Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean

On 4 March 2018, the Latin American and Caribbean region made history when it adopted the Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean, at Escazú, Costa Rica. The Regional Agreement is a ground-breaking legal instrument for environmental protection, but it is also a human rights treaty. Its main beneficiaries are the people of the Latin American and Caribbean region, particularly the most vulnerable groups and communities. It aims to ensure the right of all persons to have access to information in a timely and appropriate manner, to participate significantly in making the decisions that affect their lives and their environment, and to access justice when those rights have been infringed. The treaty recognizes the rights of all individuals, provides measures to facilitate their exercise and, most importantly, establishes mechanisms to render them effective.

Foreword<br />

In adopt<strong>in</strong>g <strong>the</strong> 2030 Agenda for Susta<strong>in</strong>able Development, <strong>the</strong><br />

Member States of <strong>the</strong> United Nati<strong>on</strong>s charted a path <strong>to</strong>wards<br />

greater dignity, prosperity <strong>and</strong> susta<strong>in</strong>ability for people <strong>and</strong> planet,<br />

<strong>and</strong> pledged <strong>to</strong> leave no <strong>on</strong>e beh<strong>in</strong>d.<br />

Lat<strong>in</strong> <strong>America</strong>n <strong>and</strong> <strong>Caribbean</strong> countries have played an<br />

important role <strong>in</strong> advanc<strong>in</strong>g this visi<strong>on</strong> through multilateral efforts<br />

that have resulted <strong>in</strong> <strong>the</strong> <strong>on</strong>ly legally b<strong>in</strong>d<strong>in</strong>g agreement stemm<strong>in</strong>g<br />

from <strong>the</strong> United Nati<strong>on</strong>s C<strong>on</strong>ference <strong>on</strong> Susta<strong>in</strong>able Development<br />

(Rio+20), <strong>the</strong> regi<strong>on</strong>’s first treaty <strong>on</strong> envir<strong>on</strong>mental matters <strong>and</strong><br />

<strong>the</strong> world’s first <strong>to</strong> <strong>in</strong>clude provisi<strong>on</strong>s <strong>on</strong> human rights defenders<br />

<strong>in</strong> envir<strong>on</strong>mental matters. Adopted at Escazú, Costa Rica, <strong>on</strong><br />

4 March 2018, <strong>and</strong> negotiated by States with <strong>the</strong> significant<br />

participati<strong>on</strong> of civil society <strong>and</strong> <strong>the</strong> wider public, <strong>the</strong> <str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>on</strong> <strong>Access</strong> <strong>to</strong> Informati<strong>on</strong>, <strong>Public</strong> Participati<strong>on</strong> <strong>and</strong><br />

<strong>Justice</strong> <strong>in</strong> Envir<strong>on</strong>mental <strong>Matters</strong> affirms <strong>the</strong> value of <strong>the</strong> regi<strong>on</strong>al<br />

dimensi<strong>on</strong> of multilateralism for susta<strong>in</strong>able development. By<br />

l<strong>in</strong>k<strong>in</strong>g global <strong>and</strong> nati<strong>on</strong>al frameworks, <strong>the</strong> agreement sets<br />

regi<strong>on</strong>al st<strong>and</strong>ards, fosters capacity build<strong>in</strong>g —particularly through<br />

South-South cooperati<strong>on</strong>— lays <strong>the</strong> foundati<strong>on</strong>s of a support<strong>in</strong>g<br />

<strong>in</strong>stituti<strong>on</strong>al architecture <strong>and</strong> offers <strong>to</strong>ols for improved policy- <strong>and</strong><br />

decisi<strong>on</strong>-mak<strong>in</strong>g.<br />

Above all, this treaty aims <strong>to</strong> combat <strong>in</strong>equality <strong>and</strong> discrim<strong>in</strong>ati<strong>on</strong><br />

<strong>and</strong> <strong>to</strong> guarantee <strong>the</strong> rights of every pers<strong>on</strong> <strong>to</strong> a healthy envir<strong>on</strong>ment<br />

<strong>and</strong> <strong>to</strong> susta<strong>in</strong>able development. In so do<strong>in</strong>g, it devotes particular<br />

attenti<strong>on</strong> <strong>to</strong> pers<strong>on</strong>s <strong>and</strong> groups <strong>in</strong> vulnerable situati<strong>on</strong>s, <strong>and</strong><br />

places equality at <strong>the</strong> core of susta<strong>in</strong>able development.<br />

In this year <strong>in</strong> which we commemorate <strong>the</strong> seventieth<br />

anniversary of <strong>the</strong> Ec<strong>on</strong>omic Commissi<strong>on</strong> for Lat<strong>in</strong> <strong>America</strong> <strong>and</strong><br />

<strong>the</strong> <strong>Caribbean</strong> <strong>and</strong> <strong>the</strong> Universal Declarati<strong>on</strong> of Human Rights,

as well as <strong>the</strong> twentieth anniversary of <strong>the</strong> Declarati<strong>on</strong> <strong>on</strong> Human<br />

Rights Defenders, this l<strong>and</strong>mark agreement has <strong>the</strong> potential<br />

<strong>to</strong> unlock structural change <strong>and</strong> address key challenges of our<br />

times. It is a powerful <strong>in</strong>strument <strong>to</strong> prevent c<strong>on</strong>flict, achieve<br />

<strong>in</strong>formed, participa<strong>to</strong>ry <strong>and</strong> <strong>in</strong>clusive decisi<strong>on</strong>-mak<strong>in</strong>g <strong>and</strong> deepen<br />

accountability, transparency <strong>and</strong> good governance.<br />

I commend <strong>the</strong> adopti<strong>on</strong> of <strong>the</strong> first agreement ever c<strong>on</strong>cluded<br />

under <strong>the</strong> auspices of <strong>the</strong> regi<strong>on</strong>al commissi<strong>on</strong>, <strong>and</strong> c<strong>on</strong>gratulate<br />

all who made it possible. It is now up <strong>to</strong> <strong>the</strong> countries of Lat<strong>in</strong><br />

his<strong>to</strong>ry when it adopted <strong>the</strong> <str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>on</strong> <strong>Access</strong> <strong>to</strong><br />

Informati<strong>on</strong>, <strong>Public</strong> Participati<strong>on</strong> <strong>and</strong> <strong>Justice</strong> <strong>in</strong> Envir<strong>on</strong>mental<br />

<strong>Matters</strong> <strong>in</strong> Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong>, at Escazú, Costa Rica.<br />

Initiated at <strong>the</strong> United Nati<strong>on</strong>s C<strong>on</strong>ference <strong>on</strong> Susta<strong>in</strong>able<br />

Development (Rio+20) <strong>and</strong> rooted <strong>in</strong> <strong>the</strong> tenets of Pr<strong>in</strong>ciple 10 of<br />

<strong>the</strong> 1992 Rio Declarati<strong>on</strong> <strong>on</strong> Envir<strong>on</strong>ment <strong>and</strong> Development, <strong>the</strong><br />

<str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> is <strong>the</strong> fruit of a two-year prepara<strong>to</strong>ry phase<br />

<strong>and</strong> n<strong>in</strong>e <strong>in</strong>tense meet<strong>in</strong>gs of its negotiat<strong>in</strong>g committee. Led by<br />

Chile <strong>and</strong> Costa Rica, as co-chairs, <strong>and</strong> five o<strong>the</strong>r Presid<strong>in</strong>g Officers<br />

(Argent<strong>in</strong>a, Mexico, Peru, Sa<strong>in</strong>t V<strong>in</strong>cent <strong>and</strong> <strong>the</strong> Grenad<strong>in</strong>es,<br />

<strong>and</strong> Tr<strong>in</strong>idad <strong>and</strong> Tobago), <strong>the</strong> negotiati<strong>on</strong>s brought <strong>to</strong>ge<strong>the</strong>r<br />

government delegates, representatives of <strong>the</strong> public, experts,<br />

academics <strong>and</strong> o<strong>the</strong>r <strong>in</strong>terested stakeholders who participated<br />

actively <strong>on</strong> a collaborative basis <strong>and</strong> an equal foot<strong>in</strong>g.<br />

The result of such an <strong>in</strong>novative process could not be more<br />

<strong>in</strong>spir<strong>in</strong>g. At a time of <strong>in</strong>creas<strong>in</strong>g uncerta<strong>in</strong>ty <strong>and</strong> profound ec<strong>on</strong>omic,<br />

social <strong>and</strong> envir<strong>on</strong>mental imbalances, <strong>and</strong> when multilateralism is<br />

under <strong>in</strong>tense scrut<strong>in</strong>y, Lat<strong>in</strong> <strong>America</strong>n <strong>and</strong> <strong>Caribbean</strong> countries<br />

dem<strong>on</strong>strated <strong>the</strong> value of regi<strong>on</strong>al acti<strong>on</strong>. To advance <strong>to</strong>wards<br />

greater envir<strong>on</strong>mental rights <strong>and</strong> protecti<strong>on</strong> at <strong>the</strong> local level,<br />

our countries decided <strong>to</strong> act <strong>in</strong> a regi<strong>on</strong>ally coord<strong>in</strong>ated manner,<br />

putt<strong>in</strong>g capacity-build<strong>in</strong>g <strong>and</strong> cooperati<strong>on</strong> at <strong>the</strong> service of greater<br />

collective goods <strong>and</strong> <strong>in</strong>terests.<br />

The <str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> is a ground-break<strong>in</strong>g legal <strong>in</strong>strument<br />

<strong>to</strong> facilitate <strong>the</strong>ir exercise <strong>and</strong>, most importantly, establishes<br />

mechanisms <strong>to</strong> render <strong>the</strong>m effective.<br />

Visi<strong>on</strong>ary <strong>and</strong> unprecedented, it is an agreement reached<br />

by <strong>and</strong> for Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong>, reflect<strong>in</strong>g <strong>the</strong><br />

ambiti<strong>on</strong>, priorities <strong>and</strong> particularities of our regi<strong>on</strong>. It addresses<br />

key aspects of envir<strong>on</strong>mental management <strong>and</strong> protecti<strong>on</strong> from<br />

a regi<strong>on</strong>al perspective, regulat<strong>in</strong>g access rights <strong>to</strong> <strong>in</strong>formati<strong>on</strong>,<br />

public participati<strong>on</strong> <strong>and</strong> justice <strong>in</strong> matters as important as <strong>the</strong><br />

susta<strong>in</strong>able use of natural resources, biodiversity c<strong>on</strong>servati<strong>on</strong>,<br />

<strong>the</strong> fight aga<strong>in</strong>st l<strong>and</strong> degradati<strong>on</strong> <strong>and</strong> climate change, <strong>and</strong><br />

build<strong>in</strong>g resilience <strong>to</strong> disasters. It also <strong>in</strong>cludes <strong>the</strong> world’s first<br />

b<strong>in</strong>d<strong>in</strong>g provisi<strong>on</strong> <strong>on</strong> human rights defenders <strong>in</strong> envir<strong>on</strong>mental<br />

matters <strong>in</strong> a regi<strong>on</strong> where sadly <strong>the</strong>y are all <strong>to</strong>o often subject <strong>to</strong><br />

attacks <strong>and</strong> <strong>in</strong>timidati<strong>on</strong>.<br />

From a rights-based approach, <strong>the</strong> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> recognizes<br />

core democratic pr<strong>in</strong>ciples <strong>and</strong> seeks <strong>to</strong> address <strong>the</strong> regi<strong>on</strong>’s<br />

most important challenges, namely <strong>the</strong> scourge of <strong>in</strong>equality<br />

<strong>and</strong> a deep-rooted culture of privilege. Through transparency,<br />

openness <strong>and</strong> participati<strong>on</strong>, <strong>the</strong> <str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> c<strong>on</strong>tributes<br />

<strong>to</strong> <strong>the</strong> shift <strong>to</strong>wards a new development model <strong>and</strong> tackles <strong>the</strong><br />

regi<strong>on</strong>’s <strong>in</strong>efficient <strong>and</strong> unsusta<strong>in</strong>able culture of narrow, fragmented<br />

<strong>in</strong>terests. In that ve<strong>in</strong>, <strong>the</strong> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> vows <strong>to</strong> <strong>in</strong>clude those that<br />

have traditi<strong>on</strong>ally been underrepresented, excluded or marg<strong>in</strong>alized<br />

<strong>and</strong> give a voice <strong>to</strong> <strong>the</strong> voiceless, leav<strong>in</strong>g no <strong>on</strong>e beh<strong>in</strong>d.<br />

With this <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, our regi<strong>on</strong> is also sett<strong>in</strong>g a sh<strong>in</strong><strong>in</strong>g<br />

example of how <strong>to</strong> balance <strong>the</strong> three dimensi<strong>on</strong>s of susta<strong>in</strong>able<br />

development. By engag<strong>in</strong>g <strong>the</strong> public <strong>in</strong> all decisi<strong>on</strong>s that affect<br />

<strong>the</strong>m <strong>and</strong> establish<strong>in</strong>g a new relati<strong>on</strong>ship between <strong>the</strong> State, <strong>the</strong><br />

market <strong>and</strong> society, our countries are refut<strong>in</strong>g <strong>the</strong> false dicho<strong>to</strong>my<br />

between envir<strong>on</strong>mental protecti<strong>on</strong> <strong>and</strong> ec<strong>on</strong>omic development.<br />

