As a result of this new knowledge, some hospitals switched
to copper for “touch surfaces”, like faucets, bedrails, and
doorknobs. This cut the spread of MRSA and other illnesses
in those hospitals by over half, and saved lives.
The strong scientific evidence gave inventor Doug Cornell
an idea. When he felt a cold coming on he fashioned a
smooth copper probe and rubbed it gently in his nose for 60
seconds.
“It worked!” he exclaimed. “The cold went away completely.”
It worked again every time he felt a cold coming
on. He reports he has never had a cold since.
He asked relatives and friends to try it. They said it worked
for them, too, every time. So he patented CopperZap and
put it on the market.
Soon hundreds of people had tried it and given feedback.
Nearly 100 percent said the copper stops their colds if used
within 3 hours after the first sign. Even up to 2 days, if they
still get the cold it is milder than usual and they feel better.
Users wrote things like, “It stopped my cold right away,”
and “Is it supposed to work that fast?”
November 2017
New research: Copper stops colds if used early.
(paid advertisement)
“What a wonderful thing,” wrote Physician’s Assistant
Julie. “Now I have this little magic wand, no more colds for
me!”
Pat McAllister, age 70, received one for Christmas and
called it “one of the best presents ever. This little jewel really
works.” Many users say they have completely stopped
getting colds.
People often use CopperZap for prevention, before cold
signs appear. Karen Gauci, who flies often for her job, used
to get colds after crowded flights. Though skeptical, she tried
it several times a day on travel days for 2 months. “Sixteen
flights and not a sniffle!” she exclaimed.
Business owner Rosaleen says when people are sick
around her she uses CopperZap morning and night. “It saved
me last holidays,” she said. “The kids had colds going round
and round, but not me.”
Some users say it also helps
with sinuses. Attorney Donna
Blight had a 2-day sinus headache.
When her CopperZap arrived,
she tried it. “I am shocked!”
she said. “My head cleared, no
more headache, no more congestion.”
One man had suffered seasonal
sinus problems for years. It
was so bad it ruined family vacations
and even dinners out with
friends. His wife Judy bought
CopperZaps for both of them. He
was so skeptical he said, “Oh Judy, you are such a whack
job!” But he finally tried it and, to his surprise, the copper
cleared up his sinuses right away. Judy and their daughter
both said, “It has changed our lives!”
Some users say copper stops nighttime stuffiness, too, if
they use it just before bed. One man said, “Best sleep I’ve
had in years.”
Some users have reported success in stopping cold sores
at the first sign of a tingle in the lip. One family reports it has
worked to eliminate warts as well.
The handle is sculptured to fit the hand and finely textured
to improve contact. Tests show it kills germs on fingers to
help you stay well and not spread illness to your family.
Copper may even help stop flu if used early and for several
days. In a lab test, scientists placed 25 million live flu
viruses on a CopperZap. No viruses were found alive soon
after.
The EPA says the natural color change of copper does not
reduce its ability to kill germs.
CopperZap is made in the U.S. of pure copper. It carries
a 90-day full money back guarantee and is available for
$49.95 at CopperZap.com or toll-free 1-888-411-6114.
What Da Hemp?
By: Dr. Victoria Boyd / Hempworx
What’s been around for thousands of years,
used by almost every human civilization,
proclaimed as a miracle medicine, and then
demonized through propaganda as the source of all evil?
You may have noticed a buzz (no pun intended) that is growing
every day and I gain satisfaction knowing factual information is finally
being shared. You would be astounded at some of the questions I’m
asked based on the myths and misconceptions out there.
If you haven’t guessed it yet, I’m talking about Cannabis, a multifaceted
desert plant that in a mere 80 years (not long considering its
history) has the distinction of being at both ends of the spectrum -
hated and loved. But why?
My goal is to answer the WHY. We will provide information, answer
questions, and share facts about this not so mysterious plant.
We’ll talk about its origin and why the tides are turning back to an
era when it was a mainstay in society. Without the stigma attached of
being a stoner, we’ll get to the root (pun intended) of the information;
especially the health benefits it can provide to seniors like me.
What’s our first WHY? A key confusion point, what are Cannabis,
Hemp and Marijuana? Here’s the simple version.
Think of Cannabis as the parent of a girl named Marijuana (female
plant) and a son named Hemp (male plant) that have different
chemical composition – their DNA. As an annual (you know like the
8907_OctVegasVoice_Ad_FIN.pdf 1 9/22/17 11:58 AM
petunias sold at our local nursery every year) the species produces male
and female plants. It’s a matter of genetics.
As a female plant, its flowering buds produce a resin rich in the
common compound THC, the source of the psychoactive effect. On the
other hand, the male plant does not produce a female bud allowing
energy (females suck the life out it) to be redirected for stronger stalks
and stems that are great for industrial use.
