Nevertheless, many manufacturersevaded their responsibilities and did not participateas required in the dual systems. This should now be over:In order to increase transparency, fairness and control inthe market of packaging disposal, the Central PackagingRegistry (ZSVR, headquartered in Osnabrück) was createdas a new federal agency. Anyone who places packagingfilled with goods (including filling material) into commercialcirculation on the German market for the first time,that ends up at end users as waste, must register with theCentral Packaging Registry. This initial distributor can bea producer, importer, online or mail-order distributor, icertain cases also a promotional product distributor.Mandatory registration and reportingThe Central Packaging Registry administers the LUpackaging register in which companies must registemaster data and brand names. In addition, they mport the quantities of packaging (broken down into mterial types) they have placed on the market each year.More specifi cally, this means that all information submittedin connection with participation in the German DualSystem must be sent to the LUCID packaging registersimultaneously and with identical wording. Conversely,the registration number of the Central Packaging Registryis mandatory for registration with the Dual System,otherwise registration is not possible. The dual systemsare also obligated to report data. There are no de minimislimits. Mandatory registration and reporting cannotbe transferred to third parties. Accordingly,the packaging register can be used at anytime to check who is responsible for productresponsibility. This should promote faircompetition. Anyone who does not complywith the Act thus runs a high risk ofbeing discovered. In the worst case, theremay be a ban on sales of the affectedproducts and six-digit fines.