Growth cannot take place at <strong>the</strong> expense of <strong>the</strong> envir<strong>on</strong>ment <strong>and</strong>


<str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>on</strong> <strong>Access</strong> <strong>to</strong> Informati<strong>on</strong>...<br />

<strong>the</strong> envir<strong>on</strong>ment cannot be managed if our ec<strong>on</strong>omies <strong>and</strong> peoples<br />

are ignored. Legal certa<strong>in</strong>ty <strong>and</strong> trust <strong>in</strong> public <strong>in</strong>stituti<strong>on</strong>s are<br />

also crucial <strong>to</strong> susta<strong>in</strong>able development. Such <strong>in</strong>terl<strong>in</strong>kage <strong>and</strong><br />

<strong>in</strong>terdependence, recognized <strong>in</strong> <strong>the</strong> <str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, makes<br />

<strong>the</strong> first regi<strong>on</strong>al treaty of ECLAC an <strong>in</strong>valuable <strong>to</strong>ol for achiev<strong>in</strong>g<br />

<strong>the</strong> 2030 Agenda for Susta<strong>in</strong>able Development.<br />

The str<strong>on</strong>g regi<strong>on</strong>al commitment <strong>to</strong> envir<strong>on</strong>mental protecti<strong>on</strong><br />

<strong>and</strong> human rights is expected <strong>to</strong> lead <strong>to</strong> <strong>the</strong> <str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>’s<br />

prompt entry <strong>in</strong><strong>to</strong> force. By jo<strong>in</strong><strong>in</strong>g this l<strong>and</strong>mark treaty, <strong>the</strong> 33<br />

countries of Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong> will not <strong>on</strong>ly c<strong>on</strong>t<strong>in</strong>ue<br />

<strong>to</strong> streng<strong>the</strong>n envir<strong>on</strong>mental democracy, but will also move a step<br />

closer <strong>to</strong>wards mak<strong>in</strong>g equality, sound ec<strong>on</strong>omic growth <strong>and</strong><br />

susta<strong>in</strong>able development for all a reality.<br />

The Parties <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>,<br />

Recall<strong>in</strong>g <strong>the</strong> adopti<strong>on</strong>, at <strong>the</strong> United Nati<strong>on</strong>s C<strong>on</strong>ference<br />

<strong>on</strong> Susta<strong>in</strong>able Development, held <strong>in</strong> Rio de Janeiro, Brazil,<br />

<strong>in</strong> 2012, of <strong>the</strong> Declarati<strong>on</strong> <strong>on</strong> <strong>the</strong> applicati<strong>on</strong> of Pr<strong>in</strong>ciple 10 of <strong>the</strong><br />

Rio Declarati<strong>on</strong>, reaffirm<strong>in</strong>g <strong>the</strong> commitment <strong>to</strong> <strong>the</strong> rights of access<br />

<strong>to</strong> <strong>in</strong>formati<strong>on</strong>, participati<strong>on</strong> <strong>and</strong> justice regard<strong>in</strong>g envir<strong>on</strong>mental<br />

issues, recogniz<strong>in</strong>g <strong>the</strong> need <strong>to</strong> make commitments <strong>to</strong> ensure<br />

proper fulfilment of those rights <strong>and</strong> declar<strong>in</strong>g a will<strong>in</strong>gness<br />

<strong>to</strong> launch a process for explor<strong>in</strong>g <strong>the</strong> feasibility of adopt<strong>in</strong>g a<br />

regi<strong>on</strong>al <strong>in</strong>strument,<br />

Reaffirm<strong>in</strong>g Pr<strong>in</strong>ciple 10 of <strong>the</strong> 1992 Rio Declarati<strong>on</strong> <strong>on</strong><br />

Envir<strong>on</strong>ment <strong>and</strong> Development, which establishes <strong>the</strong> follow<strong>in</strong>g:<br />

“Envir<strong>on</strong>mental issues are best h<strong>and</strong>led with participati<strong>on</strong> of all<br />

c<strong>on</strong>cerned citizens, at <strong>the</strong> relevant level. At <strong>the</strong> nati<strong>on</strong>al level,<br />

each <strong>in</strong>dividual shall have appropriate access <strong>to</strong> <strong>in</strong>formati<strong>on</strong><br />

c<strong>on</strong>cern<strong>in</strong>g <strong>the</strong> envir<strong>on</strong>ment that is held by public authorities,<br />

<strong>in</strong>clud<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> <strong>on</strong> hazardous materials <strong>and</strong> activities <strong>in</strong> <strong>the</strong>ir<br />

communities, <strong>and</strong> <strong>the</strong> opportunity <strong>to</strong> participate <strong>in</strong> decisi<strong>on</strong>-mak<strong>in</strong>g<br />

processes. States shall facilitate <strong>and</strong> encourage public awareness<br />

<strong>and</strong> participati<strong>on</strong> by mak<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> widely available. Effective<br />

access <strong>to</strong> judicial <strong>and</strong> adm<strong>in</strong>istrative proceed<strong>in</strong>gs, <strong>in</strong>clud<strong>in</strong>g<br />

redress <strong>and</strong> remedy, shall be provided”,

Emphasiz<strong>in</strong>g that access rights are <strong>in</strong>terrelated <strong>and</strong><br />

<strong>in</strong>terdependent, <strong>and</strong> so each <strong>and</strong> every <strong>on</strong>e of <strong>the</strong>m should be<br />

promoted <strong>and</strong> implemented <strong>in</strong> an <strong>in</strong>tegrated <strong>and</strong> balanced manner,<br />

C<strong>on</strong>v<strong>in</strong>ced that access rights c<strong>on</strong>tribute <strong>to</strong> <strong>the</strong> streng<strong>the</strong>n<strong>in</strong>g of,<br />

<strong>in</strong>ter alia, democracy, susta<strong>in</strong>able development <strong>and</strong> human rights,<br />

Reaffirm<strong>in</strong>g <strong>the</strong> importance of <strong>the</strong> Universal Declarati<strong>on</strong> of<br />

Human Rights <strong>and</strong> recall<strong>in</strong>g o<strong>the</strong>r <strong>in</strong>ternati<strong>on</strong>al human rights<br />

<strong>in</strong>struments that underscore that all States have <strong>the</strong> resp<strong>on</strong>sibility<br />

Heads of State <strong>and</strong> Government <strong>and</strong> high-level representatives<br />

acknowledged that democracy, good governance <strong>and</strong> <strong>the</strong> rule of<br />

law, at <strong>the</strong> nati<strong>on</strong>al <strong>and</strong> <strong>in</strong>ternati<strong>on</strong>al levels, as well as an enabl<strong>in</strong>g<br />

envir<strong>on</strong>ment, were essential for susta<strong>in</strong>able development, <strong>in</strong>clud<strong>in</strong>g<br />

susta<strong>in</strong>ed <strong>and</strong> <strong>in</strong>clusive ec<strong>on</strong>omic growth, social development,

underscored that broad public participati<strong>on</strong> <strong>and</strong> access <strong>to</strong> <strong>in</strong>formati<strong>on</strong><br />

<strong>and</strong> judicial <strong>and</strong> adm<strong>in</strong>istrative proceed<strong>in</strong>gs were essential <strong>to</strong> <strong>the</strong><br />

promoti<strong>on</strong> of susta<strong>in</strong>able development; <strong>and</strong> encouraged acti<strong>on</strong><br />

at <strong>the</strong> regi<strong>on</strong>al, nati<strong>on</strong>al, subnati<strong>on</strong>al <strong>and</strong> local levels <strong>to</strong> promote<br />

access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>, public participati<strong>on</strong> <strong>in</strong> <strong>the</strong><br />

envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g process <strong>and</strong> access <strong>to</strong> justice <strong>in</strong><br />

envir<strong>on</strong>mental matters, as appropriate,<br />

C<strong>on</strong>sider<strong>in</strong>g United Nati<strong>on</strong>s General Assembly resoluti<strong>on</strong> 70/1<br />

of 25 September 2015, entitled “Transform<strong>in</strong>g our world: <strong>the</strong><br />

2030 Agenda for Susta<strong>in</strong>able Development”, by which it adopted<br />

a comprehensive, far-reach<strong>in</strong>g <strong>and</strong> people-centred set of universal<br />

<strong>and</strong> transformative Susta<strong>in</strong>able Development Goals <strong>and</strong> targets, <strong>and</strong><br />

reaffirmed its commitment <strong>to</strong> achiev<strong>in</strong>g susta<strong>in</strong>able development<br />

<strong>in</strong> its three dimensi<strong>on</strong>s —ec<strong>on</strong>omic, social <strong>and</strong> envir<strong>on</strong>mental— <strong>in</strong><br />

a balanced <strong>and</strong> <strong>in</strong>tegrated manner,<br />

Recogniz<strong>in</strong>g <strong>the</strong> multiculturalism of Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong><br />

<strong>Caribbean</strong> <strong>and</strong> of <strong>the</strong>ir peoples,<br />

Recogniz<strong>in</strong>g also <strong>the</strong> important work of <strong>the</strong> public <strong>and</strong> of<br />

human rights defenders <strong>in</strong> envir<strong>on</strong>mental matters for streng<strong>the</strong>n<strong>in</strong>g<br />

democracy, access rights <strong>and</strong> susta<strong>in</strong>able development <strong>and</strong> <strong>the</strong>ir<br />

fundamental c<strong>on</strong>tributi<strong>on</strong>s <strong>in</strong> this regard,<br />

Aware of <strong>the</strong> progress made <strong>in</strong> <strong>in</strong>ternati<strong>on</strong>al <strong>and</strong> regi<strong>on</strong>al<br />

agreements, <strong>in</strong> domestic legislati<strong>on</strong> <strong>and</strong> practice <strong>on</strong> rights of<br />

access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>, public participati<strong>on</strong> <strong>in</strong> <strong>the</strong><br />

envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g process <strong>and</strong> access <strong>to</strong> justice <strong>in</strong><br />

envir<strong>on</strong>mental matters,<br />

C<strong>on</strong>v<strong>in</strong>ced of <strong>the</strong> need <strong>to</strong> promote <strong>and</strong> streng<strong>the</strong>n dialogue,<br />

cooperati<strong>on</strong>, technical assistance, educati<strong>on</strong> <strong>and</strong> awareness-rais<strong>in</strong>g<br />

creati<strong>on</strong> <strong>and</strong> streng<strong>the</strong>n<strong>in</strong>g of capacities <strong>and</strong> cooperati<strong>on</strong>,

Have agreed as follows:<br />

Article 1<br />

Objective<br />

The objective of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> is <strong>to</strong> guarantee <strong>the</strong> full <strong>and</strong><br />

effective implementati<strong>on</strong> <strong>in</strong> Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong> of <strong>the</strong><br />

rights of access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>, public participati<strong>on</strong> <strong>in</strong><br />

<strong>the</strong> envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g process <strong>and</strong> access <strong>to</strong> justice<br />

<strong>in</strong> envir<strong>on</strong>mental matters, <strong>and</strong> <strong>the</strong> creati<strong>on</strong> <strong>and</strong> streng<strong>the</strong>n<strong>in</strong>g of<br />

capacities <strong>and</strong> cooperati<strong>on</strong>, c<strong>on</strong>tribut<strong>in</strong>g <strong>to</strong> <strong>the</strong> protecti<strong>on</strong> of <strong>the</strong><br />

right of every pers<strong>on</strong> of present <strong>and</strong> future generati<strong>on</strong>s <strong>to</strong> live <strong>in</strong><br />

a healthy envir<strong>on</strong>ment <strong>and</strong> <strong>to</strong> susta<strong>in</strong>able development.<br />

Article 2<br />

Def<strong>in</strong>iti<strong>on</strong>s<br />

For <strong>the</strong> purposes of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>:<br />

(a) “<strong>Access</strong> rights” means <strong>the</strong> right of access <strong>to</strong> envir<strong>on</strong>mental<br />

<strong>in</strong>formati<strong>on</strong>, <strong>the</strong> right of public participati<strong>on</strong> <strong>in</strong> <strong>the</strong><br />

envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g process <strong>and</strong> <strong>the</strong> right of<br />

access <strong>to</strong> justice <strong>in</strong> envir<strong>on</strong>mental matters;<br />

(b) “Competent authority” means, for <strong>the</strong> purposes of articles 5<br />

<strong>and</strong> 6 of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, any public body that<br />

exercises <strong>the</strong> powers, authority <strong>and</strong> functi<strong>on</strong>s for access<br />

<strong>to</strong> <strong>in</strong>formati<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>dependent <strong>and</strong> aut<strong>on</strong>omous<br />

bodies, organizati<strong>on</strong>s or entities owned or c<strong>on</strong>trolled by <strong>the</strong><br />

government, whe<strong>the</strong>r by virtue of powers granted by <strong>the</strong><br />

c<strong>on</strong>stituti<strong>on</strong> or o<strong>the</strong>r laws, <strong>and</strong>, when appropriate, private<br />

organizati<strong>on</strong>s that receive public funds or benefits (directly<br />

or <strong>in</strong>directly) or that perform public functi<strong>on</strong>s <strong>and</strong> services,<br />

but <strong>on</strong>ly with respect <strong>to</strong> <strong>the</strong> public funds or benefits received<br />

or <strong>to</strong> <strong>the</strong> public functi<strong>on</strong>s <strong>and</strong> services performed;<br />