This male plant also has higher levels of a group of compounds
called CBD’s (Cannabinoids). It is this group of compounds that have
an immense health benefit on so many levels.
Let’s get the conversation going. I invite you to send questions or
suggest a topic for an article.
Talking About Boobs!
By: Linda Bateman-Gomez / Timeless Beauty
Let’s talk about boobs! And for any men now
suddenly reading this, this is unlikely to go
down a path that you will be interested in.
First off, as October’s National Breast Cancer
Awareness month has quickly passed us by, it’s important to remember
that this awareness should be every month! Breast health is just as
important as any other part of our well-being. Remember your checks
and remind a friend too!
Like many things, they can often go overlooked everyday as we
quickly strap them into a (probably) poor fitting bra in the morning
and we forget to give them the proper attention!
While I wouldn’t change a thing, breastfeeding 6 children has
certainly left its mark on “the girls” today.
And although we now know that breastfeeding is known to lower
your breast cancer risk, Mother Nature often gifts you in return a
smaller, sagging version of your younger, baby-free boobs.
Throw in age and gravity and suddenly we have one more daily thing
to manage. That’s where a good bra works wonders!
Recently at a seminar, a stranger asked if I would mind a personal
question. I was a bit surprised, but she excused her husband and asked
me what type of bra I was wearing.
Such a girlfriend thing to do! I said I didn’t shop specific brands, but
complete coverage sweater bras were my go-to style.
I must admit it was an unusual
conversation because I never met
her before. I did understand her
quest however, as a good bra works
wonders and she hadn't found one
yet. As it turned out, she shopped
at fancy lingerie stores and while
pretty, it didn't produce the results
she paid for.
My guess is many are in the
same boat. And at our age, you should have something that fits properly,
is comfortable, and produces the look you are after!
When shopping, first know what you want to accomplish. Do you
need lift, smooth coverage, comfortable straps? Then make a point to
spend some quality time shopping and find the right one!
At every department store, they are always willing to measure and
help. If in doubt, just ask. Strange as it sounds, it’s an important part
of your every life.
You will feel beautiful and your boobs will thank you at the end of
the day too!
Whenever someone finds out I’m an
automotive journalist, inevitably, the
next question is, “What car should I buy?” It’s not
a one-size-fits all answer.
How you use your vehicle and what your budget is are the two biggest
deciding factors, but that’s the easy part. Because buying a vehicle is the
second most expensive purchase people make in their lifetimes, it should
require a lot of thought and research before you sign on the line.
While most people are doing research online, the first step before the
internet is a pen and paper. You first need to write down the parameters
that fit your needs.
Here are the most important questions: How many passengers will you
have? How many miles do you travel per year? How much time do you
spend commuting?
What will you use it for on weekends? Does it fit your hobby? How big a
monthly payment can you afford? How big is your garage?
This last question might seem minor, but too many times we’ve seen
people buy trucks and full-size sedans or SUVs that were too long to go
inside the garage and close the door. Buying a car isn’t like a piece of
clothing; you can’t return it because it doesn’t fit.
In addition to those basic questions, think about your previous car
purchases, and then ask yourself (and write it down): what did you really
like about your last car? What did you dislike? What is an absolute must
have on your next vehicle?
Finally, when you get your list together, go online and check out how
some of the new technologies work. You may not want or need 4G LTE
Wi-Fi, but blind spot recognition is a great safety feature that you’ll use
all the time.
Being prepared before you go into the dealership will make not only
your purchase decision easier, but also will help the sales consultant pair
you with the right vehicle. And remember, you can always email me with
questions or just ask for advice. Happy shopping!
Fall has arrived and you discovered those
dreaded “love handles.” It’s time to work
on getting back into shape before the holidays are
here.
Oblique exercises play an important role in core strengthening. It is
important to move the spine in all directions - forward, backwards, side
bends to the right, left, twisting to the right, left. Try this move to help
tone and strengthen your obliques (the thin, flat muscles forming the
middle and outer layers of the lateral walls of the abdomen). Play fun
music and move to the beat!
Oblique Crunch: Lie on your back, bending your knees. Keep your
shoulders flat on the floor. Exhale as you lift your shoulder blades off
the floor.
Slowly rotate your legs to the left. Even though your knees are turned
to the side, keep your upper body moving straight up and slightly to the
left side. Place your right hand behind your head and your left hand
across your abdomen. Hold at the top for 1 second and slowly lower.
Repeat 8-15 times and switch sides.
Look up at the ceiling, tighten your abs, exhale as you crunch straight
up. Try to maintain tension in your obliques as you lower yourself back
to the starting position. Do this exercise at least 3 times a week.
Variation: Bend knees, place arms straight out to side and move
Those Dreaded Love Handles!
