Dear Friend of Legal Aid,<br />
We passionately protect the rights of those in our community who most need, but can least<br />
afford, legal help. Amidst the prosperity of San Mateo County, the median household income<br />
of our clients is $18,846, which is only one-fifth of the San Mateo County median household<br />
income of $93,623.<br />
Since the last impact report, our low-income neighbors from nearly every city in the county<br />
have sought our legal assistance to ensure that they have the basic necessities of life.<br />
In addition to continuing our 6 key areas of service—housing, healthcare, public benefits,<br />
immigration, domestic violence and education—we are expanding the scope of our services<br />
to respond to uncertainty from the federal government. We’ve been asked to make scores<br />
of presentations about the status of the law particularly in immigration, healthcare and housing,<br />
and we regularly get calls for technical assistance about the law.<br />
We are grateful to local funders who have responded quickly to the shifting political landscape<br />
by providing grants to help us address immigrants’ urgent requests for legal assistance.<br />
This funding gives our LIBRE (Linking Immigrants to Benefits, Resources, and Education)<br />
program the resources to increase the range of services offered to immigrants, including<br />
representing immigrants seeking legal status and helping parents develop family preparedness<br />
plans in case a family member is detained or deported.<br />
We are also proud of the first-of-its-kind 2016 San Mateo County Eviction <strong>Report</strong> published<br />
by Legal Aid and co-author Community Legal Services in East Palo Alto. For the first time,<br />
statistical information about the housing crisis in our neighborhood was compiled, analyzed<br />
and made public. The report guides officials, decision-makers and the public in the debate and<br />
decision-making process about the housing crisis.<br />

This family was able to keep<br />
their housing with help from<br />
Legal Aid.<br />
"Laila" and her children have made their home in an<br />
apartment in Redwood City for seven years. The two<br />
younger children walk to elementary school every<br />
day, and the eldest daughter is on the swim team<br />
and the cheer team at the local high school. In the<br />
fall of 2016 the building was sold to new owners.<br />
On the day escrow closed, all the tenants received<br />
notice of a $200 rent increase, except Laila. She<br />
received a 60-day eviction notice that didn’t state a<br />
reason for the eviction.<br />
Laila told the landlord that she couldn’t move in 60<br />
days and didn’t want her children to have to leave<br />
school in the middle of the school year. The new<br />
landlord said she could have an extra thirty days on<br />
condition that she pay the $200 rent increase the<br />
other tenants were absorbing, and an additional<br />
$500, for a total of $700. Laila was desperate and<br />
paid the new landlord $700.<br />
Laila came to one of Legal Aid’s three weekly housing clinics where she was interviewed<br />
in Spanish by a housing coordinator. Legal Aid contacted the landlord to find out why the<br />
family was being evicted and was told that the family was “messy.” When staff met with<br />
Laila in her apartment, they found it was in good condition and became suspicious that the<br />
landlord was discriminating against Laila because she had three children and was a single<br />
mother.<br />
The landlord filed an eviction case against Laila. Legal Aid fired back by vigorously<br />
contesting the eviction case, and threatening to file a discrimination case against the<br />
landlord. The landlord backed down, dismissed the case, and dropped his efforts to evict<br />
Laila and her children. They remain tenants in their home and the children continue to<br />
attend their schools.<br />

reading with help from<br />
Legal Aid.<br />
Client names and other details have been changed for reasons of privacy<br />
Reading wasn’t easy for 5th grader "Zeke." While his<br />
classmates were choosing chapter books for quiet<br />
reading time, he was choosing picture books, hoping<br />
none of his friends would notice. Zeke’s teacher knew he<br />
was struggling and put him into a small reading group,<br />
but that wasn't working. Zeke’s mother was concerned.<br />
Zeke’s older sister hadn’t had the same kind of problems<br />
when she learned to read.<br />
When Zeke’s mother told the pediatrician at Gardner<br />
Packard Children’s Health Center (Gardner) about<br />
Zeke’s reading struggles, the doctor referred her to the<br />
Peninsula Family Advocacy Program (FAP), a medicallegal<br />
partnership between Legal Aid, Gardner, Lucile<br />
Packard Children’s Hospital Stanford, and other clinics in<br />
the county. FAP provides free legal services to children,<br />
pregnant women and their families to help address the<br />
social determinants of health, including education issues.<br />
The FAP attorney immediately began to advocate with the school district on behalf of Zeke’s<br />
mother. In the past, Zeke's mother had asked Zeke's school for a special education assessment,<br />
to see if he had a learning disability, but the school had declined. As a result of the attorney's<br />
advocacy, the school finally agreed to the assessment.<br />
After a thorough assessment, it was determined that Zeke had a learning disability and was<br />
only reading at a 2nd grade level. The FAP team recommended an outside reading intervention<br />
program that specializes in working with children who have reading disabilities. FAP was optimistic<br />
that Zeke, who was a hard worker and eager to improve his reading, would thrive with this type of<br />
reading intervention. After negotiations were complete, Zeke began his program as soon as school<br />
concluded for the year. Now, Zeke’s mother reports that her son has made tremendous strides in<br />
his summer intensive program and is excited to be closer to be reading just like his peers at middle<br />
school this fall.