(c) “Envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>” means any <strong>in</strong>formati<strong>on</strong> that is<br />

written, visual, audio, <strong>and</strong> electr<strong>on</strong>ic, or recorded <strong>in</strong> any<br />

o<strong>the</strong>r format, regard<strong>in</strong>g <strong>the</strong> envir<strong>on</strong>ment <strong>and</strong> its elements

<strong>and</strong> natural resources, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> related <strong>to</strong><br />

envir<strong>on</strong>mental risks, <strong>and</strong> any possible adverse impacts<br />

affect<strong>in</strong>g or likely <strong>to</strong> affect <strong>the</strong> envir<strong>on</strong>ment <strong>and</strong> health,<br />

as well as <strong>to</strong> envir<strong>on</strong>mental protecti<strong>on</strong> <strong>and</strong> management;<br />

(d) “<strong>Public</strong>” means <strong>on</strong>e or more natural or legal pers<strong>on</strong>s <strong>and</strong><br />

<strong>the</strong> associati<strong>on</strong>s, organizati<strong>on</strong>s or groups established by<br />

those pers<strong>on</strong>s, that are nati<strong>on</strong>als or that are subject <strong>to</strong><br />

<strong>the</strong> nati<strong>on</strong>al jurisdicti<strong>on</strong> of <strong>the</strong> State Party;<br />

(e) “Pers<strong>on</strong>s or groups <strong>in</strong> vulnerable situati<strong>on</strong>s” means those<br />

pers<strong>on</strong>s or groups that face particular difficulties <strong>in</strong> fully<br />

exercis<strong>in</strong>g <strong>the</strong> access rights recognized <strong>in</strong> <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, because of circumstances or c<strong>on</strong>diti<strong>on</strong>s<br />

identified with<strong>in</strong> each Party’s nati<strong>on</strong>al c<strong>on</strong>text <strong>and</strong> <strong>in</strong><br />

accordance with its <strong>in</strong>ternati<strong>on</strong>al obligati<strong>on</strong>s.<br />

Article 3<br />

Pr<strong>in</strong>ciples<br />

Each Party shall be guided by <strong>the</strong> follow<strong>in</strong>g pr<strong>in</strong>ciples <strong>in</strong><br />

implement<strong>in</strong>g <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>:<br />

(a) Pr<strong>in</strong>ciple of equality <strong>and</strong> pr<strong>in</strong>ciple of n<strong>on</strong>-discrim<strong>in</strong>ati<strong>on</strong>;<br />

(b) Pr<strong>in</strong>ciple of transparency <strong>and</strong> pr<strong>in</strong>ciple of accountability;<br />

(c) Pr<strong>in</strong>ciple of n<strong>on</strong>-regressi<strong>on</strong> <strong>and</strong> pr<strong>in</strong>ciple of progressive<br />

realizati<strong>on</strong>;<br />

(d) Pr<strong>in</strong>ciple of good faith;<br />

(e) Preventive pr<strong>in</strong>ciple;<br />

(f) Precauti<strong>on</strong>ary pr<strong>in</strong>ciple;<br />

(g) Pr<strong>in</strong>ciple of <strong>in</strong>tergenerati<strong>on</strong>al equity;<br />

(h) Pr<strong>in</strong>ciple of maximum disclosure;<br />

(i) Pr<strong>in</strong>ciple of permanent sovereignty of States over <strong>the</strong>ir<br />

natural resources;<br />

(j) Pr<strong>in</strong>ciple of sovereign equality of States; <strong>and</strong><br />

(k) Pr<strong>in</strong>ciple of pro pers<strong>on</strong>a.

1. Each Party shall guarantee <strong>the</strong> right of every pers<strong>on</strong> <strong>to</strong> live <strong>in</strong><br />

a healthy envir<strong>on</strong>ment <strong>and</strong> any o<strong>the</strong>r universally-recognized<br />

human right related <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

2. Each Party shall ensure that <strong>the</strong> rights recognized <strong>in</strong> <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> are freely exercised.<br />

3. Each Party shall adopt <strong>the</strong> necessary measures, of a legislative,<br />

regula<strong>to</strong>ry, adm<strong>in</strong>istrative or any o<strong>the</strong>r nature, <strong>in</strong> <strong>the</strong> framework<br />

of its domestic provisi<strong>on</strong>s, <strong>to</strong> guarantee <strong>the</strong> implementati<strong>on</strong><br />

of <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

4. With <strong>the</strong> aim of c<strong>on</strong>tribut<strong>in</strong>g <strong>to</strong> <strong>the</strong> effective applicati<strong>on</strong> of<br />

<strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, each Party shall provide <strong>the</strong> public<br />

with <strong>in</strong>formati<strong>on</strong> <strong>to</strong> facilitate <strong>the</strong> acquisiti<strong>on</strong> of knowledge <strong>on</strong><br />

access rights.<br />

5. Each Party shall ensure that guidance <strong>and</strong> assistance is<br />

provided <strong>to</strong> <strong>the</strong> public —particularly those pers<strong>on</strong>s or groups<br />

<strong>in</strong> vulnerable situati<strong>on</strong>s— <strong>in</strong> order <strong>to</strong> facilitate <strong>the</strong> exercise of<br />

<strong>the</strong>ir access rights.<br />

6. Each Party shall guarantee an enabl<strong>in</strong>g envir<strong>on</strong>ment for<br />

<strong>the</strong> work of pers<strong>on</strong>s, associati<strong>on</strong>s, organizati<strong>on</strong>s or groups<br />

that promote envir<strong>on</strong>mental protecti<strong>on</strong>, by recogniz<strong>in</strong>g <strong>and</strong><br />

protect<strong>in</strong>g <strong>the</strong>m.<br />

7. No provisi<strong>on</strong> <strong>in</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall limit or repeal o<strong>the</strong>r<br />

more favourable rights <strong>and</strong> guarantees set forth, at present or<br />

<strong>in</strong> <strong>the</strong> future, <strong>in</strong> <strong>the</strong> legislati<strong>on</strong> of a State Party or <strong>in</strong> any o<strong>the</strong>r<br />

<strong>in</strong>ternati<strong>on</strong>al agreement <strong>to</strong> which a State is party, or prevent<br />

a State Party from grant<strong>in</strong>g broader access <strong>to</strong> envir<strong>on</strong>mental<br />

<strong>in</strong>formati<strong>on</strong>, public participati<strong>on</strong> <strong>in</strong> <strong>the</strong> envir<strong>on</strong>mental decisi<strong>on</strong>mak<strong>in</strong>g<br />

process <strong>and</strong> justice <strong>in</strong> envir<strong>on</strong>mental matters.<br />

8. Each Party shall seek <strong>to</strong> adopt <strong>the</strong> most favourable <strong>in</strong>terpretati<strong>on</strong><br />

for <strong>the</strong> full enjoyment of <strong>and</strong> respect for <strong>the</strong> access rights<br />

when implement<strong>in</strong>g <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

9. For <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, each Party<br />

shall encourage <strong>the</strong> use of new <strong>in</strong>formati<strong>on</strong> <strong>and</strong> communicati<strong>on</strong>s

technologies, such as open data, <strong>in</strong> <strong>the</strong> different languages<br />

used <strong>in</strong> <strong>the</strong> country, as appropriate. In no circumstances shall<br />

<strong>the</strong> use of electr<strong>on</strong>ic media c<strong>on</strong>stra<strong>in</strong> or result <strong>in</strong> discrim<strong>in</strong>ati<strong>on</strong><br />

aga<strong>in</strong>st <strong>the</strong> public.<br />

10. The Parties may promote knowledge of <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>in</strong> o<strong>the</strong>r <strong>in</strong>ternati<strong>on</strong>al forums related <strong>to</strong> envir<strong>on</strong>mental<br />

matters, <strong>in</strong> accordance with <strong>the</strong> rules of each forum.<br />

Article 5<br />

<strong>Access</strong> <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

<strong>Access</strong>ibility of envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

1. Each Party shall ensure <strong>the</strong> public’s right of access <strong>to</strong><br />

envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> <strong>in</strong> its possessi<strong>on</strong>, c<strong>on</strong>trol or cus<strong>to</strong>dy,<br />

<strong>in</strong> accordance with <strong>the</strong> pr<strong>in</strong>ciple of maximum disclosure.<br />

2. The exercise of <strong>the</strong> right of access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

<strong>in</strong>cludes:<br />

(a) request<strong>in</strong>g <strong>and</strong> receiv<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> from competent<br />

authorities without menti<strong>on</strong><strong>in</strong>g any special <strong>in</strong>terest or<br />

expla<strong>in</strong><strong>in</strong>g <strong>the</strong> reas<strong>on</strong>s for <strong>the</strong> request;<br />

(b) be<strong>in</strong>g <strong>in</strong>formed promptly whe<strong>the</strong>r <strong>the</strong> requested <strong>in</strong>formati<strong>on</strong><br />

is <strong>in</strong> possessi<strong>on</strong> or not of <strong>the</strong> competent authority receiv<strong>in</strong>g<br />

<strong>the</strong> request; <strong>and</strong><br />

(c) be<strong>in</strong>g <strong>in</strong>formed of <strong>the</strong> right <strong>to</strong> challenge <strong>and</strong> appeal when<br />

<strong>in</strong>formati<strong>on</strong> is not delivered, <strong>and</strong> of <strong>the</strong> requirements for<br />

exercis<strong>in</strong>g this right.<br />

3. Each Party shall facilitate access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

for pers<strong>on</strong>s or groups <strong>in</strong> vulnerable situati<strong>on</strong>s, establish<strong>in</strong>g<br />

procedures for <strong>the</strong> provisi<strong>on</strong> of assistance, from <strong>the</strong> formulati<strong>on</strong><br />

of requests through <strong>to</strong> <strong>the</strong> delivery of <strong>the</strong> <strong>in</strong>formati<strong>on</strong>, tak<strong>in</strong>g<br />

<strong>in</strong><strong>to</strong> account <strong>the</strong>ir c<strong>on</strong>diti<strong>on</strong>s <strong>and</strong> specificities, for <strong>the</strong> purpose<br />

of promot<strong>in</strong>g access <strong>and</strong> participati<strong>on</strong> under equal c<strong>on</strong>diti<strong>on</strong>s.<br />

4. Each Party shall guarantee that <strong>the</strong> above-menti<strong>on</strong>ed pers<strong>on</strong>s<br />

or groups <strong>in</strong> vulnerable situati<strong>on</strong>s, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>digenous<br />

peoples <strong>and</strong> ethnic groups, receive assistance <strong>in</strong> prepar<strong>in</strong>g<br />

<strong>the</strong>ir requests <strong>and</strong> obta<strong>in</strong> a resp<strong>on</strong>se.

Refusal of access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

5. If <strong>the</strong> requested <strong>in</strong>formati<strong>on</strong> or part <strong>the</strong>reof is not delivered <strong>to</strong><br />

<strong>the</strong> applicant because it falls under <strong>the</strong> domestic legal regime<br />

of excepti<strong>on</strong>s, <strong>the</strong> competent authority shall communicate<br />

its refusal <strong>in</strong> writ<strong>in</strong>g, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> legal provisi<strong>on</strong>s <strong>and</strong> <strong>the</strong><br />

reas<strong>on</strong>s justify<strong>in</strong>g <strong>the</strong> decisi<strong>on</strong> <strong>in</strong> each case, <strong>and</strong> <strong>in</strong>form <strong>the</strong><br />

applicant of <strong>the</strong> right <strong>to</strong> challenge <strong>and</strong> appeal.<br />

6. <strong>Access</strong> <strong>to</strong> <strong>in</strong>formati<strong>on</strong> may be refused <strong>in</strong> accordance with<br />

domestic legislati<strong>on</strong>. In cases where a Party does not have<br />

a domestic legal regime of excepti<strong>on</strong>s, that Party may apply<br />

<strong>the</strong> follow<strong>in</strong>g excepti<strong>on</strong>s:<br />

(a) when disclosure would put at risk <strong>the</strong> life, safety or health<br />

of <strong>in</strong>dividuals;<br />

(b) when disclosure would adversely affect nati<strong>on</strong>al security,<br />

public safety or nati<strong>on</strong>al defence;<br />

(c) when disclosure would adversely affect <strong>the</strong> protecti<strong>on</strong> of<br />

<strong>the</strong> envir<strong>on</strong>ment, <strong>in</strong>clud<strong>in</strong>g any endangered or threatened<br />

species; or<br />

(d) when disclosure would create a clear, probable <strong>and</strong> specific<br />

risk of substantial harm <strong>to</strong> law enforcement, preventi<strong>on</strong>,<br />

<strong>in</strong>vestigati<strong>on</strong> <strong>and</strong> prosecuti<strong>on</strong> of crime.<br />

7. The excepti<strong>on</strong> regimes shall take <strong>in</strong><strong>to</strong> account each Party’s<br />

human rights obligati<strong>on</strong>s. Each Party shall encourage <strong>the</strong><br />

adopti<strong>on</strong> of excepti<strong>on</strong> regimes that favour <strong>the</strong> disclosure<br />

of <strong>in</strong>formati<strong>on</strong>.<br />

8. The reas<strong>on</strong>s for refusal shall be legally established <strong>in</strong> advance<br />

<strong>and</strong> be clearly def<strong>in</strong>ed <strong>and</strong> regulated, tak<strong>in</strong>g <strong>in</strong><strong>to</strong> account <strong>the</strong><br />

public <strong>in</strong>terest, <strong>and</strong> shall thus be <strong>in</strong>terpreted restrictively. The<br />

burden of proof will lie with <strong>the</strong> competent authority.<br />

9. When apply<strong>in</strong>g <strong>the</strong> public <strong>in</strong>terest test, <strong>the</strong> competent authorities<br />

shall weigh <strong>the</strong> <strong>in</strong>terest of withhold<strong>in</strong>g <strong>the</strong> <strong>in</strong>formati<strong>on</strong> aga<strong>in</strong>st<br />

<strong>the</strong> public benefit of disclos<strong>in</strong>g it, based <strong>on</strong> suitability, need<br />

<strong>and</strong> proporti<strong>on</strong>ality.