Bone Spurs
By: Kyo Mitchell / A Healthier You
As many individuals grow older, they tend
to suffer more pain of various sorts. One
potential cause of pain are osteophytes or as they
are more commonly called - bone spurs.
A bone spur causes pain by being a hard substance which presses
on a softer tissue and irritates it or causes it damage. This softer tissue
can be a nerve, tendon or ligament. Imagine stepping on a small, hard
pointy rock every time you took a step and you get the basic idea of why
a bone spur can irritate tissue and cause pain.
For those individuals who suffer from pain due to a bone spur, their
primary question is, “How do I obtain relief?” While surgery may be
possible to remove a bone spur, many individuals are reluctant to go
through surgery and will only do so as a last resort.
Like all medical problems, to effectively treat it, you need to
understand what caused it in the first place.
In order to move the body, muscles must be attached to bone. The end
of the muscle that attaches to the bone is called a tendon. The muscle
does not actually attach to the bone but rather to a tough, fibrous tissue
which surrounds and protects the bone called the periosteum.
The place where the tendon connects to the periosteum can be a weak
link in the musculoskeletal system where damage is likely to occur.
Many times, due to stress, incorrect posture or the body compensating
from previous injury, a muscle is in a continual state of tension.
November 2017
bent knees side to side. Do this at an even pace.
Hula Hoop Crunch: Another “fun” way of whittling your waist is
to use a hula hoop (yes, you can get them in the kid’s toy department
or discount supersaver stores) and use the hula hoop while watching
television! I try to do this at least 3-4 times a week. Move at an even pace
so as not to injure your spinal column.
Remember, in any exercise – especially something that you are
doing for the first time, do it in moderation, then gradually increase
the intensity. Always check with your doctor if there is any doubt for
any exercises.
Positive attitude and good health to all!
Therefore, where the tendon of this muscle attaches to the periosteum,
it is also under a continual state of tension. The body senses this as
a possible weak point and tries to reinforce its structure by adding to
calcium to it, making it harder and stronger. This is a bone spur.
Constant muscle tension gave rise to the conditions which created
the bone spur. Similarly, re-educating the muscle so that it is not in a
continual state of tension will tell the body that the reinforcement that
gave rise to the bone spur is no longer needed. Over time, the body will
re-absorb this calcium and the bone spur will dissolve.
Cancer & Gum Disease - Attention Ladies!
By: James J. White, D.D.S. / Your Dentist
According to a recent publication of
“Medical News Today”: New research has
confirmed that periodontal disease is tied to an
elevated risk of several types of cancer; such as esophageal cancer,
breast cancer, and gallbladder cancer - especially in mature women.
Periodontal disease, aka Periodontitis, is a result of infection and
inflammation of the gums. Gum disease affects adults and is especially
common among seniors.
In fact, the Center for Disease Control has reported that some 70% of
people 65 and older have gum disease. Gum disease affects more men
than women, but 38.4% of the female population in this country are
living with periodontal disease.
Jean Wactawski-Wende, PhD, of New York’s State University in Buffalo
and several colleagues from other American institutions has for the
first time, investigated the association between gum disease and several
types of cancer in women. These finding are published in the journal
“Cancer Epidemiology, Biomarkers & Prevention.”
This research has confirmed that women who have gum disease
are “also more likely to develop breast cancer.” In addition to the link
with breast cancer, the study indicated a link between gum disease and
gallbladder, lung, melanoma and esophageal cancers.
The bottom line of this study (which followed 68,869 female patients
ages 54-86) was to understand the correlation between periodontal
disease and the risk of cancer in women. This study found “…that
women who had reported a diagnosis of periodontal disease had a 14%
astering the art/science of dentistry takes
and a passion for the art of dentistry.
higher risk of developing any type of cancer.”
It is not yet understood what this link between periodontitis and
various types of cancer is. The rather obvious explanation offered is
bacteria and other pathogen from the mouth made their way into the
bloodstream through saliva or the diseased gum tissues. More research
needs to be conducted to establish an actual mechanism.
I have simplified these findings to help readers understand that oral
health is an integral part of one’s good health. It is really a simple thing
to control one’s oral health. It is also one of the few diseases of our body
over which we truly have some control.
My goal as a “physician of the mouth” is to help everyone understand
and know that one is not in good health without good oral health.
Living Trust vs. The Will: What Do You
Need?
The short answer to this question is both. You
need both a living trust and a will.
You might think of it like this: the will is your last testament; it’s what
you write to communicate your wishes. The Living Trust is the vehicle
that carries out those wishes.
Without the vehicle, all you have is the paper, which is why doing only
a will might still result in your intentions being carried out, but your
entire holdings will have to pass through probate which is an expensive
and time-consuming process.