family safe with help from<br />
Legal Aid.<br />
Many months prior to the Trump Administration's end<br />
of the DACA program, "Aleeza," an 18 year old mom,<br />
contacted Legal Aid's Teen Parent Project because she<br />
had filed for DACA but had never heard back from US<br />
Citizenship and Immigration Services (USCIS). She was<br />
unable to re-file because she could not afford to pay<br />
the $495 filing fee again.<br />
She met with Legal Aid's Teen Parent Project attorney,<br />
who helped her file a request with the money order<br />
company to reimburse her filing fee and then refiled<br />
her DACA application. When USCIS wrongly<br />
denied her DACA because of juvenile police contacts,<br />
Legal Aid helped her file a complaint and her DACA<br />
application was approved.<br />
Shortly thereafter, Aleeza and her husband were brutally attacked by gang members, who hit her<br />
husband over the head with a brick and grabbed her by the hair and threw her to the ground.<br />
Aleeza turned to Legal Aid’s Teen Parent Project attorney again, who gave her immediate legal<br />
assistance and representation in court. The attorney helped Aleeza file for restraining orders<br />
against the gang members and encouraged her to cooperate with the prosecution, despite her<br />
fear of retaliation.<br />
Aleeza did testify against the gang members and three of her attackers, and a fourth who<br />
helped them intimidate her after the attack, were convicted or pled no contest to felony charges<br />
and were sentenced to state prison. Legal Aid advised Aleeza that because she had helped<br />
law enforcement and testified against perpetrators of a crime, she was eligible to apply for U<br />
Nonimmigrant Status. Legal Aid helped Aleeza obtain a U Visa certification and apply for U<br />
Nonimmigrant Status for herself and her parents, long term San Mateo County residents with two<br />
US citizen children. Their applications are pending.<br />

This girl got the medical care<br />
she needed with help from<br />
Legal Aid.<br />
"Brianna" is a medically fragile child who was discharged<br />
from the hospital with a diagnosis of a serious medical<br />
condition. Although she qualified for at-home nursing<br />
care under her health care coverage, even after several<br />
months had gone by, her family's insurer was still looking<br />
for a qualified nurse to assign to her case.<br />
Brianna's mother "Mary," though not a medical<br />
professional, had assumed the sole responsibility for<br />
the complexities of her daughter's care and was feeling<br />
exhausted and overwhelmed. She was also frustrated<br />
by the long delays in obtaining a service which her<br />
daughter was entitled to receive. Following a referral<br />
from our partner agency Community Gatepath, Brianna's<br />
case came to Legal Aid's Peninsula Family Advocacy<br />
Program (FAP).<br />
FAP is a medical-legal partnership between Legal Aid, Gardner Packard Children’s Health<br />
Center, Lucile Packard Children’s Hospital Stanford, and other clinics in the county. FAP<br />
provides free legal services to children, pregnant women and their families to help address<br />
legal problems which are adversely impacting their health, including access to health care.<br />
The FAP attorney discussed the case with Mary, and informed her of Brianna's legal right<br />
to appropriate at-home nursing care. The attorney then immediately filed a grievance<br />
with the insurer. Shortly after the grievance was filed, Brianna was hospitalized again. In<br />
the meantime, Brianna's nursing care was approved and a nurse was assigned to care for<br />
Brianna as soon as she was discharged from the hospital.<br />
Mary is relieved that her daughter is now receiving the appropriate care at home, and<br />
grateful that Brianna's health and wellbeing are being supported by a skilled nurse.<br />