10. Where not all <strong>the</strong> <strong>in</strong>formati<strong>on</strong> c<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong> a document<br />

is exempt under paragraph 6 of <strong>the</strong> present article, <strong>the</strong><br />

n<strong>on</strong>-exempt <strong>in</strong>formati<strong>on</strong> shall be provided <strong>to</strong> <strong>the</strong> applicant.<br />

C<strong>on</strong>diti<strong>on</strong>s applicable <strong>to</strong> <strong>the</strong> delivery of envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

11. The competent authorities shall guarantee that <strong>the</strong> envir<strong>on</strong>mental<br />

<strong>in</strong>formati<strong>on</strong> is provided <strong>in</strong> <strong>the</strong> format requested by <strong>the</strong> applicant,<br />

if available. If such a format is not available, <strong>the</strong> envir<strong>on</strong>mental<br />

<strong>in</strong>formati<strong>on</strong> shall be provided <strong>in</strong> <strong>the</strong> available format.<br />

12. The competent authorities shall resp<strong>on</strong>d <strong>to</strong> requests for<br />

envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> as quickly as possible <strong>and</strong><br />

with<strong>in</strong> a period not l<strong>on</strong>ger than 30 bus<strong>in</strong>ess days from<br />

<strong>the</strong> date of receipt of <strong>the</strong> request, or less if so stipulated<br />

<strong>in</strong> domestic legislati<strong>on</strong>.<br />

13. Where, <strong>in</strong> excepti<strong>on</strong>al circumstances <strong>and</strong> <strong>in</strong> accordance with<br />

domestic legislati<strong>on</strong>, <strong>the</strong> competent authority requires more time<br />

<strong>to</strong> resp<strong>on</strong>d <strong>to</strong> <strong>the</strong> request, it shall notify <strong>the</strong> applicant <strong>in</strong> writ<strong>in</strong>g<br />

of <strong>the</strong> justificati<strong>on</strong> for <strong>the</strong> extensi<strong>on</strong> prior <strong>to</strong> <strong>the</strong> expirati<strong>on</strong> of<br />

<strong>the</strong> period established <strong>in</strong> paragraph 12 of <strong>the</strong> present article.<br />

Such an extensi<strong>on</strong> will not exceed 10 bus<strong>in</strong>ess days.<br />

14. In <strong>the</strong> event that <strong>the</strong> competent authority does not resp<strong>on</strong>d<br />

with<strong>in</strong> <strong>the</strong> periods established <strong>in</strong> paragraphs 12 <strong>and</strong> 13 of <strong>the</strong><br />

present article, paragraph 2 of article 8 shall apply.<br />

15. When <strong>the</strong> competent authority receiv<strong>in</strong>g <strong>the</strong> request does not<br />

have <strong>the</strong> requested <strong>in</strong>formati<strong>on</strong>, it shall notify <strong>the</strong> applicant as<br />

quickly as possible, <strong>in</strong>dicat<strong>in</strong>g, if it can determ<strong>in</strong>e it, which<br />

authority may be <strong>in</strong> possessi<strong>on</strong> of <strong>the</strong> <strong>in</strong>formati<strong>on</strong>. The request<br />

shall be forwarded <strong>to</strong> <strong>the</strong> relevant authority, <strong>and</strong> <strong>the</strong> applicant<br />

so <strong>in</strong>formed.<br />

16. When <strong>the</strong> requested <strong>in</strong>formati<strong>on</strong> does not exist or has not yet<br />

been generated, <strong>the</strong> applicant shall be so <strong>in</strong>formed, with<br />

explanati<strong>on</strong>, with<strong>in</strong> <strong>the</strong> periods established <strong>in</strong> paragraphs 12<br />

<strong>and</strong> 13 of <strong>the</strong> present article.<br />

17. Envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> shall be disclosed at no cost, <strong>in</strong>sofar<br />

as its reproducti<strong>on</strong> or delivery is not required. Reproducti<strong>on</strong><br />

<strong>and</strong> delivery costs shall be applied <strong>in</strong> accordance with <strong>the</strong>

procedures established by <strong>the</strong> competent authority. Such<br />

costs shall be reas<strong>on</strong>able <strong>and</strong> made known <strong>in</strong> advance,<br />

<strong>and</strong> payment can be waived <strong>in</strong> <strong>the</strong> event that <strong>the</strong> applicant<br />

is deemed <strong>to</strong> be <strong>in</strong> a vulnerable situati<strong>on</strong> or <strong>to</strong> have special<br />

circumstances warrant<strong>in</strong>g such a waiver.<br />

Independent oversight mechanisms<br />

18. Each Party shall establish or designate <strong>on</strong>e or more impartial<br />

entities or <strong>in</strong>stituti<strong>on</strong>s with aut<strong>on</strong>omy <strong>and</strong> <strong>in</strong>dependence <strong>to</strong><br />

promote transparency <strong>in</strong> access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>,<br />

<strong>to</strong> oversee compliance with rules, <strong>and</strong> m<strong>on</strong>i<strong>to</strong>r, report <strong>on</strong><br />

<strong>and</strong> guarantee <strong>the</strong> right of access <strong>to</strong> <strong>in</strong>formati<strong>on</strong>. Each Party<br />

may c<strong>on</strong>sider <strong>in</strong>clud<strong>in</strong>g or streng<strong>the</strong>n<strong>in</strong>g, as appropriate,<br />

sancti<strong>on</strong><strong>in</strong>g powers with<strong>in</strong> <strong>the</strong> scope of <strong>the</strong> resp<strong>on</strong>sibilities<br />

of <strong>the</strong> aforementi<strong>on</strong>ed entities or <strong>in</strong>stituti<strong>on</strong>s.<br />

Article 6<br />

Generati<strong>on</strong> <strong>and</strong> dissem<strong>in</strong>ati<strong>on</strong> of envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

1. Each Party shall guarantee, <strong>to</strong> <strong>the</strong> extent possible with<strong>in</strong> available<br />

resources, that <strong>the</strong> competent authorities generate, collect,<br />

publicize <strong>and</strong> dissem<strong>in</strong>ate envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> relevant<br />

<strong>to</strong> <strong>the</strong>ir functi<strong>on</strong>s <strong>in</strong> a systematic, proactive, timely, regular,<br />

accessible <strong>and</strong> comprehensible manner, <strong>and</strong> periodically<br />

update this <strong>in</strong>formati<strong>on</strong> <strong>and</strong> encourage <strong>the</strong> disaggregati<strong>on</strong><br />

<strong>and</strong> decentralizati<strong>on</strong> of envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> at <strong>the</strong><br />

subnati<strong>on</strong>al <strong>and</strong> local levels. Each Party shall streng<strong>the</strong>n<br />

coord<strong>in</strong>ati<strong>on</strong> between <strong>the</strong> different authorities of <strong>the</strong> State.<br />

2. The competent authorities shall endeavour <strong>to</strong> ensure, <strong>to</strong> <strong>the</strong><br />

extent possible, that envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> is reusable,<br />

processable <strong>and</strong> available <strong>in</strong> formats that are accessible, <strong>and</strong><br />

that no restricti<strong>on</strong>s are placed <strong>on</strong> its reproducti<strong>on</strong> or use, <strong>in</strong><br />

accordance with domestic legislati<strong>on</strong>.<br />

3. Each Party shall have <strong>in</strong> place <strong>on</strong>e or more up-<strong>to</strong>-date<br />

envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> systems, which may <strong>in</strong>clude, <strong>in</strong>ter alia:<br />

(a) <strong>the</strong> texts of treaties <strong>and</strong> <strong>in</strong>ternati<strong>on</strong>al agreements, as well<br />

as envir<strong>on</strong>mental laws, regulati<strong>on</strong>s <strong>and</strong> adm<strong>in</strong>istrative acts;

(b) reports <strong>on</strong> <strong>the</strong> state of <strong>the</strong> envir<strong>on</strong>ment;<br />

(c) a list of public entities competent <strong>in</strong> envir<strong>on</strong>mental matters<br />

<strong>and</strong>, where possible, <strong>the</strong>ir respective areas of operati<strong>on</strong>;<br />

(d) a list of polluted areas, by type of pollutant <strong>and</strong> locati<strong>on</strong>;<br />

(e) <strong>in</strong>formati<strong>on</strong> <strong>on</strong> <strong>the</strong> use <strong>and</strong> c<strong>on</strong>servati<strong>on</strong> of natural<br />

resources <strong>and</strong> ecosystem services;<br />

(f) scientific, technical or technological reports, studies<br />

<strong>and</strong> <strong>in</strong>formati<strong>on</strong> <strong>on</strong> envir<strong>on</strong>mental matters produced by<br />

academic <strong>and</strong> research <strong>in</strong>stituti<strong>on</strong>s, whe<strong>the</strong>r public or<br />

private, nati<strong>on</strong>al or foreign;<br />

(g) climate change sources aimed at build<strong>in</strong>g nati<strong>on</strong>al<br />

capacities;<br />

(h) <strong>in</strong>formati<strong>on</strong> <strong>on</strong> envir<strong>on</strong>mental impact assessment processes<br />

<strong>and</strong> <strong>on</strong> o<strong>the</strong>r envir<strong>on</strong>mental management <strong>in</strong>struments,<br />

where applicable, <strong>and</strong> envir<strong>on</strong>mental licences or permits<br />

granted by <strong>the</strong> public authorities;<br />

(i) an estimated list of waste by type <strong>and</strong>, when possible,<br />

by volume, locati<strong>on</strong> <strong>and</strong> year; <strong>and</strong><br />

(j) <strong>in</strong>formati<strong>on</strong> <strong>on</strong> <strong>the</strong> impositi<strong>on</strong> of adm<strong>in</strong>istrative sancti<strong>on</strong>s<br />

<strong>in</strong> envir<strong>on</strong>mental matters.<br />

Each Party shall guarantee that envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

systems are duly organized, accessible <strong>to</strong> all pers<strong>on</strong>s <strong>and</strong> made<br />

progressively available through <strong>in</strong>formati<strong>on</strong> technology <strong>and</strong><br />

georeferenced media, where appropriate.<br />

4. Each Party shall take steps <strong>to</strong> establish a pollutant release <strong>and</strong><br />

transfer register cover<strong>in</strong>g air, water, soil <strong>and</strong> subsoil pollutants,<br />

as well as materials <strong>and</strong> waste <strong>in</strong> its jurisdicti<strong>on</strong>. This register<br />

will be established progressively <strong>and</strong> updated periodically.<br />

5. Each Party shall guarantee that <strong>in</strong> <strong>the</strong> case of an imm<strong>in</strong>ent threat<br />

<strong>to</strong> public health or <strong>the</strong> envir<strong>on</strong>ment, <strong>the</strong> relevant competent<br />

authority shall immediately disclose <strong>and</strong> dissem<strong>in</strong>ate through <strong>the</strong><br />

most effective means all pert<strong>in</strong>ent <strong>in</strong>formati<strong>on</strong> <strong>in</strong> its possessi<strong>on</strong><br />

that could help <strong>the</strong> public take measures <strong>to</strong> prevent or limit

potential damage. Each Party shall develop <strong>and</strong> implement<br />

an early warn<strong>in</strong>g system us<strong>in</strong>g available mechanisms.<br />

6. In order <strong>to</strong> facilitate access by pers<strong>on</strong>s or groups <strong>in</strong> vulnerable<br />

situati<strong>on</strong>s <strong>to</strong> <strong>in</strong>formati<strong>on</strong> that particularly affects <strong>the</strong>m, each<br />

Party shall endeavour, where applicable, <strong>to</strong> ensure that <strong>the</strong><br />

competent authorities dissem<strong>in</strong>ate envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

<strong>in</strong> <strong>the</strong> various languages used <strong>in</strong> <strong>the</strong> country, <strong>and</strong> prepare<br />

alternative formats that are comprehensible <strong>to</strong> those groups,<br />

us<strong>in</strong>g suitable channels of communicati<strong>on</strong>.<br />