I sometimes joke and say that if you complete a proper living trust,
then all you have to write in your Will is, “Being of sound mind and body,
I SPENT IT ALL.” While this is funny, it is also somewhat true, because
when you set up a trust, you essentially no longer own anything.
anything. (Imagine how freeing that could be?) Instead, the trust owns
everything.
You also need to designate a backup beneficiary and a backup trustee
called successor trustee(s). Their job is to manage your trust if you cannot
and or eventually distribute your trust to your beneficiaries when you kick
the bucket.
The successor trustee of the trust is also the executor of the will. That
means they are the ones who make sure your wishes are carried out, so
the court doesn’t have to get involved in your business.
It’s that simple.
The successor trustee or trustees are usually your kids or beneficiaries,
but it can also be a friend, an attorney, or a trust company. Your backup
beneficiaries can also be anyone you want, either your kids (if you still
like them) a charity you value, or the guy writing this article. Just kidding!
Really, it’s all up to you. You can add assets to your trust by opening a
You do, however, still get to decide where your money will go. You can
also change your mind. If one of your kids comes to Las Vegas to visit,
puts a few bucks in the slot machine, and hits megabucks for $30 million,
well, then you can take them out of your trust, not because you don’t love
them anymore, but because they don’t need your pittance of an estate!
One of my favorite trust stories from back in the days was a client who
got so upset with her two kids, she took them out of her trust and left the
entire estate to her cat, Ms. Kitty. She set it up so her neighbor would be
paid $500 a month to take care of the cat, and all the rest of the assets
were divided among three animal charities equally.
Imagine – she was able to accomplish all of this from beyond the
grave. (So kids, if you’re reading this, show respect to your elders!)
Setting Up a Living Trust: What Do You Do?
When you create a living trust, you get to wear three hats:
1. The first hat is the Trustor which means “Great Creator.”
2. The second hat is the Trustee which is the manager
3. And the third is the Beneficiary. You can even write yourself
checks from your own living trust!
Once you set up the trust, your life will go on the same way as without
the trust, but the one main difference will be that you don’t actually own
36
November 2017
new bank account in the name of the trust, or you can buy a beach condo
in the name of the trust. If you end up closing the bank account or selling
the condo, you just close it or sell it and it’s out of the trust. That’s all you
have to do.
The trust uses your Social Security number as the tax ID, which means
you file for your taxes the same way as you did before you set up the trust.
You can have your tax professional or a qualified financial professional
talk to you about any tax savings you might be able to take advantage of
if you set up a trust.
Remodeling? Freshening up your home?
There are 6 basic elements to drafting an agreement with any contractor that will do work on your
home. Whether it is a small job, or a complete remodel, your agreement should have these basic provisions.
1. A detailed description of the project. The contract should include a project description that outlines all of the
work, materials, and products needed for the job. That includes everything from what will be demolished to
what will be constructed—including every material and fixture that will be used, with its cost. It should specify
that the contractor will obtain all of the necessary permits (and close them out when finished) and dispose of the
debris properly, and that the project is covered by their liability and workman’s compensation insurance.
2. How much (and how often) the contractor will be paid. Not only should the contract state the total project
price, but it should also outline the timing and amount of installment payments based on project milestones. If
the contractor has to place orders for expensive items such as windows or cabinets, offer to pay the supplier
directly. The final payment should be at least 10% of the total project cost, payable only when the final “punch
list” is completed to your satisfaction.
3. Lien waivers. Here’s a scary thought: Any worker who comes to your house as part of a remodeling crew could
place a lien on your property, claiming they were never paid for their work—even if you have paid the contractor
in full. So write into the contract that your contractor must provide you with a “lien waver” for each installment
before you pay the next one. The invoice for each payment needs to include a signed statement indicating that
the contractor used your previous payment to pay for the labor and materials described in its invoice.
4. Approximate project dates. Discuss approximate start and end dates for the project with your contractor and
write them into the agreement. The point is not to hold him to an exact date but to ensure that you both have an
understanding of when work will commence and—barring weather interruptions or major plan changes—about
when it will be completed.
5. A procedure for making changes. Write in that no changes to the original plan can commence until the contractor
has given you a clear description of the new work, how much it will cost, and how it will affect the
schedule—and that you must give written approval. Change orders should be done in writing. If you ever make a
verbal agreement on the fly, follow up with an email to the contractor restating the details and your approval,
and ask him to respond with a confirming email that you got the details right, so you have a written record.
6. Signatures. A contract isn’t a binding legal document unless it’s signed by both parties. Include the
contractor's license number and both of your addresses on the document.
Many contractors have their own contracts that they may use. You should READ every word of what you are
signing and make sure that you understand it before you sign. If both you and your contractor understand
upfront what is expected of each of you, your project will be much more pleasant and satisfying for all involved.