<strong>Impact</strong>ing the Housing Crisis:<br />
San Mateo County<br />
Eviction <strong>Report</strong> 2016<br />
In 2016, the Legal Aid Society of San Mateo County and coauthor<br />
Community Legal Services in East Palo Alto released<br />
the San Mateo County Eviction <strong>Report</strong>, funded by The San<br />
Francisco Foundation and designed by the Anti-Eviction<br />
Mapping Project.<br />
This report, the first of its kind in San Mateo County,<br />
compiles three years of the agencies' eviction case data,<br />
covering the period July 2012 to June 2015, and will<br />
aid agencies and governments in bringing clarity to a<br />
contentious local issue.<br />
San Mateo County eviction data is not available in any<br />
centralized, publicly accessible database, making this report<br />
the first integrated source of information to reveal the full<br />
scale of the eviction problem in the heart of Silicon Valley,<br />
and to bring to light a number of startling trends:<br />
• A 59% increase in the number of evictions for people unable to pay rent on time<br />
• A 300% increase in the number of "no-cause" evictions, where the landlord gave no<br />
reason for the eviction<br />
• Seventy percent of the households that sought legal services to help with eviction<br />
issues had children<br />
• Evictions disproportionately impact Hispanic and African American households<br />
One of the report's authors was Legal Aid Directing Attorney Shirley Gibson, who brought to the<br />
project nearly a decade of experience working on housing issues in the county.<br />
Says Shirley, "My hope is that the San Mateo County Eviction <strong>Report</strong> will be used by officials, decision<br />
makers and the general public, all of whom are well aware of the housing crisis, but lack data to inform<br />
debate and make decisions."<br />

The <strong>Impact</strong> of Advocacy:<br />
California AB 291 strengthens<br />
protection for tenants<br />
This year, California Assembly Bill 291, The Immigrant Tenant<br />
Protection Act, passed the state legislature, and was signed<br />
into law by Governor Brown in October. The Act strengthens<br />
state law to protect immigrant tenants from intimidation and<br />
retaliation in their homes.<br />
Immigrant tenants live in a climate of increasing fear of<br />
government enforcement action that may be taken against<br />
them at any time. This fear can be held over their heads by<br />
unscrupulous landlords who assume that their immigrant<br />
tenants will be afraid to report abusive actions—extreme rent<br />
increases, threats of illegal eviction, or refusal to maintain the<br />
property in livable conditions—if they are threatened with<br />
being reported to Immigrations and Customs Enforcement.<br />
"Tenants should not have to live in fear simply because they are immigrants or refugees," says<br />
bill sponsor Assemblymember David Chiu. "Trump's escalating war on immigrants is ripping<br />
apart families, and mass deportations could be our new reality. This bill will deter the small<br />
minority of landlords who unscrupulously take advantage of the real or perceived immigration<br />
status of their tenants to engage in abusive acts."<br />
"We have seen an alarming increase in national origin/immigration status discrimination felt<br />
by tenants since the election," says Legal Aid Housing Project Coordinator Andreina Leon, "a<br />
fear that can be exploited by landlords wishing to pressure tenants to accept rent increases, or<br />
eviction, without formal legal process."<br />
Legal Aid Directing Attorney Shirley Gibson contributed data and testimony in support of<br />
the bill, and she is pleased that these tenant protections have become law: "AB 291 is a<br />
commonsense bill that responds directly to the abuses most commonly reported by Legal Aid<br />
clients. Its safeguards are especially necessary given that most undocumented Californians<br />
are renters."

Making an <strong>Impact</strong><br />
When "Maria" ended her brief dating relationship with<br />
"Eric," he responded with threats of physical harm and<br />
violently shoved her. After she moved out to escape him, he<br />
began stalking her: he would leave notes and personal effects<br />
on the windshield of her car, and send texts to show that he<br />
knew her movements and whereabouts. Eventually, Maria<br />
discovered that a GPS device had been hidden in a secret<br />
compartment of her car, and she turned it over to the police.<br />
She then iled for a restraining order against Eric, and her<br />
case was referred to the irm of Latham & Watkins LLP by the<br />
Domestic Violence Collaborative, a partnership of the Legal<br />
Aid Society of San Mateo County, Bay Area Legal Aid, and<br />
CORA (Community Overcoming Relationship Abuse).<br />
Eric denied all of Maria's claims and asserted his right to an evidentiary hearing, which would<br />
be delayed for 8 months due to court backlogs. Although Maria had the beneit of a temporary<br />
restraining order in the interim, Eric used this time to harass and intimidate her by bringing<br />
bogus claims against her in small claims court. While the rules of small claims courts did not<br />
allow a Latham attorney to appear with Maria in small claims court, we helped prepare her<br />
defenses, and project assistant Na Ho attended the hearing to provide support. As a result of<br />
these efforts, the small claims court denied relief for Eric's claims.<br />
Led by Emily Chen and Nick Woloszczuk, the Latham team took advantage of the time before<br />
the evidentiary hearing and successfully subpoenaed records from the GPS device maker. These<br />
records proved that Eric had purchased the GPS device and that he was receiving alerts to<br />
monitor our client's movements. Facing this evidence of stalking (which is a form of domestic<br />
violence under state law) and the prospect of paying Maria's fees and costs, Eric gave up his<br />
defense, and the evidentiary hearing, and instead agreed to the stipulation of a three-year<br />
restraining order.<br />