7. Each Party shall use its best endeavours <strong>to</strong> publish <strong>and</strong><br />

dissem<strong>in</strong>ate at regular <strong>in</strong>tervals, not exceed<strong>in</strong>g five years,<br />

a nati<strong>on</strong>al report <strong>on</strong> <strong>the</strong> state of <strong>the</strong> envir<strong>on</strong>ment, which<br />

may c<strong>on</strong>ta<strong>in</strong>:<br />

(a) <strong>in</strong>formati<strong>on</strong> <strong>on</strong> <strong>the</strong> state of <strong>the</strong> envir<strong>on</strong>ment <strong>and</strong> natural<br />

resources, <strong>in</strong>clud<strong>in</strong>g quantitative data, where possible;<br />

(b) nati<strong>on</strong>al acti<strong>on</strong>s <strong>to</strong> fulfil envir<strong>on</strong>mental legal obligati<strong>on</strong>s;<br />

(c) advances <strong>in</strong> <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> access rights; <strong>and</strong><br />

(d) collaborati<strong>on</strong> agreements am<strong>on</strong>g public, social <strong>and</strong><br />

private sec<strong>to</strong>rs.<br />

Such reports shall be drafted <strong>in</strong> an easily comprehensible<br />

manner <strong>and</strong> accessible <strong>to</strong> <strong>the</strong> public <strong>in</strong> different formats <strong>and</strong><br />

dissem<strong>in</strong>ated through appropriate means, tak<strong>in</strong>g <strong>in</strong><strong>to</strong> account<br />

cultural realities. Each Party may <strong>in</strong>vite <strong>the</strong> public <strong>to</strong> make<br />

c<strong>on</strong>tributi<strong>on</strong>s <strong>to</strong> <strong>the</strong>se reports.<br />

8. Each Party shall encourage <strong>in</strong>dependent envir<strong>on</strong>mental<br />

performance reviews that take <strong>in</strong><strong>to</strong> account nati<strong>on</strong>ally or<br />

<strong>in</strong>ternati<strong>on</strong>ally agreed criteria <strong>and</strong> guides <strong>and</strong> comm<strong>on</strong><br />

<strong>in</strong>dica<strong>to</strong>rs, with a view <strong>to</strong> evaluat<strong>in</strong>g <strong>the</strong> efficacy, effectiveness<br />

<strong>and</strong> progress of its nati<strong>on</strong>al envir<strong>on</strong>mental policies <strong>in</strong> fulfilment<br />

of <strong>the</strong>ir nati<strong>on</strong>al <strong>and</strong> <strong>in</strong>ternati<strong>on</strong>al commitments. The reviews<br />

shall <strong>in</strong>clude participati<strong>on</strong> by <strong>the</strong> various stakeholders.<br />

9. Each Party shall promote access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong><br />

c<strong>on</strong>ta<strong>in</strong>ed <strong>in</strong> c<strong>on</strong>cessi<strong>on</strong>s, c<strong>on</strong>tracts, agreements or<br />

authorizati<strong>on</strong>s granted, which <strong>in</strong>volve <strong>the</strong> use of public goods,<br />

services or resources, <strong>in</strong> accordance with domestic legislati<strong>on</strong>.

10. Each Party shall ensure that c<strong>on</strong>sumers <strong>and</strong> users have<br />

official, relevant <strong>and</strong> clear <strong>in</strong>formati<strong>on</strong> <strong>on</strong> <strong>the</strong> envir<strong>on</strong>mental<br />

qualities of goods <strong>and</strong> services <strong>and</strong> <strong>the</strong>ir effects <strong>on</strong> health,<br />

favour<strong>in</strong>g susta<strong>in</strong>able producti<strong>on</strong> <strong>and</strong> c<strong>on</strong>sumpti<strong>on</strong> patterns.<br />

11. Each Party shall create <strong>and</strong> keep regularly updated its<br />

archiv<strong>in</strong>g <strong>and</strong> document management systems <strong>in</strong> envir<strong>on</strong>mental<br />

matters <strong>in</strong> accordance with its applicable rules with <strong>the</strong> aim<br />

of facilitat<strong>in</strong>g access <strong>to</strong> <strong>in</strong>formati<strong>on</strong> at all times.<br />

12. Each Party shall take <strong>the</strong> necessary measures, through legal<br />

or adm<strong>in</strong>istrative frameworks, am<strong>on</strong>g o<strong>the</strong>rs, <strong>to</strong> promote<br />

access <strong>to</strong> envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong> <strong>in</strong> <strong>the</strong> possessi<strong>on</strong> of<br />

private entities, <strong>in</strong> particular <strong>in</strong>formati<strong>on</strong> <strong>on</strong> <strong>the</strong>ir operati<strong>on</strong>s<br />

<strong>and</strong> <strong>the</strong> possible risks <strong>and</strong> effects <strong>on</strong> human health <strong>and</strong> <strong>the</strong><br />

envir<strong>on</strong>ment.<br />

13. In accordance with its capacities, each Party shall encourage<br />

public <strong>and</strong> private companies, particularly large companies,<br />

<strong>to</strong> prepare susta<strong>in</strong>ability reports that reflect <strong>the</strong>ir social <strong>and</strong><br />

envir<strong>on</strong>mental performance.<br />

Article 7<br />

<strong>Public</strong> participati<strong>on</strong> <strong>in</strong> <strong>the</strong> envir<strong>on</strong>mental<br />

decisi<strong>on</strong>-mak<strong>in</strong>g process<br />

1. Each Party shall ensure <strong>the</strong> public’s right <strong>to</strong> participati<strong>on</strong> <strong>and</strong>,<br />

for that purpose, commits <strong>to</strong> implement open <strong>and</strong> <strong>in</strong>clusive<br />

participati<strong>on</strong> <strong>in</strong> envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g processes<br />

based <strong>on</strong> domestic <strong>and</strong> <strong>in</strong>ternati<strong>on</strong>al normative frameworks.<br />

2. Each Party shall guarantee mechanisms for <strong>the</strong> participati<strong>on</strong><br />

of <strong>the</strong> public <strong>in</strong> decisi<strong>on</strong>-mak<strong>in</strong>g processes, revisi<strong>on</strong>s, reexam<strong>in</strong>ati<strong>on</strong>s<br />

or updates with respect <strong>to</strong> projects <strong>and</strong> activities,<br />

<strong>and</strong> <strong>in</strong> o<strong>the</strong>r processes for grant<strong>in</strong>g envir<strong>on</strong>mental permits that<br />

have or may have a significant impact <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment,<br />

<strong>in</strong>clud<strong>in</strong>g when <strong>the</strong>y may affect health.<br />

3. Each Party shall promote <strong>the</strong> participati<strong>on</strong> of <strong>the</strong> public <strong>in</strong><br />

decisi<strong>on</strong>-mak<strong>in</strong>g processes, revisi<strong>on</strong>s, re-exam<strong>in</strong>ati<strong>on</strong>s or<br />

updates o<strong>the</strong>r than those referred <strong>to</strong> <strong>in</strong> paragraph 2 of <strong>the</strong><br />

present article with respect <strong>to</strong> envir<strong>on</strong>mental matters of public

<strong>in</strong>terest, such as l<strong>and</strong>-use plann<strong>in</strong>g, policies, strategies, plans,<br />

programmes, rules <strong>and</strong> regulati<strong>on</strong>s, which have or may have<br />

a significant impact <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment.<br />

4. Each Party shall adopt measures <strong>to</strong> ensure that <strong>the</strong> public<br />

can participate <strong>in</strong> <strong>the</strong> decisi<strong>on</strong>-mak<strong>in</strong>g process from <strong>the</strong><br />

early stages, so that due c<strong>on</strong>siderati<strong>on</strong> can be given <strong>to</strong> <strong>the</strong><br />

observati<strong>on</strong>s of <strong>the</strong> public, thus c<strong>on</strong>tribut<strong>in</strong>g <strong>to</strong> <strong>the</strong> process.<br />

To that effect, each Party shall provide <strong>the</strong> public with <strong>the</strong><br />

necessary <strong>in</strong>formati<strong>on</strong> <strong>in</strong> a clear, timely <strong>and</strong> comprehensive<br />

manner, <strong>to</strong> give effect <strong>to</strong> its right <strong>to</strong> participate <strong>in</strong> <strong>the</strong> decisi<strong>on</strong>mak<strong>in</strong>g<br />

process.<br />

5. The public participati<strong>on</strong> procedure will provide for reas<strong>on</strong>able<br />

timeframes that allow sufficient time <strong>to</strong> <strong>in</strong>form <strong>the</strong> public <strong>and</strong><br />

for its effective participati<strong>on</strong>.<br />

6. The public shall be <strong>in</strong>formed, through appropriate means,<br />

such as <strong>in</strong> writ<strong>in</strong>g, electr<strong>on</strong>ically, orally <strong>and</strong> by cus<strong>to</strong>mary<br />

methods, <strong>and</strong> <strong>in</strong> an effective, comprehensible <strong>and</strong> timely<br />

manner, as a m<strong>in</strong>imum, of <strong>the</strong> follow<strong>in</strong>g:<br />

(a) <strong>the</strong> type or nature of <strong>the</strong> envir<strong>on</strong>mental decisi<strong>on</strong> under<br />

c<strong>on</strong>siderati<strong>on</strong> <strong>and</strong>, where appropriate, <strong>in</strong> n<strong>on</strong>-technical<br />

language;<br />

(b) <strong>the</strong> authority resp<strong>on</strong>sible for mak<strong>in</strong>g <strong>the</strong> decisi<strong>on</strong> <strong>and</strong><br />

o<strong>the</strong>r authorities <strong>and</strong> bodies <strong>in</strong>volved;<br />

(c) <strong>the</strong> procedure foreseen for <strong>the</strong> participati<strong>on</strong> of <strong>the</strong><br />

public, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> date <strong>on</strong> which <strong>the</strong> procedure will<br />

beg<strong>in</strong> <strong>and</strong> end, mechanisms for participati<strong>on</strong> <strong>and</strong>, where<br />

applicable, <strong>the</strong> date <strong>and</strong> place of any public c<strong>on</strong>sultati<strong>on</strong><br />

or hear<strong>in</strong>g; <strong>and</strong><br />

(d) <strong>the</strong> public authorities <strong>in</strong>volved from which additi<strong>on</strong>al<br />

<strong>in</strong>formati<strong>on</strong> <strong>on</strong> <strong>the</strong> envir<strong>on</strong>mental decisi<strong>on</strong> under<br />

c<strong>on</strong>siderati<strong>on</strong> can be requested <strong>and</strong> <strong>the</strong> procedure for<br />

request<strong>in</strong>g <strong>in</strong>formati<strong>on</strong>.<br />

7. The public’s right <strong>to</strong> participate <strong>in</strong> envir<strong>on</strong>mental decisi<strong>on</strong>mak<strong>in</strong>g<br />

processes shall <strong>in</strong>clude <strong>the</strong> opportunity <strong>to</strong> present<br />

observati<strong>on</strong>s through appropriate means available, accord<strong>in</strong>g <strong>to</strong>


<str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>on</strong> <strong>Access</strong> <strong>to</strong> Informati<strong>on</strong>...<br />

<strong>the</strong> circumstances of <strong>the</strong> process. Before adopt<strong>in</strong>g <strong>the</strong> decisi<strong>on</strong>,<br />

<strong>the</strong> relevant public authority shall give due c<strong>on</strong>siderati<strong>on</strong> <strong>to</strong><br />

<strong>the</strong> outcome of <strong>the</strong> participati<strong>on</strong> process.<br />

8. Each Party shall ensure that, <strong>on</strong>ce a decisi<strong>on</strong> has been made,<br />

<strong>the</strong> public is <strong>in</strong>formed <strong>in</strong> a timely manner <strong>the</strong>reof <strong>and</strong> of <strong>the</strong><br />

grounds <strong>and</strong> reas<strong>on</strong>s underly<strong>in</strong>g <strong>the</strong> decisi<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g<br />

how <strong>the</strong> observati<strong>on</strong>s of <strong>the</strong> public have been taken <strong>in</strong><strong>to</strong><br />

c<strong>on</strong>siderati<strong>on</strong>. The decisi<strong>on</strong> <strong>and</strong> its basis shall be made<br />

public <strong>and</strong> be accessible.<br />

9. The dissem<strong>in</strong>ati<strong>on</strong> of <strong>the</strong> decisi<strong>on</strong>s result<strong>in</strong>g from envir<strong>on</strong>mental<br />

impact assessments <strong>and</strong> o<strong>the</strong>r envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g<br />

processes <strong>in</strong> which <strong>the</strong> public has participated shall be<br />

carried out through appropriate means, which may <strong>in</strong>clude<br />

written, electr<strong>on</strong>ic or oral means <strong>and</strong> cus<strong>to</strong>mary methods, <strong>in</strong><br />

an effective <strong>and</strong> prompt manner. The <strong>in</strong>formati<strong>on</strong> dissem<strong>in</strong>ated<br />

shall <strong>in</strong>clude <strong>the</strong> established procedure <strong>to</strong> allow <strong>the</strong> public <strong>to</strong><br />

take <strong>the</strong> relevant adm<strong>in</strong>istrative <strong>and</strong> judicial acti<strong>on</strong>s.<br />

