People often ask me “What is the definition of a buyer and a seller?”<br />

Well a very simple answer is that a buyer is somebody that “buys” and a seller somebody<br />

that “sells”. I am not being sarcastic I am serious!<br />

By that I mean that the two persons mentioned above are people that take action and<br />

follow through. They act in writing, and do not remain in the phase of talking about the<br />

subject.<br />

If you fall under the definition of a Seller with motivation and reason to sell, then in my<br />

opinion, one of the most important factors is compiling a competitive selling price with<br />

written facts to prove such a suggested price.<br />

Trust me, if you price incorrectly from day one, it will result in months of trying to sell your<br />

property as well as potential unpleasantness in the process.<br />

Please keep in mind- there will not be a fool around to buy your overpriced property, as<br />

fools do not have the financial capacity to buy.<br />

Keep in mind that the Buyers out there will be knowledgeable about the market by the<br />

time they make a decision, as by then they would most probably have seen more<br />

properties than what the Agent has seen.<br />

Estate Agents are not wizards; they are merely a liaison between the Seller and the Buyer<br />

with knowledge to assist both the parties to get to a win-win agreement.<br />

Going to market, you should seek out the assistance of a person who is both<br />

knowledgeable of the market and is trustworthy with a proven record of success.<br />

Once the Estate Agents asks you, “What is the amount that you want for your property?”<br />

you should tell such person that you have had them come to the property to give you their<br />

suggested price to go to the market with.<br />

It you tell the Estate Agent what “you think” the price should be, you have robbed and<br />

influenced the objectivity of the Estate Agent, essentially delegating to them how they<br />

should evaluate your property.<br />

If you lead them in what you as the Seller require for your property, some Agents may<br />

on occasion attempt to please you as the Seller to the detriment of actually selling your<br />

property. Most of the time, these situations are based on the Agents fears that you will<br />

not give them the mandate to sell; and opt instead to give your mandate to an Agent who<br />

is willing to tell you want you want to hear.<br />

Do not underestimate this fact; it is a real issue in the market. Often you should go with<br />

the person apposing your price (if need be) with written proof of why they oppose you.<br />

These are the Agents that know their profession and how these processes work.<br />

If you are going to lead the Estate Agent with your asking price and get him to conform,<br />

it is most probably going to cost you time and lots of money, trust me on this.<br />

Please ask your Estate Agent for his CMA (Competitive Market Analysis) in writing. If he or<br />

she does not know what you are talking about then forget them and seek somebody else<br />

who does.<br />

Next week, I will deal with a CMA - how to price while considering market facts.<br />

Do not work or give mandates to Estate Agents who cannot produce their licence (FFC)<br />

because according to the EAAB (Board of Estate Agents} they are illegal, and are not<br />

legally entitled to earn commission.<br />

ESTATE AGENTS MANDATES<br />

It is an estate agent’s sole mandate agreement binding if it is signed by only one spouse married in<br />

community of property? This is the question that was fi nally decided by the Western Cape High Court on<br />

Tuesday, 21 August <strong>2018</strong> in the matter of Blue Platinum Ventures 43 (Pty) Ltd v S & L Mesecke<br />

(Case No A 175/18).<br />

In this matter Mr Mesecke had signed a sole mandate in favour of XXX Properties at a time when he was<br />

getting divorced from his wife, to whom he was married in community of property. His wife did not sign the<br />

mandate. XXX Properties introduced a willing and able purchaser during the period of the mandate for the full<br />

asking price, but the offer was not accepted. The property was then sold to a purchaser introduced by another<br />

agency. XXX Properties sued for commission.<br />

Mesecke’s attorneys argued as follows:<br />

• In terms of the Matrimonial Property Act, a spouse married in community of property, acting alone, can<br />

not bind the joint estate to any contract in terms of which immovable property forming part of the joint<br />

estate is sold or “alienated”. For such a contract to be binding, the written consent of the other spouse<br />

is also required.<br />

• The granting of a sole mandate to an agent to market the property is an act so inextricably linked to the<br />

ultimate sale or “alienation” of the property that it should be included under the banner of contracts<br />

requiring the consent of both spouses.<br />

• Because Mrs Mesecke did not sign the mandate agreement, it was not enforceable against the joint<br />

estate.<br />

In deciding the matter, the judge noted that the section of the Matrimonial Property Act that Mesecke’s<br />

attorneys relied on, prohibited acts by spouses acting alone, which resulted in their joint estate losing real<br />

rights, such as property rights. He noted that the contract of mandate conferred only personal rights upon the<br />

parties, i.e the right to compel performance and the right to receive payment. In terms of the mandate, the<br />

estate agent was never given the power to conclude the sale agreement on behalf of the sellers.<br />

He accordingly made a clear distinction between the estate agent’s mandate and the deed of sale that might<br />

have resulted. He therefore found in favour of XXX Properties and held that the mandate was valid and<br />

enforceable against Mr and Mrs Mesecke. XXX Properties were therefore entitled to be paid their commission.<br />
