Background<br />
• Zoning Text Amendment (ZTA) was initiated by<br />
the BOS on May 3, 2017<br />
• A series of public input meetings have been<br />
held since September 2017 with both the PC<br />
and the Board<br />
• The most recent was on November 14, at which<br />
the Board discussed a variety of considerations<br />
for the ZTA
Current Zoning Regulations<br />
Accessory Tourist Lodging (ATL) in DA and Bed & Breakfast (BNB) in the RA<br />
What you can do<br />
• Rent up to 5 rooms<br />
inside a single family<br />
detached (SFD) structure<br />
• In DA, owner/tenant<br />
must reside in SFD<br />
• In RA, rental may be in<br />
accessory structures or<br />
SFD; owner or manager<br />
must reside on parcel,<br />
you may also have a<br />
second BNB<br />
What you can’t do<br />
• Rent without owner or<br />
manager present “whole<br />
house rental”<br />
• Rent rooms in a<br />
townhouse or apartment<br />
unit<br />
• Rent a detached<br />
structure in the DA<br />
• Have weddings or other<br />
special events w/o SP in<br />
RA

Residential and RA zoned lots less than 5 acres<br />
• Owner/operator of the parcel or a manager must<br />
reside on the parcel<br />
• Only permitted in a single-family detached dwelling<br />
• All parking is required to be off-street<br />
• No whole house rental<br />
• No more than 2 guest rooms are permitted<br />
• Use of accessory structure not allowed
Potential <strong>Homestay</strong> Regulations<br />
RA zoned lots 5 acres or larger<br />
• Owner/operator or a manager must reside on the parcel<br />
• Only permitted in a single-family detached dwelling<br />
• All parking is required to be off-street<br />
• Whole house rental permitted for a maximum of 45<br />
days/year<br />
• No more than 5 guest rooms are permitted<br />
• 125-foot setback from any abutting lot<br />
• Use of an accessory structure may be allowed<br />
• Use of second <strong>Homestay</strong> use, if zoning density allows
Rural Area <strong>Homestay</strong> Regulations<br />
All <strong>Homestay</strong>s<br />
• Operator required to register annually on short-term<br />
rental registry (§ 15.2-983)<br />
• Annual Safety Inspections<br />
• Possibility of special exception under certain criteria<br />
• The owner/operator of the parcel or a manager of the<br />
homestay shall reside on the parcel<br />
• Permitted in a single-family detached dwelling only<br />
• All parking is required to be off-street

Possible Special Exceptions<br />
A process where the Board of Supervisors may waive or<br />
modify certain homestay regulations in circumstances if<br />
there is a finding of no substantial detrimental impacts to<br />
adjoining properties, or adjoining properties that are under<br />
the same ownership.<br />
The following items may be varied by a special exception:<br />
1. Dwelling unit type. (<strong>Homestay</strong>s permitted in a singlefamily<br />
detached dwelling only)<br />
2. Increase number of guest rooms<br />
3. Reduce required 125 foot setback from any abutting lot<br />
4. Allow use of an accessory structure in the Residential<br />
Zoning districts