10. Each Party shall establish c<strong>on</strong>diti<strong>on</strong>s that are favourable<br />

<strong>to</strong> public participati<strong>on</strong> <strong>in</strong> envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g<br />

processes <strong>and</strong> that are adapted <strong>to</strong> <strong>the</strong> social, ec<strong>on</strong>omic,<br />

cultural, geographical <strong>and</strong> gender characteristics of <strong>the</strong> public.<br />

11. When <strong>the</strong> primary language of <strong>the</strong> directly affected public is<br />

different <strong>to</strong> <strong>the</strong> official languages, <strong>the</strong> public authority shall<br />

ensure that means are provided <strong>to</strong> facilitate <strong>the</strong>ir underst<strong>and</strong><strong>in</strong>g<br />

<strong>and</strong> participati<strong>on</strong>.<br />

12. Each Party shall promote, where appropriate <strong>and</strong> <strong>in</strong> accordance<br />

with domestic legislati<strong>on</strong>, public participati<strong>on</strong> <strong>in</strong> <strong>in</strong>ternati<strong>on</strong>al<br />

forums <strong>and</strong> negotiati<strong>on</strong>s <strong>on</strong> envir<strong>on</strong>mental matters or with an<br />

envir<strong>on</strong>mental impact, <strong>in</strong> accordance with <strong>the</strong> procedural rules<br />

<strong>on</strong> participati<strong>on</strong> of each forum. The participati<strong>on</strong> of <strong>the</strong> public<br />

at <strong>the</strong> nati<strong>on</strong>al level <strong>on</strong> matters of <strong>in</strong>ternati<strong>on</strong>al envir<strong>on</strong>mental<br />

forums shall also be promoted, where appropriate.<br />

13. Each Party shall encourage <strong>the</strong> establishment of appropriate<br />

spaces for c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong> envir<strong>on</strong>mental matters or <strong>the</strong> use<br />

of those that are already <strong>in</strong> existence <strong>in</strong> which various groups<br />

<strong>and</strong> sec<strong>to</strong>rs are able <strong>to</strong> participate. Each Party shall promote

regard for local knowledge, dialogue <strong>and</strong> <strong>in</strong>teracti<strong>on</strong> of different<br />

views <strong>and</strong> knowledge, where appropriate.<br />

14. The public authorities shall make efforts <strong>to</strong> identify <strong>and</strong><br />

support pers<strong>on</strong>s or groups <strong>in</strong> vulnerable situati<strong>on</strong>s <strong>in</strong> order<br />

<strong>to</strong> engage <strong>the</strong>m <strong>in</strong> an active, timely <strong>and</strong> effective manner <strong>in</strong><br />

participati<strong>on</strong> mechanisms. For <strong>the</strong>se purposes, appropriate<br />

means <strong>and</strong> formats will be c<strong>on</strong>sidered, <strong>in</strong> order <strong>to</strong> elim<strong>in</strong>ate<br />

barriers <strong>to</strong> participati<strong>on</strong>.<br />

15. In <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, each Party<br />

shall guarantee that its domestic legislati<strong>on</strong> <strong>and</strong> <strong>in</strong>ternati<strong>on</strong>al<br />

obligati<strong>on</strong>s <strong>in</strong> relati<strong>on</strong> <strong>to</strong> <strong>the</strong> rights of <strong>in</strong>digenous peoples <strong>and</strong><br />

local communities are observed.<br />

16. The public authority shall make efforts <strong>to</strong> identify <strong>the</strong> public<br />

directly affected by <strong>the</strong> projects or activities that have or may<br />

have a significant impact <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment <strong>and</strong> shall promote<br />

specific acti<strong>on</strong>s <strong>to</strong> facilitate <strong>the</strong>ir participati<strong>on</strong>.<br />

17. With respect <strong>to</strong> <strong>the</strong> envir<strong>on</strong>mental decisi<strong>on</strong>-mak<strong>in</strong>g processes<br />

referred <strong>to</strong> <strong>in</strong> paragraph 2 of <strong>the</strong> present article, as a m<strong>in</strong>imum,<br />

<strong>the</strong> follow<strong>in</strong>g <strong>in</strong>formati<strong>on</strong> shall be made public:<br />

(a) a descripti<strong>on</strong> of <strong>the</strong> area of <strong>in</strong>fluence <strong>and</strong> physical <strong>and</strong><br />

technical characteristics of <strong>the</strong> proposed project or activity;<br />

(b) a descripti<strong>on</strong> of <strong>the</strong> ma<strong>in</strong> envir<strong>on</strong>mental impacts of <strong>the</strong><br />

project or activity <strong>and</strong>, as appropriate, <strong>the</strong> cumulative<br />

envir<strong>on</strong>mental impact;<br />

(c) a descripti<strong>on</strong> of <strong>the</strong> measures foreseen with respect <strong>to</strong><br />

those impacts;<br />

(d) a summary of (a), (b) <strong>and</strong> (c) of <strong>the</strong> present paragraph<br />

<strong>in</strong> comprehensible, n<strong>on</strong>-technical language;<br />

(e) <strong>the</strong> public reports <strong>and</strong> op<strong>in</strong>i<strong>on</strong>s of <strong>the</strong> <strong>in</strong>volved entities<br />

addressed <strong>to</strong> <strong>the</strong> public authority related <strong>to</strong> <strong>the</strong> project<br />

or activity under c<strong>on</strong>siderati<strong>on</strong>;<br />

(f) a descripti<strong>on</strong> of <strong>the</strong> available technologies <strong>to</strong> be used<br />

<strong>and</strong> alternative locati<strong>on</strong>s for execut<strong>in</strong>g <strong>the</strong> project or<br />

activity subject <strong>to</strong> assessment, when <strong>the</strong> <strong>in</strong>formati<strong>on</strong> is<br />

available; <strong>and</strong>


<str<strong>on</strong>g>Regi<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>on</strong> <strong>Access</strong> <strong>to</strong> Informati<strong>on</strong>...<br />

(g) acti<strong>on</strong>s taken <strong>to</strong> m<strong>on</strong>i<strong>to</strong>r <strong>the</strong> implementati<strong>on</strong> <strong>and</strong> results<br />

of envir<strong>on</strong>mental impact assessment measures.<br />

The aforementi<strong>on</strong>ed <strong>in</strong>formati<strong>on</strong> shall be made available<br />

free of charge <strong>to</strong> <strong>the</strong> public <strong>in</strong> accordance with paragraph 17 of<br />

article 5 of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 8<br />

<strong>Access</strong> <strong>to</strong> justice <strong>in</strong> envir<strong>on</strong>mental matters<br />

1. Each Party shall guarantee <strong>the</strong> right of access <strong>to</strong> justice <strong>in</strong><br />

envir<strong>on</strong>mental matters <strong>in</strong> accordance with <strong>the</strong> guarantees of<br />

due process.<br />

2. Each Party shall ensure, <strong>in</strong> <strong>the</strong> framework of its domestic<br />

legislati<strong>on</strong>, access <strong>to</strong> judicial <strong>and</strong> adm<strong>in</strong>istrative mechanisms<br />

<strong>to</strong> challenge <strong>and</strong> appeal, with respect <strong>to</strong> substance <strong>and</strong><br />

procedure:<br />

(a) any decisi<strong>on</strong>, acti<strong>on</strong> or omissi<strong>on</strong> related <strong>to</strong> <strong>the</strong> access <strong>to</strong><br />

envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>;<br />

(b) any decisi<strong>on</strong>, acti<strong>on</strong> or omissi<strong>on</strong> related <strong>to</strong> public<br />

participati<strong>on</strong> <strong>in</strong> <strong>the</strong> decisi<strong>on</strong>-mak<strong>in</strong>g process regard<strong>in</strong>g<br />

envir<strong>on</strong>mental matters; <strong>and</strong><br />

(c) any o<strong>the</strong>r decisi<strong>on</strong>, acti<strong>on</strong> or omissi<strong>on</strong> that affects or<br />

could affect <strong>the</strong> envir<strong>on</strong>ment adversely or violate laws<br />

<strong>and</strong> regulati<strong>on</strong>s related <strong>to</strong> <strong>the</strong> envir<strong>on</strong>ment.<br />

3. To guarantee <strong>the</strong> right of access <strong>to</strong> justice <strong>in</strong> envir<strong>on</strong>mental<br />

matters, each Party shall have, c<strong>on</strong>sider<strong>in</strong>g its circumstances:<br />

(a) competent State entities with access <strong>to</strong> expertise <strong>in</strong><br />

envir<strong>on</strong>mental matters;<br />

(b) effective, timely, public, transparent <strong>and</strong> impartial procedures<br />

that are not prohibitively expensive;<br />

(c) broad active legal st<strong>and</strong><strong>in</strong>g <strong>in</strong> defence of <strong>the</strong> envir<strong>on</strong>ment,<br />

<strong>in</strong> accordance with domestic legislati<strong>on</strong>;<br />

(d) <strong>the</strong> possibility of order<strong>in</strong>g precauti<strong>on</strong>ary <strong>and</strong> <strong>in</strong>terim<br />

measures, <strong>in</strong>ter alia, <strong>to</strong> prevent, halt, mitigate or rehabilitate<br />

damage <strong>to</strong> <strong>the</strong> envir<strong>on</strong>ment;

(e) measures <strong>to</strong> facilitate <strong>the</strong> producti<strong>on</strong> of evidence of<br />

envir<strong>on</strong>mental damage, when appropriate <strong>and</strong> as<br />

applicable, such as <strong>the</strong> reversal of <strong>the</strong> burden of proof<br />

<strong>and</strong> <strong>the</strong> dynamic burden of proof;<br />

(f) mechanisms <strong>to</strong> execute <strong>and</strong> enforce judicial <strong>and</strong><br />

adm<strong>in</strong>istrative decisi<strong>on</strong>s <strong>in</strong> a timely manner; <strong>and</strong><br />

(g) mechanisms for redress, where applicable, such as<br />

restituti<strong>on</strong> <strong>to</strong> <strong>the</strong> c<strong>on</strong>diti<strong>on</strong> prior <strong>to</strong> <strong>the</strong> damage, res<strong>to</strong>rati<strong>on</strong>,<br />

compensati<strong>on</strong> or payment of a f<strong>in</strong>ancial penalty, satisfacti<strong>on</strong>,<br />

guarantees of n<strong>on</strong>-repetiti<strong>on</strong>, assistance for affected<br />

pers<strong>on</strong>s <strong>and</strong> f<strong>in</strong>ancial <strong>in</strong>struments <strong>to</strong> support redress.<br />

4. To facilitate access <strong>to</strong> justice <strong>in</strong> envir<strong>on</strong>mental matters for <strong>the</strong><br />

public, each Party shall establish:<br />

(a) measures <strong>to</strong> m<strong>in</strong>imize or elim<strong>in</strong>ate barriers <strong>to</strong> <strong>the</strong> exercise<br />

of <strong>the</strong> right of access <strong>to</strong> justice;<br />

(b) means <strong>to</strong> publicize <strong>the</strong> right of access <strong>to</strong> justice <strong>and</strong> <strong>the</strong><br />

procedures <strong>to</strong> ensure its effectiveness;<br />

(c) mechanisms <strong>to</strong> systematize <strong>and</strong> dissem<strong>in</strong>ate judicial <strong>and</strong><br />

adm<strong>in</strong>istrative decisi<strong>on</strong>s, as appropriate; <strong>and</strong><br />

(d) <strong>the</strong> use of <strong>in</strong>terpretati<strong>on</strong> or translati<strong>on</strong> of languages<br />

o<strong>the</strong>r than <strong>the</strong> official languages when necessary for <strong>the</strong><br />

exercise of that right.<br />

5. In order <strong>to</strong> give effect <strong>to</strong> <strong>the</strong> right of access <strong>to</strong> justice, each<br />

Party shall meet <strong>the</strong> needs of pers<strong>on</strong>s or groups <strong>in</strong> vulnerable<br />

situati<strong>on</strong>s by establish<strong>in</strong>g support mechanisms, <strong>in</strong>clud<strong>in</strong>g, as<br />

appropriate, free technical <strong>and</strong> legal assistance.<br />

6. Each Party shall ensure that <strong>the</strong> judicial <strong>and</strong> adm<strong>in</strong>istrative<br />

decisi<strong>on</strong>s adopted <strong>in</strong> envir<strong>on</strong>mental matters <strong>and</strong> <strong>the</strong>ir legal<br />

grounds are set out <strong>in</strong> writ<strong>in</strong>g.<br />

7. Each Party shall promote, where appropriate, alternative<br />

dispute resoluti<strong>on</strong> mechanisms <strong>in</strong> envir<strong>on</strong>mental matters,<br />

such as mediati<strong>on</strong>, c<strong>on</strong>ciliati<strong>on</strong> or o<strong>the</strong>r means that allow<br />

such disputes <strong>to</strong> be prevented or resolved.

Article 9<br />

Human rights defenders <strong>in</strong> envir<strong>on</strong>mental matters<br />

1. Each Party shall guarantee a safe <strong>and</strong> enabl<strong>in</strong>g envir<strong>on</strong>ment for<br />

pers<strong>on</strong>s, groups <strong>and</strong> organizati<strong>on</strong>s that promote <strong>and</strong> defend<br />

human rights <strong>in</strong> envir<strong>on</strong>mental matters, so that <strong>the</strong>y are able<br />

<strong>to</strong> act free from threat, restricti<strong>on</strong> <strong>and</strong> <strong>in</strong>security.<br />

2. Each Party shall take adequate <strong>and</strong> effective measures <strong>to</strong><br />

recognize, protect <strong>and</strong> promote all <strong>the</strong> rights of human rights<br />

defenders <strong>in</strong> envir<strong>on</strong>mental matters, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong>ir right <strong>to</strong><br />

life, pers<strong>on</strong>al <strong>in</strong>tegrity, freedom of op<strong>in</strong>i<strong>on</strong> <strong>and</strong> expressi<strong>on</strong>,<br />

peaceful assembly <strong>and</strong> associati<strong>on</strong>, <strong>and</strong> free movement,<br />

as well as <strong>the</strong>ir ability <strong>to</strong> exercise <strong>the</strong>ir access rights, tak<strong>in</strong>g<br />

<strong>in</strong><strong>to</strong> account its <strong>in</strong>ternati<strong>on</strong>al obligati<strong>on</strong>s <strong>in</strong> <strong>the</strong> field of human<br />

rights, its c<strong>on</strong>stituti<strong>on</strong>al pr<strong>in</strong>ciples <strong>and</strong> <strong>the</strong> basic c<strong>on</strong>cepts of<br />

its legal system.<br />

3. Each Party shall also take appropriate, effective <strong>and</strong> timely<br />

measures <strong>to</strong> prevent, <strong>in</strong>vestigate <strong>and</strong> punish attacks, threats<br />

or <strong>in</strong>timidati<strong>on</strong>s that human rights defenders <strong>in</strong> envir<strong>on</strong>mental<br />

matters may suffer while exercis<strong>in</strong>g <strong>the</strong> rights set out <strong>in</strong> <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 10<br />

Capacity-build<strong>in</strong>g<br />

1. In order <strong>to</strong> c<strong>on</strong>tribute <strong>to</strong> <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> provisi<strong>on</strong>s<br />

of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, each Party undertakes <strong>to</strong> create<br />

<strong>and</strong> streng<strong>the</strong>n nati<strong>on</strong>al capacities, based <strong>on</strong> its priorities<br />

<strong>and</strong> needs.<br />

2. Each Party, <strong>in</strong> l<strong>in</strong>e with its capacities, may take, <strong>in</strong>ter alia, <strong>the</strong><br />

follow<strong>in</strong>g measures:<br />

(a) tra<strong>in</strong> authorities <strong>and</strong> civil servants <strong>on</strong> envir<strong>on</strong>mental<br />

access rights;<br />

(b) develop <strong>and</strong> streng<strong>the</strong>n envir<strong>on</strong>mental law <strong>and</strong> access rights<br />

awareness-rais<strong>in</strong>g <strong>and</strong> capacity-build<strong>in</strong>g programmes for,<br />

<strong>in</strong>ter alia, <strong>the</strong> public, judicial <strong>and</strong> adm<strong>in</strong>istrative officials,<br />

nati<strong>on</strong>al human rights <strong>in</strong>stituti<strong>on</strong>s <strong>and</strong> jurists;

(c) provide <strong>the</strong> competent <strong>in</strong>stituti<strong>on</strong>s <strong>and</strong> entities with<br />

adequate equipment <strong>and</strong> resources;<br />

(d) promote educati<strong>on</strong> <strong>and</strong> tra<strong>in</strong><strong>in</strong>g <strong>on</strong>, <strong>and</strong> raise public<br />

awareness of, envir<strong>on</strong>mental matters, through, <strong>in</strong>ter alia,<br />

basic educati<strong>on</strong>al modules <strong>on</strong> access rights for students<br />

at all levels of educati<strong>on</strong>;<br />

(e) develop specific measures for pers<strong>on</strong>s or groups <strong>in</strong><br />

vulnerable situati<strong>on</strong>s, such as provid<strong>in</strong>g <strong>in</strong>terpreters or<br />

transla<strong>to</strong>rs <strong>in</strong> languages o<strong>the</strong>r than official languages<br />

when necessary;<br />

(f) acknowledge <strong>the</strong> importance of associati<strong>on</strong>s, organizati<strong>on</strong>s<br />

or groups that tra<strong>in</strong> <strong>the</strong> public <strong>on</strong> or raise public awareness<br />

of access rights; <strong>and</strong><br />

(g) streng<strong>the</strong>n capabilities <strong>to</strong> collect, reta<strong>in</strong> <strong>and</strong> evaluate<br />

envir<strong>on</strong>mental <strong>in</strong>formati<strong>on</strong>.<br />

Article 11<br />

Cooperati<strong>on</strong><br />

1. The Parties shall cooperate <strong>to</strong> streng<strong>the</strong>n <strong>the</strong>ir nati<strong>on</strong>al<br />

capacities with <strong>the</strong> aim of implement<strong>in</strong>g <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g><br />

<strong>in</strong> an effective manner.<br />

2. The Parties shall give particular c<strong>on</strong>siderati<strong>on</strong> <strong>to</strong> least developed<br />

countries, l<strong>and</strong>locked develop<strong>in</strong>g countries <strong>and</strong> small isl<strong>and</strong><br />

develop<strong>in</strong>g States from Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong>.<br />

3. For <strong>the</strong> purposes of implement<strong>in</strong>g paragraph 2 of <strong>the</strong> present<br />

article, <strong>the</strong> Parties shall promote activities <strong>and</strong> mechanisms,<br />

such as:<br />

(a) discussi<strong>on</strong>s, workshops, expert exchanges, technical<br />

assistance, educati<strong>on</strong> <strong>and</strong> observa<strong>to</strong>ries;<br />

(b) develop<strong>in</strong>g, shar<strong>in</strong>g <strong>and</strong> implement<strong>in</strong>g educati<strong>on</strong>al, tra<strong>in</strong><strong>in</strong>g<br />

<strong>and</strong> awareness-rais<strong>in</strong>g materials <strong>and</strong> programmes;<br />

(c) shar<strong>in</strong>g experiences of voluntary codes of c<strong>on</strong>duct,<br />

guidel<strong>in</strong>es, good practices <strong>and</strong> st<strong>and</strong>ards; <strong>and</strong>

(d) committees, councils <strong>and</strong> forums of multisec<strong>to</strong>ral<br />

development stakeholders <strong>to</strong> address cooperati<strong>on</strong><br />

priorities <strong>and</strong> activities.<br />

4. The Parties shall encourage partnerships with States<br />

from o<strong>the</strong>r regi<strong>on</strong>s, <strong>in</strong>tergovernmental, n<strong>on</strong>-governmental,<br />

academic <strong>and</strong> private organizati<strong>on</strong>s, as well as civil society<br />

organizati<strong>on</strong>s <strong>and</strong> o<strong>the</strong>r relevant stakeholders <strong>to</strong> implement<br />

<strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

5. The Parties recognize that regi<strong>on</strong>al cooperati<strong>on</strong> <strong>and</strong> <strong>in</strong>formati<strong>on</strong>shar<strong>in</strong>g<br />

shall be promoted <strong>in</strong> relati<strong>on</strong> <strong>to</strong> all aspects of illicit<br />

activities aga<strong>in</strong>st <strong>the</strong> envir<strong>on</strong>ment.<br />

Article 12<br />

Clear<strong>in</strong>g house<br />

The Parties shall have a virtual <strong>and</strong> universally accessible clear<strong>in</strong>g<br />

house <strong>on</strong> access rights. The clear<strong>in</strong>g house will be operated by<br />

<strong>the</strong> Ec<strong>on</strong>omic Commissi<strong>on</strong> for Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong>, <strong>in</strong><br />

its capacity as Secretariat, <strong>and</strong> may <strong>in</strong>clude, <strong>in</strong>ter alia, legislative,<br />

adm<strong>in</strong>istrative <strong>and</strong> policy measures, codes of c<strong>on</strong>duct <strong>and</strong> good<br />

practices.<br />

Article 13<br />

Nati<strong>on</strong>al implementati<strong>on</strong><br />

Each Party, <strong>to</strong> <strong>the</strong> extent of its ability <strong>and</strong> <strong>in</strong> accordance with its<br />

nati<strong>on</strong>al priorities, commits <strong>to</strong> provide <strong>the</strong> resources for nati<strong>on</strong>al<br />

activities that are needed <strong>to</strong> fulfil <strong>the</strong> obligati<strong>on</strong>s derived from <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 14<br />

Voluntary Fund<br />

1. A Voluntary Fund is hereby established <strong>to</strong> support <strong>the</strong> f<strong>in</strong>anc<strong>in</strong>g<br />

of <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, <strong>the</strong> functi<strong>on</strong><strong>in</strong>g<br />

of which shall be def<strong>in</strong>ed by <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties.<br />

2. Parties may make voluntary c<strong>on</strong>tributi<strong>on</strong>s <strong>to</strong> support <strong>the</strong><br />

implementati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.

3. The C<strong>on</strong>ference of <strong>the</strong> Parties may seek, <strong>in</strong> accordance with<br />

paragraph 5(g) of article 15 of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, <strong>to</strong><br />

obta<strong>in</strong> funds from o<strong>the</strong>r sources <strong>to</strong> support <strong>the</strong> implementati<strong>on</strong><br />

of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 15<br />

C<strong>on</strong>ference of <strong>the</strong> Parties<br />

1. A C<strong>on</strong>ference of <strong>the</strong> Parties is hereby established.<br />

2. The Executive Secretary of <strong>the</strong> Ec<strong>on</strong>omic Commissi<strong>on</strong> for Lat<strong>in</strong><br />

<strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong> shall c<strong>on</strong>vene <strong>the</strong> first meet<strong>in</strong>g<br />

of <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties no later than <strong>on</strong>e year after<br />

<strong>the</strong> entry <strong>in</strong><strong>to</strong> force of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>. Subsequently,<br />

ord<strong>in</strong>ary meet<strong>in</strong>gs of <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties shall be<br />

held at regular <strong>in</strong>tervals <strong>to</strong> be decided by <strong>the</strong> C<strong>on</strong>ference.<br />

3. Extraord<strong>in</strong>ary meet<strong>in</strong>gs of <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties shall<br />

be held when <strong>the</strong> C<strong>on</strong>ference deems necessary.<br />

4. At its first meet<strong>in</strong>g, <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties shall:<br />

(a) discuss <strong>and</strong> adopt by c<strong>on</strong>sensus its rules of procedure,<br />

<strong>in</strong>clud<strong>in</strong>g <strong>the</strong> modalities for significant participati<strong>on</strong> by<br />

<strong>the</strong> public; <strong>and</strong><br />

(b) discuss <strong>and</strong> adopt by c<strong>on</strong>sensus <strong>the</strong> f<strong>in</strong>ancial provisi<strong>on</strong>s<br />

that are necessary for <strong>the</strong> functi<strong>on</strong><strong>in</strong>g <strong>and</strong> implementati<strong>on</strong><br />

of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

5. The C<strong>on</strong>ference of <strong>the</strong> Parties shall exam<strong>in</strong>e <strong>and</strong> promote <strong>the</strong><br />

implementati<strong>on</strong> <strong>and</strong> effectiveness of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

To that end:<br />

(a) it shall establish by c<strong>on</strong>sensus such subsidiary bodies<br />

as it deems necessary for <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

(b) it shall receive <strong>and</strong> c<strong>on</strong>sider reports <strong>and</strong> recommendati<strong>on</strong>s<br />

from subsidiary bodies;<br />

(c) it shall be <strong>in</strong>formed by <strong>the</strong> Parties of <strong>the</strong> measures adopted<br />

<strong>to</strong> implement <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

(d) it may formulate recommendati<strong>on</strong>s <strong>to</strong> <strong>the</strong> Parties <strong>on</strong> <strong>the</strong><br />

implementati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;

(e) it shall prepare <strong>and</strong> adopt, as applicable, pro<strong>to</strong>cols <strong>to</strong><br />

<strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> for its subsequent signature,<br />

ratificati<strong>on</strong>, acceptance, approval <strong>and</strong> accessi<strong>on</strong>;<br />

(f) it shall exam<strong>in</strong>e <strong>and</strong> adopt proposals <strong>to</strong> amend <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>in</strong> accordance with <strong>the</strong> provisi<strong>on</strong>s of article<br />

20 of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

(g) it shall establish guidel<strong>in</strong>es <strong>and</strong> modalities for mobiliz<strong>in</strong>g<br />

f<strong>in</strong>ancial <strong>and</strong> n<strong>on</strong>-f<strong>in</strong>ancial resources from various sources<br />

<strong>to</strong> facilitate <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

(h) it shall exam<strong>in</strong>e <strong>and</strong> adopt any additi<strong>on</strong>al measures needed<br />

<strong>to</strong> achieve <strong>the</strong> objective of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>; <strong>and</strong><br />

(i) it shall perform any o<strong>the</strong>r functi<strong>on</strong> assigned <strong>to</strong> it by <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 16<br />

Right <strong>to</strong> vote<br />

Each Party <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall have <strong>on</strong>e vote.<br />

Article 17<br />

Secretariat<br />

1. The Executive Secretary of <strong>the</strong> Ec<strong>on</strong>omic Commissi<strong>on</strong> for Lat<strong>in</strong><br />

<strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong> shall carry out <strong>the</strong> secretariat<br />

functi<strong>on</strong>s of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

2. The functi<strong>on</strong>s of <strong>the</strong> Secretariat shall be as follows:<br />

(a) <strong>to</strong> c<strong>on</strong>vene <strong>and</strong> organize <strong>the</strong> meet<strong>in</strong>gs of <strong>the</strong> C<strong>on</strong>ference<br />

of <strong>the</strong> Parties <strong>and</strong> its subsidiary bodies <strong>and</strong> provide <strong>the</strong><br />

necessary services;<br />

(b) <strong>to</strong> provide assistance <strong>to</strong> <strong>the</strong> Parties up<strong>on</strong> <strong>the</strong>ir request for<br />

capacity-build<strong>in</strong>g, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> shar<strong>in</strong>g of experiences<br />

<strong>and</strong> <strong>in</strong>formati<strong>on</strong> <strong>and</strong> <strong>the</strong> organizati<strong>on</strong> of activities <strong>in</strong><br />

accordance with articles 10, 11 <strong>and</strong> 12 of <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g>;<br />

c<strong>on</strong>tractual arrangements needed <strong>to</strong> carry out its functi<strong>on</strong>s<br />

effectively; <strong>and</strong>

(d) <strong>to</strong> perform any o<strong>the</strong>r secretariat functi<strong>on</strong>s specified <strong>in</strong> <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>and</strong> any o<strong>the</strong>r functi<strong>on</strong>s as determ<strong>in</strong>ed<br />

by <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties.<br />

Article18<br />

Committee <strong>to</strong> Support Implementati<strong>on</strong> <strong>and</strong> Compliance<br />

1. A Committee <strong>to</strong> Support Implementati<strong>on</strong> <strong>and</strong> Compliance is<br />

hereby established as a subsidiary body of <strong>the</strong> C<strong>on</strong>ference<br />

of <strong>the</strong> Parties <strong>to</strong> promote <strong>the</strong> implementati<strong>on</strong> of <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>and</strong> <strong>to</strong> support <strong>the</strong> Parties <strong>in</strong> that regard. The rules<br />

relat<strong>in</strong>g <strong>to</strong> its structure <strong>and</strong> functi<strong>on</strong>s shall be determ<strong>in</strong>ed by<br />

<strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties at its first meet<strong>in</strong>g.<br />

2. The Committee shall be of a c<strong>on</strong>sultative <strong>and</strong> transparent<br />

nature, n<strong>on</strong>-adversarial, n<strong>on</strong>-judicial <strong>and</strong> n<strong>on</strong>-punitive <strong>and</strong><br />

shall review compliance of <strong>the</strong> provisi<strong>on</strong>s of <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>and</strong> formulate recommendati<strong>on</strong>s, <strong>in</strong> accordance<br />

with <strong>the</strong> rules of procedure established by <strong>the</strong> C<strong>on</strong>ference of<br />

<strong>the</strong> Parties, ensur<strong>in</strong>g <strong>the</strong> significant participati<strong>on</strong> of <strong>the</strong> public<br />

<strong>and</strong> pay<strong>in</strong>g particular attenti<strong>on</strong> <strong>to</strong> <strong>the</strong> nati<strong>on</strong>al capacities <strong>and</strong><br />

circumstances of <strong>the</strong> Parties.<br />

Article 19<br />

Settlement of disputes<br />

1. If a dispute arises between two or more Parties about <strong>the</strong><br />

<strong>in</strong>terpretati<strong>on</strong> or applicati<strong>on</strong> of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, <strong>the</strong>y<br />

shall seek a soluti<strong>on</strong> by negotiati<strong>on</strong> or by any o<strong>the</strong>r means of<br />

dispute settlement acceptable <strong>to</strong> <strong>the</strong> parties <strong>to</strong> <strong>the</strong> dispute.<br />

2. When sign<strong>in</strong>g, ratify<strong>in</strong>g, accept<strong>in</strong>g, approv<strong>in</strong>g or acced<strong>in</strong>g <strong>to</strong><br />

<strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, or at any time <strong>the</strong>reafter, a Party may<br />

declare <strong>in</strong> writ<strong>in</strong>g <strong>to</strong> <strong>the</strong> Depositary that, for a dispute not resolved<br />

<strong>in</strong> accordance with paragraph 1 of <strong>the</strong> present article, it accepts<br />

<strong>on</strong>e or both of <strong>the</strong> follow<strong>in</strong>g means of dispute settlement as<br />

compulsory <strong>in</strong> relati<strong>on</strong> <strong>to</strong> any Party accept<strong>in</strong>g <strong>the</strong> same obligati<strong>on</strong>:<br />

(a) submissi<strong>on</strong> of <strong>the</strong> dispute <strong>to</strong> <strong>the</strong> Internati<strong>on</strong>al Court of <strong>Justice</strong>;<br />

(b) arbitrati<strong>on</strong> <strong>in</strong> accordance with <strong>the</strong> procedures that <strong>the</strong><br />

C<strong>on</strong>ference of <strong>the</strong> Parties will establish.

3. If <strong>the</strong> parties <strong>to</strong> <strong>the</strong> dispute have accepted both means of<br />

dispute settlement referred <strong>to</strong> <strong>in</strong> paragraph 2 of <strong>the</strong> present<br />

article, <strong>the</strong> dispute may be submitted <strong>on</strong>ly <strong>to</strong> <strong>the</strong> Internati<strong>on</strong>al<br />

Court of <strong>Justice</strong>, unless <strong>the</strong> parties agree o<strong>the</strong>rwise.<br />

Article 20<br />

Amendments<br />

1. Amendments <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> may be proposed<br />

by any Party.<br />

2. Amendments <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall be adopted at<br />

a meet<strong>in</strong>g of <strong>the</strong> C<strong>on</strong>ference of <strong>the</strong> Parties. The text of any<br />

proposed amendment shall be communicated <strong>to</strong> <strong>the</strong> Parties<br />

by <strong>the</strong> Secretariat at least six m<strong>on</strong>ths before <strong>the</strong> meet<strong>in</strong>g at<br />

which it is proposed for adopti<strong>on</strong>. The Secretariat shall also<br />

communicate <strong>the</strong> proposed amendment <strong>to</strong> <strong>the</strong> signa<strong>to</strong>ries <strong>to</strong><br />

<strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> <strong>and</strong>, for <strong>in</strong>formati<strong>on</strong>, <strong>to</strong> <strong>the</strong> Depositary.<br />

3. The Parties shall make every effort <strong>to</strong> reach a c<strong>on</strong>sensus<br />

<strong>on</strong> any proposed amendment <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>. In<br />

<strong>the</strong> event that <strong>the</strong> efforts <strong>to</strong> reach a c<strong>on</strong>sensus fail, as a last<br />

resort, <strong>the</strong> amendment shall be adopted by a three-fourths<br />

majority vote of <strong>the</strong> Parties present <strong>and</strong> vot<strong>in</strong>g at <strong>the</strong> meet<strong>in</strong>g.<br />

4. An adopted amendment shall be communicated by <strong>the</strong><br />

Depositary <strong>to</strong> all Parties for ratificati<strong>on</strong>, acceptance or approval.<br />

5. Ratificati<strong>on</strong>, acceptance or approval of an amendment<br />

shall be notified <strong>to</strong> <strong>the</strong> Depositary <strong>in</strong> writ<strong>in</strong>g. An amendment<br />

adopted <strong>in</strong> accordance with paragraph 3 of <strong>the</strong> present article<br />

shall enter <strong>in</strong><strong>to</strong> force for <strong>the</strong> Parties hav<strong>in</strong>g c<strong>on</strong>sented <strong>to</strong> be<br />

bound by it <strong>on</strong> <strong>the</strong> n<strong>in</strong>etieth day after <strong>the</strong> date of deposit of<br />

<strong>the</strong> <strong>in</strong>struments of ratificati<strong>on</strong>, acceptance or approval by at<br />

least half of <strong>the</strong> number of Parties <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g><br />

at <strong>the</strong> time <strong>the</strong> amendment was adopted. Thereafter, <strong>the</strong><br />

amendment shall enter <strong>in</strong><strong>to</strong> force for any o<strong>the</strong>r Party that<br />

c<strong>on</strong>sents <strong>to</strong> be bound by it <strong>on</strong> <strong>the</strong> n<strong>in</strong>etieth day after <strong>the</strong><br />

date of deposit of its <strong>in</strong>strument of ratificati<strong>on</strong>, acceptance<br />

or approval of <strong>the</strong> amendment.

Article 21<br />

Signature, ratificati<strong>on</strong>, acceptance, approval <strong>and</strong> accessi<strong>on</strong><br />

1. The present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall be open for signature by any of<br />

<strong>the</strong> countries of Lat<strong>in</strong> <strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong> <strong>in</strong>cluded<br />

<strong>in</strong> annex 1 at United Nati<strong>on</strong>s Headquarters <strong>in</strong> New York from<br />

27 September 2018 <strong>to</strong> 26 September 2020.<br />

2. The present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall be subject <strong>to</strong> <strong>the</strong> ratificati<strong>on</strong>,<br />

acceptance or approval of <strong>the</strong> States that have signed<br />

it. It shall be open <strong>to</strong> accessi<strong>on</strong> by any country <strong>in</strong> Lat<strong>in</strong><br />

<strong>America</strong> <strong>and</strong> <strong>the</strong> <strong>Caribbean</strong> <strong>in</strong>cluded <strong>in</strong> annex 1 that has not<br />

signed it from <strong>the</strong> day after <strong>the</strong> date <strong>on</strong> which it is closed for<br />

signature. Instruments of ratificati<strong>on</strong>, acceptance, approval<br />

or accessi<strong>on</strong> shall be deposited with <strong>the</strong> Depositary.<br />

Article 22<br />

Entry <strong>in</strong><strong>to</strong> force<br />

1. The present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall enter <strong>in</strong><strong>to</strong> force <strong>on</strong> <strong>the</strong> n<strong>in</strong>etieth<br />

day after <strong>the</strong> date of deposit of <strong>the</strong> eleventh <strong>in</strong>strument of<br />

ratificati<strong>on</strong>, acceptance, approval or accessi<strong>on</strong>.<br />

2. For each State that ratifies, accepts or approves <strong>the</strong> present<br />

<str<strong>on</strong>g>Agreement</str<strong>on</strong>g> or accedes <strong>the</strong>re<strong>to</strong> after <strong>the</strong> deposit of <strong>the</strong> eleventh<br />

<strong>in</strong>strument of ratificati<strong>on</strong>, acceptance, approval or accessi<strong>on</strong>,<br />

<strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> shall enter <strong>in</strong><strong>to</strong> effect <strong>on</strong> <strong>the</strong> n<strong>in</strong>etieth<br />

day after <strong>the</strong> date of deposit by such State of its <strong>in</strong>strument<br />

of ratificati<strong>on</strong>, acceptance, approval or accessi<strong>on</strong>.<br />

Article 23<br />

Reservati<strong>on</strong>s<br />

No reservati<strong>on</strong>s may be made <strong>to</strong> <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 24<br />

Withdrawal<br />

1. At any time after three years from <strong>the</strong> date <strong>on</strong> which <strong>the</strong><br />

present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> has entered <strong>in</strong><strong>to</strong> force for a Party, that<br />

Party may withdraw from <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g> by giv<strong>in</strong>g<br />

written notificati<strong>on</strong> <strong>to</strong> <strong>the</strong> Depositary.

2. Any such withdrawal shall take effect up<strong>on</strong> expiry of <strong>on</strong>e year<br />

from <strong>the</strong> date of receipt by <strong>the</strong> Depositary of <strong>the</strong> notificati<strong>on</strong><br />

of withdrawal, or <strong>on</strong> such later date as may be specified <strong>in</strong><br />

<strong>the</strong> notificati<strong>on</strong> of withdrawal.<br />

Article 25<br />

Depositary<br />

The Secretary-General of <strong>the</strong> United Nati<strong>on</strong>s shall be <strong>the</strong> Depositary<br />

for <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />

Article 26<br />

Au<strong>the</strong>ntic texts<br />

The orig<strong>in</strong>al of <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>, <strong>the</strong> Spanish <strong>and</strong> English<br />

texts of which are equally au<strong>the</strong>ntic, shall be deposited with <strong>the</strong><br />

Secretary-General of <strong>the</strong> United Nati<strong>on</strong>s.<br />

IN WITNESS WHEREOF, <strong>the</strong> undersigned, duly authorized,<br />

have signed <strong>the</strong> present <str<strong>on</strong>g>Agreement</str<strong>on</strong>g>.<br />
